EN-CONSULTANTS January 28, 2026 Glenn Goldsmith, Chairman Board of Trustees 3 0 2026 Town of Southold P.O Box 1179 Southold,NY 11971 Southold Town Board of Trustees Re: Amnon & Kathleen Bar-Tur, 170 Bay Lane, Orient(Wetlands Permit No. 10094) Dear Mr. Goldsmith: As you may recall, following a pre-submission site meeting with the Board in 2021, the above referenced wetland permit was issued in March 2022, authorizing the relocation and raising of the existing dwelling with a reconstructed front porch and a 1-story addition to the landward side of the house, partially in place of an existing accessory garage to be removed, and serviced by a new I/A sanitary system. The permit has since been extended twice, but its maximum regulatory lifetime is scheduled to expire on March 16,2026. Unfortunately, the work has not yet commenced due to delays with obtaining a permit and associated variances from the Suffolk County Department of Health Services, which relate to formal recognition of a lot line modification approved by the Town of Southold in 2002, and finalizing locations of drinking water wells on properties other than the applicant's. Therefore, to maintain the Trustees' approval of the project, and because the Health Department cannot issue its approvals without a valid Town Wetlands Permit in place,we are resubmitting the attached application to secure the Board's approval of the identically proposed scope of work and plans that were approved in 2022. Should you have any questions or require any additional in support of our application, please let us know. Town,Law.4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of older single-family dwellings located on a private,.gravel, single-lane road that runs along Orient Harbor. Most of the lots are irregularly shaped and many homes have historic landmark designation and pre-existing non7conforming1setbacks. the applicant has obtained a Certificate of Appropriateness from the:Historic Preservation Cominission.for the proposed construction and renovation which includes elevating and relocating the existing..two:story dwelling slightly to the.south.which ' Will remove a non-confonning,3.7-foot side yard setback., and adding a.bne-story master bedroom addition located so as to preserve the water view of the neighbor to the East of the applicant's rear yard: The proposed construction will conform to the town of Southold's maximum lot coverage requirements. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be.achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is oddly shaped and is iinproved with a home that is pre-existing non-conforming. Any design scheme which includes preserving and/or adding to the shape of the existing home will require the benefit of an area variance. 3. Town Law$267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 90%relief from the code. However, the proposed setback is more conforming than the setback of the existing accessory garage which is being demolished, and the application is LWRP Consistent. 4. Town-•L-aw•,5267-b(3)(b)(4):No evidence has been submitted to suggest that a var--iance in this-residential community will have an adverse impact on the physical or environmental conditions in the neighborhood, The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. The old septic system will be abandoned and a new IA wastewater treatment sanitary system_ is proposed which.will improve the environment. 5. Town Law&267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a FEMA compliant dwelling with additions while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. j Page 3, February 17,2022 #7593, Bur-Tur SCTM No. 1000-24-2-26.4 i RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Dantes, seconded by Member Planamento, and duly carried, to i GRANT the variance as applied for, and shown on the Site Plan prepared by Matthew Benjamin Sherman, LPE, last revised August 31, 2021, and Architectural Plans by David Kriegel, Architect, dated September 7, 2021, and labeled site plan,A 100,A101; A300;A301. i SUBJECT TO THE FOLLOWING CONDITIONS: i 1. STATEMENT OF EFFECT FOR AMNON&KATHLEEN BAR-TUR 170 BAY LANE ORIENT,NY SCTM#1000-24-2-26.4 The proposed project, which seeks to raise, relocate, renovate, and add a master bedroom addition to an existing dwelling, was previously approved by the Board of Trustees on March 16,2022(Wetlands Permit No. 10094), an approval that was extended in 2024 and 2025. Due to delays with securing approval from the Suffolk County Department of Health Services, however, work has not yet commenced, and the wetlands permit is scheduled to permanently expire on March 16, 2026, necessitating submission of the current application for approval of the identical scope of work. Specifically, the existing dwelling, whose construction pre-dates the adoption of Town zoning code in 1957, is in need of structural repairs, upgrade of mechanical systems, and replacement of deteriorating siding, roofing, windows, and insulation. But as a result of its design and additionally incorporated environmental mitigation measures described below, the project will further the goals of Chapter 275 (and LWRP Policies 4. 5, and 6) by increasing the dwelling's protection from potential flood and erosion damage; and by protecting and improving water quality and the quality and function of the surrounding Orient Harbor tidal wetland ecosystem. 1. All proposed construction will remain located outside the Coastal Erosion Hazard Area; 2. Lot coverage will remain below the maximum 20 percent allowed by code. 3. The relocated dwelling will be elevated to a FEMA-compliant base flood elevation, thus substantially increasing the dwelling's protection from potential flood and erosion damage and providing a benefit to adjacent properties through reduction of potential damage that could be caused to nearby structures as a result of damage that might otherwise be caused to the subject dwelling during a significant storm event; 4. The existing wetland setback to the bulkhead adjacent to Orient Harbor will be maintained and in fact increased by one foot as a result of the relocation of the existing dwelling structure, and the proposed addition will be located on the landward side of the relocated dwelling; 5. To ensure that the project does not increase the potential for stormwater runoff and would instead result in a potential reduction in runoff reaching Orient Harbor through improved site drainage, a stormwater drainage system is designed to capture and recharge roof runoff from the finished dwelling structure; 6. As a means of providing a potentially substantial increase in the protection and improvement of water quality, the existing conventional septic system will be removed and replaced with a low- nitrogen,I/A sanitary system designed to significantly reduce nitrogen loading into the groundwater and thus ultimately the surface waters of Orient Harbor; and 7. A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. But as a result of its design and additionally incorporated environmental mitigation measures described below, the project will further the goals of Chapter 275(and LWRP Policies 4. 5, and 6) by increasing the dwelling's protection from potential flood and erosion damage; and by protecting and improving water quality and the quality and function of the4surrounding Orient Harbor tidal wetland ecosystem. 1. All proposed construction will remain located outside the Coastal Erosion Hazard Area; 2. Lot coverage will remain below the code-compliant 20 percent. -SEE ATTACHED ADDENDUM- Attach additional sheets if necessary Policy 7.
