The adjacent tidal wetlands were maniPulated by trenching for Purposes Of Mosquito control. Attached herewith are three aerial photographs taken 1984 (prior to the subdlivi ' sion a three aeia pproval),2001 and 2017. All rl photos depict disturbed and manipulated nature of the upland habitat, the tidal wetlands as altered by trenching, and the wetland boundary as delineated by this Firm on September 27, 2012, confirmed by NYSDEC in 2014 and reconfirmed by Suffolk Environmental Consulting Inc. on November 30"2017. The land boundary is dominated by mature ward edge of the wetland groundsel bush (Boccharis hulimifolia). The eleva ion of the marsh area is 4-5 feet lower than the a�djacent uplands and the transition from Hands to uplands is decidedly abrupt. Successional Old Fields are common throughout the North Fork of Long Island. �CONCLUSION Lot#1 consists of 92,521 ft.'and meets and exceeds all development restrictions set forth the Suffolk County Sanitary Code in ,and Article 24 of the Environmental Conservation Law.The parcel was approved by the Southold Town Planning Board. The development of the parcel can easily comply provisions Of Suffolk County Sanitary Code.. Article 24 of Environmental Conservation Law, and §275 of the Sou thold Town Code. The subject parcel is part of Lot I of the subdivision of Ken Strachan at Orient. On 2/23/1987 the Planning Board approved this parcel together with the attached flag shown as"part of Lot I" which was 'Intended to be the open space (non-buildable) attached to the lot. In 1990 the New York State DEC purchased from Strachan the non-buildable "part of lot 1". No town approvals were obtained before the NYS acquired the parcel,however,the Town of Southold did support the State purchases in Orient. This was a purchase not a condemnation proceeding. Thereafter,,the Town of Southold up-zoned this area of Orient to R-120(5 acre). The balance of the parcel became non-conforming and an area variance is required in order to"legalize"the acquisition by the New York State DEC. This area variance will legalize what the State and Town believed to be in the best interest of the community. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The owner wishes to sell the parcel and Mr. Ruocco wishes to purchase the parcel and construct a single family dwelling. The NY State DEC acquisition had unintended consequences for the owner of the property. Because the lot dimensions changed and the lot is not conforming to zoning the building department can not issue a building permit for the construction of a single family dwelling. The contract is conditioned on approval of the variance and Planning Board approval of the "lot line change". (3) The amount of relief requested is not substantial because: The subdivision was approved with the same plan as is proposed in this application. Due to the lack of public water, sole source aquifer, expected high groundwater and close proximity to surface wafers in this area, the development of a future residential structure is expected to contribute to the incremental and compounding adverse affects to groundwater and surface water quality over time. The app licant has indicated that a future landowner will construct a single family residence on lot 9.4 with a new sanitary system capable of contributing nitrogen and other contaminants to groundwater and ultimately sLirface waters. Several recent studies have linked on-site sanitary systems with contributing Nitrogen to surface waters resulting in impacts that include; algal blooms, hypoxia and fish kills. In local waters, after atmospheric deposition, groundwater is estimated as the second largest external source of Nitrogen, totaling 21 percent of the total Nitrogen load. To mitigate future impacts from a sanitary system, it is recommneded that the Board require the installation of a alternative on-site sewage disposal systems capable of achieving a reduction of total nitrogen to approximately 19mg/l to preserve ground and surface water quality. The subject parcel is part of Lot I of the subdivision of Ken Strachan at Orient. On 2/23/1987 the Planning Board approved this parcel together with the attached flag shown as"part of Lot I" which was intended to be the open space (non-buildable) attached to the lot. In 1990 the New York State DEC purchased from Strachan the non-buildable "part of lot V. No town approvals were obtained before the NYS acquired the parcel,however,the Town of Southold did support the State purchases in Orient. This was a purchase not a condemnation proceeding. Thereafter,the Town of Southold up-zoned this area of Orient to R-120(5 acre). The variance application asks for permission to build on two lots--9.4and 9.5—on Narrow River Road (near King Street) even though the two lots comprise only 3.2 acres|nezoning district