No. 09.26.2024.1 RE: 2440 Village Lane, Orient,NY. SCTM# 1000-26-1-17.1 Owner: 2440 VILLAGE LANE, LLC/P. J. DESCHENES RESOLUTION: WHEREAS, 2440Village Lane, Orient,NY, is on the Town of Southold Registry of Historic Landmarks; and WHEREAS, as set forth in Section 170-6 of the Town Law(Landmarks Preservation Code) of the Town of Southold, all proposals for material change/alteration must be reviewed and granted a Certificate of Appropriateness by the Southold Town Historic Preservation Commission prior to the issuance of a Building Permit; and WHEREAS, on September 26, 2024,the Commission approved a proposal for improvements consisting of alterations and additions to the subject single family dwelling; and WHEREAS, on December 16, 2025,the Southold Town Building Inspector issued a Stop Work order for work exceeding the scope of approval by the Zoning Board of Appeals and the Historic Preservation Commission; and WHEREAS, the applicant submitted an Amended proposal on December 17, 2025, describing the construction in areas of the dwelling and reasoned the need to demolish the attached garage portion of the dwelling structure; and WHEREAS, on February 26, 2026, the applicant's representatives, Wade Bennett of Even Keel Home Services and Anthony Portillo of AMP Architecture, appeared before the Commission to describe the proposed Amendments to the architectural plans of the demolished attached garage portion of the single family dwelling; and WHEREAS, the improvements proposed are depicted on Architectural Plans (Sheets G-001.01, A-101.01, _ A-102.01,A-103.01,A-104.01,A-201.01,and A-202.00)prepared Anthony Portillo,Architect, last revised February 11, 2026; and 4': Certificate of Appropriateness,Res.#02.26.2026.3 (Amend 09.26.2024.1)2440 Village Lane,LLC-P.J. Deschenes SCTM No. 1000-26-1-17.1 Page 2 WHEREAS, the Commission has determined that pursuant to Chapter 170-4(E)(2) of the Southold Town Code, the Commission has the authority to determine that some proposals do not rise to the level of requiring a public hearing, as the proposal is de minimis in nature; and WHEREAS, the Commission has determined that the subject application for the Certificate of Appropriateness is de minimis in nature, and therefore does not require a Public Hearing; and WHEREAS, the applicant shall submit to the Commissioners photographs of the finished improvements upon completion; and WHEREAS,the Commissioners may conduct a site inspection of subject premises once improvements are completed. NOW THEREFORE BE IT RESOLVED, that the Southold Town Historic Preservation Commission determines that the proposal for improvements to include the reconstruction of the demolished attached garage as depicted in the Architectural Plans (Sheets G-001.01, A-101.01, A-102.01, A-103.01, A-104.01, A-201.01, and A-202.00) prepared Anthony Portillo, Architect, last revised February 11, 2026, meets the criteria for approval under Section 170-8 (A) of the Southold Town Code; and BE IT FURTHER RESOLVED,that the Commission approves the request for an Amended Certificate of Appropriateness, subject to approvals by all involved agencies; and BE IT FURTHER RESOLVED,that any deviation from the approved plans referenced above may require further review from the Commission. During the course of demolition and construction, concealed conditions were discovered that were not visible at the time the original plans were prepared. Specifically, portions of the existing wood framing were found to be severely deteriorated due to rot, moisture intrusion, and age-related degradation. The required removal (part of the demolition plan) of an LVL header resulted in the northwest wall to no longer be structurally sound and posed a risk to the integrity and safety of the structure. In two locations (north east corner of the garage and northwest corner of the garage), the integrity of the foundation was compromised resulting in needing to remove framing members to access the foundation and make the needed repairs. Based on these field conditions, it became necessary to remove and replace additional framing beyond what was originally anticipated. This work was performed solely to restore structural stability and to ensure compliance with applicable building codes and safety requirements. The additional framing was not intended to expand the structure, alter its footprint, height, or use, nor to seek any zoning relief beyond what was already approved. All corrective work was limited to addressing the unforeseen deterioration encountered in the field and maintaining the original design intent to the greatest extent possible. The decision to proceed was made in good faith to prevent unsafe conditions and further damage to the structure. I respectfully request the Board's understanding that the expanded framing scope resulted from unavoidable field conditions and was necessary to protect the safety, durability, and code compliance of the building. We ask that you remove the violation or issue a De Minimus approval, so that we may proceed with construction. Thank you for your time and consideration.
