That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board prior to expiration. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. A permit issued for work not including a demolition as per the definition in the Town Code, but subsequent to issuance,the work results in a demolition,the permit is voided and a new application must be submitted. 6. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 7. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 8. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 9. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 10. That the said Board will be notified by the Permittee of the completion of the work authorized. 11. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 12. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. PO Box 2124 Greenport, NY 11944 RE: TUTHILL BUNGALOW PROPERTY, INC. 5780 INDIAN NECK LANE, PECONIC SCTM# 1000-98-5-16 Dear Ms. Costello: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 18, 2026 regarding the above matter: WHEREAS, Costello Marine Contracting Corp on behalf of TUTHILL BUNGALOW PROPERTY, INC. applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 23, 2025, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on March 18, 2026, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold Town Code, 2 WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of TUTHILL BUNGALOW PROPERTY, INC. to remove and replace in same footprint 97'10" of existing timber retaining wall with 97'10" navy construction vinyl sheathing retaining wall with top of wall raised 18" higher to elevation 8'; remove and replace 11' long return on west side and 8' long return on east side using vinyl sheathing; and the remaining returns on bluff to remain as they exist; with the condition to establish and perpetually maintain a vegetated non-turf buffer from the top of wall to top of bank; all as depicted on the site plan prepared by Costello Marine Contracting Corp, received on March 30, 2026, and stamped approved on March 31, 2026. First, some background. The TBPI is an S-Corporation formed to preserve the family summer cottage on Indian Neck Lane for the enjoyment of the direct lineal descendants of Clara Sterling and Charles Preston Tuthill who were longtime residents of Cutchogue. The Indian Neck Lane property was acquired shortly after the hurricane of 1938, and the retaining wall was constructed in the post-war 1940's using creosote treated wood sheet aid pole pilings, and horizontal "whalers". The cottage was built in 1949/1950 and first occupied in June 1950. The Corporation was formed in 1958 after the death of Clara Tuthill in 1957. The cottage is used only by shareholders of the Corporation. It is not a commercial enterprise. I have been appointed Project Manager for this wall replacement by the TBPI Board of Directors. My professional background is documented in a LinkedIn profile publicly available online. I am a shareholder in the Corporation. The status of our current retaining wall is that of incipient failure. It exhibits localized bulges in three places which indicate local failures of the tieback system. Our assessment is that the wall has reached the end of its serviceable life after 75 years and should be replaced with a wall using modern more durable materials. The need for replacement is not characterized as urgent, rather it is assessed"as soon as practicable without undue delay". Each hurricane and tropical storm that passes us emphasizes the increasing risk. Photos 1, 2 and 3, attached, illustrate the after-effects of the Winter Storm Sandy storm surge overtopping event. Interestingly, Photo 3 shows that the storm completely scoured the beach sand away from the bottom of the wall exposing the bottom horizontal whalers. By the following spring, the level of beach sand had completely covered the whalers, and it has remained that high since. l While there has been a great deal of public discussion about global warming and its causes in the past quarter century,there is very little dissent over the fact that global warming is happening and that it is producing sea level rise. We submit that the height of our replacement retaining wall must be chosen with the now rapid rise in sea levels in mind, especially in view of the monetary investment required for replacement. For this reason we respectfully ask that the permit be issued for the full 18 inch increase in height as recently approved by the NYDEC. In over topping events, the bank behind the retaining wall suffers very significant wave erosion that must then be repaired after the storm by the replacement of the eroded soil with many cubic yards of clean fill at significant expense. And as the pace of global warming and sea level rise increase,the bluff itself above the wall will be at risk at its base. The following points are relevant: 1. The current retaining wall was built in the late 1940's and repaired approximately in 1970 due to sheet piling rot failure. The height was not raised. The tie-back anchors had not failed. 2: Sea level rise since 1950 at New York City (the closest geographic location available)has been 9 inches according several sources. This is also noticeable in the height of sand on the current retaining wall, covering the lower horizontal whaler and lower steps of the stairway leading down to the beach. 3. The anticipated life of the new retaining wall considering the advanced sheet piling material and thickness chosen, pressure treated post pilings and horizontal whalers, and the fact that the wall is normally dry, is 75 years. 4. Over a 75-year span, it is anticipated that sea level rise will be considerable, at least 9 additional inches,thus we are asking for a height commensurate with the height in 1950 relative to sea level, with an additional 9 inches to account for sea level rise over the life of the new wall. 5. We are aware that additional sea level rise of the next 75 years will likely be more than 9 inches. Perhaps it will be even 18 inches more, rather than 9 inches more -- which would put the top of the replacement wall relative to sea level at the end of its life exactly where it is today with the current retaining wall at the end of its life. 0* 40 The following references are relevant: The claim that sea levels in New York City have risen 9 inches since 1950 can be supported by research from the New York City Panel on Climate Change. According to their report, "Enhancing New York City's resilience to sea level rise and increased coastal flooding,"the sea level on the coast of New York is indeed 9 inches higher than in 1950, citing references [17] and [18] of that report. Further studies have also shown that New York City is experiencing rapid sea level rise, with some research indicating that the current rate of rise is the fastest it's been in 1,500 years. A study published in The Holocene journal used salt-marsh sediment from Pelham Bay in the Bronx to reconstruct relative sea-level change over the past 1,500 years, supporting this claim.