requiring a minimum of acres. On the Suffolk County Tax map, however, lot 9.5 is listed as being ENTIRELY owned by New York State. Unless the tax map is incorrect in ascribing ownership of lot 8.5 to NYS, this action for a variance cannot proceed. No property belonging to NYS can be acted upon without its consent—and there is no evidence of any consent from New York State in the record. Z. |n Point 1ofthe application,the applicant asks for an area variance "in order to '|egaUze'the acquisition by the New York State DEC." May an action to "'legalize" something done by NYS undertaken without the consent or involvement ofNYS7 There appears to be nothing in the application for a variance showing consent from NYS to "legalize" anything that it did, nor is NYS a party to this proceeding which might be necessary in order to "legalize" what it did. (And what does the applicant mean by"legalize"—is the applicant suggesting that NYS did something "illegal" in its acquisition?") 3 What |s the real ownership of lot 95? The Town of Southold Property Record Card submitted with the application shows the property number as 9.2 with a line drawn through itand with the number9.4 placed above'It. On the card, |t ap pea cs that 1n19BO, l.ZB followed by an illegible word was"sp|it..10 DEC." But the remaining acreage in lot 9.4 is not given. No information ls given about lot 9.5. (n other words,the property records are deeply confusing at a minimum. 4. |f the Suffolk County tax map is incorrect about the ownership of lot 9.5, and NYSacqu|red only a portion of that lot, how much do the Strachans.own of that lot?When that portion is combined with lot 9.4,what is the total acreage of the two lots?The pending application |s for a lot area variance, but the actual lot area owned by the applicant is unclear. � u�^ \ 0� �� 2 5. If the Board agrees with my concerns about property ownership and notice, I believe that a rehearing of the application isjustified, But,nf course,there isno need to reach the issue ofa rehearing based on these concerns, because the request for a variance should be denied for the reasons | have presented hz the Board before, is ec fully, ly XnElizabeth Holum .,1,012 RECEIVED EP 21 209 Statement by Elizabeth Holtzman ZONING BOARD OF APPEALS To the Southold Town Board of Zoning Appeals Regarding a Variance Application for two non-conforming lots On Narrow River Road Next to King Street(Strachan property) Se pte m be r 20, 2017 1 wish to provide supplemental objections to my earlier submission to the Board at the public hearing on September 7., 2017 as follows: The five-acre zoning that applies to these lots was adopted by Southold Town as a result of the heroic efforts of my former neighbor,the legendary Ruth Oliva,who was a member of this Board,to preserve the special rural character of Orient—its vistas of the wetlands and water, its natural beauty— for the benefit not only of the residents of Orient and indeed the whole town of Southold, but for future generations as well. Ms. Oliva's house, where her husband still lives, is diagonally across the road from the property in question here. If she were alive today,she would be fighting the variance tooth and nail, and a decision to grant the variance would be a personal slap by the Board at her family and her memory. By law, a variance from the five-acre zoning cannot be granted without any basis. Otherwise it is arbitrary and capricious, and therefore unlawful—and accordingly cannot withstand court scrutiny. In particular, given the rural character and surroundings of the property—consisting of wetlands, a stream,Orient Harbor—and the existing open space around them as you face the wetlands and the Harbor,the granting of a variance cannot be done lightly or willy-nilly. As you know, pursuant to Town Law 267-b(3)(b), special care must be taken to weigh the benefit to the applicant if the variance is granted—here a greater monetary value for the property--against the clear detriment to the health, safety and welfare of the neighborhood by the grant of a variance. The Town Board's decision to impose five-acre zoning in this portion of Orient reflected a valid policy determination that the basic health,safety and welfare of the area was best served by imposing restrictive zoning regulations that would protect the open spaces and rural character of Orient,as well the environmentally sensitive character of certain areas,such as the one that is the subject of this application. The Strachan variance application,which seeks to construct a residence on a parcel that is only approximately 3.2 acres in size and is constrained by certain environmental conditions that further restrict the parcel's ability to be developed, seeks to undermine the very purposes of the five-acre zoning. Moreover, in an attempt to justify the variance, the applicant gives incorrect, incomplete and 2 unpersuasive reasons. On this basis alone,the application must be rejected, and the Board cannot approve the variance. Let us examine the applicant's reasons in light of the five factors that the Board must consider when weighing the merits of this application. 1. An undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties will be created by the granting of the area variance. The area surrounding the Subject Property on the same side of Narrow River Road has only one house on it—located well off the road—for more than a mile. If the Board grants the requested variance,this will create an undesirable change in the character of the community and be a detriment to nearby properties, including mine. As a justification for the variance,the applicant claims that"this area variance will legalize what the State and Town believed to be in the best interest of the community." Even if true, and there is no evidence that it is true,whatever the State and Town may have believed twenty seven years ago is not really relevant today. First of all,the New York State Department of Environmental Conservation (""NYSDEC") made no decision about zoning, so that part of the applicant's claim is simply untrue.As for the Town,after that purchase was made,the Town adopted a five-acre zoning requirement which demonstrates clearly what it believes—which is that homes on lots of at least five acres, and not 3.2 acres,are best for the Town and Orient. Simply put,the variance will produce an adverse and undesirable change in the character of the neighborhood and will be a detriment to the nearby properties. It will increase water pollution; it will destroy existing beautiful vistas; it will decrease open space. 2. The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue,other than an area variance. 11 The applicant is seeking to construct a single-family home on a lot that fails to comply with the applicable five-acre zoning regulations. This provides the applicant with at least two feasible options to pursue. The first is that the applicant can seek to acquire additional property in order to meet the minimum lot area requirement. Alternatively,the applicant could sell the property to an adjacent property owner to enhance the development potential of the adjacent property.There are other options as well, none of which is addressed by the applicant. 3. The requested area variance is substantial. The applicant's attempt to demonstrate that the requested variance is not substantial is both ridiculous and wrong. It claims that the relief requested is not substantial because if the original 1970 zoning were still in place, building could take place on the property.That is an absurd argument because the merits of a variance application must be considered in light of existinz zoning regulations, not prior ones. A 36% lot area deficiency is, by any measure,substantial and any arguments to the contrary should be summarily dismissed. The five acre zoning was put in place precisely to protect Orient"s open space and environmentally-sensitive lands. The relief requested is substantial and, if granted,will 3 destroy beautiful vistas of Orient Harbor and wetlands, and create more pollution of the Harbor and the surrounding waters. 4. The proposed variance will have on adverse effect or impact on the physical or environmental conditions in the neighborhood or district. In an attempt to justify the variance,the applicant incorrectly claims that"the building envelope will be located oput[sic] of the flood zone." Whatever this claim means given the typo,the survey shows clearly that the "flood z obe-1i he' intrudes substantially-into the property on two'sides- And thatflood' line, as we all know,will only be enlarged with the rising waters in the bay resulting from climate change. The applicant also falls to acknowledge that wetlands exist on the property. Not only are wetlands ON the lots, but there is a stream, which is part of the wetlands,that may be on the property as well. While the survey does not show the location of the stream, it either is on the property or directly abuts it, creating an environmentally-sensitive condition. I know that there is a stream there because I walk by it and have kayaked on it. The stream runs from almost King Street back to Hallocks Bay,and also, as a result of Hurricane Sandy,to Orient Harbor. The significance of the existence of wetlands on the property and the stream is that pollution from the septic tank or whatever system the new owner will use to deal with waste water will seep into the wetlands and the stream and pollute Hallocks Bay and Orient Harbor. This is completely unacceptable. The Board must take into account the need to preserve this fragile environment and protect it from pollution. (it is important to point out that additional development is likely to take place on several adjacent lots that are being offered for sale by the same owners). If development takes place on those lots,then the variance will simply add more pollution to a sensitive environmental area. No disclosure of this problem was made by the applicant. Similarly,the Board should not ignore the applicant's failure to be candid about the flood lines,the wetlands and the stream on or near the property in an attempt to have the Board view its application in a better light. The applicant's justification is also misleading because it states that NYSEC did not acquire the buildable portion of the property when it made its purchase of the several surrounding lots,suggesting by its wording that NYSDEC acquired all the wetlands leaving only buildable space.That is untrue. Because the applicant's attempts to argue that the variance will not have an adverse effect or impact on the physical or'environmental conditions in the neighborhood are incomplete,inaccurate and misleading—and because the variance will, in fact, have an adverse impact on the physical and environmental conditions of the neighborhood,the variance request must be rejected. 5. The alleged difficulty was self-created. While the applicant claims that the alleged difficulty presented by this application was not self- created,that is flatly incorrect. It was the FAILURE of the owners in 1990,twenty-seven years ago.,to 4 take corrective action after the NYSDEC acquired a part of the parcel that created the alleged difficulty. The applicant basically acknowledges this by stating that the property owner acted "without realizing" that further action had to be taken to protect his rights to the pre-existing zoning rules. By that admission,THE ALLEGED DIFFICULTY WAS SELF-CREATED. For the reasons stated above, and because the applicant has failed to provide full and candid responses or take into account salient facts such as the adverse impact the variance will have on the neighborhood and the physical and environmental conditions of Orient, no variance should—or in my opinion can legally—be granted. In addition., it is my understanding that several residents of the area who are interested in the applicant were not provided with proper notice of the September 7, 2017 public hearing, as required by law, because the notice was ripped off, probably by the strong winds that weekend just before the hearing. (The applicant at the hearing acknowledged knowing only that the notice was up as of the Friday before the hearing.)These persons also did NOT have actual notice of the hearing. The DEC's acquisittpti plan met with steep resistance from the affected Orient owners as well as the Southold Board of Trustees.2 In January, 1989,the Town Board adopted Local Law#I of 1989,the adoption of a comprehensive amendment of the Town zoning code and map. In February 1989 the Strachans received the DEC notice of a public hearing with,respect to I - Confronted with the State)s ntc*ntiell of eminent domain proceedings and negotiation opportunities.' I i proceeding with acquisition of the wetland portion of their property,the Strachan's entered into negotiations with the DEC in the Fall of 1989 resulting in the conveyance of the wetlands portion of Lot 41 to the State. The State did not acquire the entire parcel and did not compensate the Strachans for the remaining residential development potential of their property. The remaining"buildable" PC)rtiOn of Lot I was 83,283 sq-ft, (in excess of 2 acres). The"buildable"portion of the lot was not affected by the State purchase nor is it niodified by this application.In other words,the State acquisition did not sterilize io -1-wh ich'rernains in priva own r p. the remaining upla-nd,'-port-n of Lot private e-sh i- The State of Now York was under no obligation to obtain Southold Town Pianning Board C� approval of the purchase,nor was it obligated to obtain approval of el lot fine"change when it purchased less than the entire property. The State action was exempt from local review.4 CRJTEFJA TO GRANT AREA VARIA NCE 1. Granting area variance will not produce an undesirable change in the CHARACTER of the neighborhood or a detriment to nearby properties if granted: Lot I of the minor subdivision at the time it was created was in excess of 3 acres in size while the,residential lots in the immediate vicinity of the property(I"nekiding those directly across the street) portion h o rty, e are significantly smaller. Even after the DEC acquired the wetland p Ion of the pr pe th remaining upland portion is approximately 1.9 acres. The neighboring residential properties(SC.TM #1000-26-3-7; 8; 9; and 10) are 17,00O square feet along King Street and the property d 1rectly across the street from the subject property(SCTM 1000-26-3-46)at 1.6 acres is smaller than the subject property. Clearly,the residential character of the community will not be detrimentally affected by residential property that is nearly five times larger than the neighboring non-conforming lots. 2. The benefit to the applicant cannot be achieved by some method feasible for the applicant to pursue other than an area variance. The property adjoining to the south (part of the Strachan subdivision which created the subject property)is already a non-conforming lot that is improved with a single family residence. An att=pt to obtain land from that property by a lot line change)would simply increase the nonconform'ty of the adjoining property, mor antly,there is 'Insufficient land --arca in any event to render the ands e import , 'ca subject property conforming. The other abutting property is owned by the Oysterponds llistor l Society is a cemetery consisting of approximately 1.8 acres. It is neither suitable to provide additk)nal property by the nature of its use,and it does not have enough property to render the subject property conforming. Neither of the ad joining propert ies therefore can provide additional acreage to'incrca5c the degree of conformity of the subject property. And neither of the adjoining properties needs the a='11310e from the subject property for the respective uses of either. 3. The amount of relief requested is not substantial. The subject property was created 'In 1987 by Plan frig Board approval of tho subdivision ct-enting Lot 1. At the time of its creation, it was in excess of 3 acres and compliant with zoning. As a single and sepaTate lot approved by the Planning Board Its buildable status remained notwithstanding the Towns ' See attached Exhibit C New York DEC letter dated Feb. 8, 1989. ' Matter of City of.Rochester 72 N.Y.2d 338 (Court of Appeals 1988) woning of the properties to 5 acre. The application before the Board does not seek to create a new lot of 2 acres when the zoning is 5 acres. It seeks to recognize that the Lot created in 1987 is entitled,as a matter of law, to an area variance in light of the action of the State of New York, which took an otherwise i pre-existing lot recognized and approved by the Planning Board and rendered it non-conforming 4. The variance will NOT have an adverse effect or impact on the physical or en%Firotinient,"al conditions in the neighborhood or district because: The subject property co-M-nplic-s-With the-a-ppl icabh standards-of the Suffolk-County Health Department for construction of a single family residence with private well and sanitary system. The DEC acquired only the wetland portion of this and the other properties in the immediate area leaving the upland areas in private ownership. The DEC did not acquire or condemn the development potential for construction of a single family home on this site. The parcel will be subject to any other applicahle requirements and restrictions associated with single family development of the parcel. 5. Has the alleged difficulty been self-created ()Yes(X)No. The subject lot was the subject of partial acquisition by the DEC in 1990. It was clear frotn'.the DEC"s statements and actions taken that the wetland proper-Lies in Orient would be. acquired by the. State oiie way or another. The Strachans were advised that the wetland portion of the SL]bjCCt property would be acquired by eminent domain if they did not agree to convey that portion of the property. Under these circumstances the conveyance to the State of the wetlands cannot be considered to have been;invlh i ng, but under compulsion. Indeed,many of the Orient property owners objected to the State action a n*d were forced to relinquish local control of the wetlands to the State. The need for the subject variance for the subject property cannot by any stretch of the imagination be considered to have been "self-.creat.ed." And even if it were,a self-created hardship expresssly is not determinative in the granting of a nC66ssavry,area variance. CONCLUSION The Planning Board has nlre:adv provided flicir recommendation to.-approve this 0 applicatiou. Objections raised ask this Board to deny the area variance. These objections are not based on anything more than all too often seen neighborhood opposition to change. Yes, if the variance is granted,a single family residence can be built on this property just as the other properties in the surrounding area have been built and used for residences. However,this residential property will b'e significantly more compliant with the Town"s zoning that the neighboring properties in the area. The variance requested is both reasonable and necessary.If the Zoning Board denies this application,in addition to other remedies,the owners will have a significant claim for regulatory taking.
