That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board prior to expiration. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. A permit issued for work not including a demolition as per the definition in the Town Code, but subsequent to issuance,the work results in a demolition,the permit is voided and a new application must be submitted. 6. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 7. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 8. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed plan includes actions which are consistent with the requirements of Chapter§275-2 A of the Wetlands Law of the Town of Southold and qualify under §275- 11 (C)(2) C. In water. The following standards are required for all in-water operations adjacent to residential properties. Operations conducted on properties zoned M1 or M2 may be given greater flexibility in these requirements given the water-dependent nature of their use. (2) Docks. (a) Standards for residential and commercial docks; general rules. It shall be the policy of the Town of Southold that all docks shall be designed, constructed and located so as to reduce a dock's potential adverse impacts to navigation, public safety, waterway congestion, access to public trust lands and water, and natural resources and habitats. The following standards will serve as a basis for granting, denying, or limiting permits for the construction of docks While all aspects of the proposed structure's construction, location, and dimensions meet the requirements of the above referenced statute, the justification for a dock of this type for kayak launching does not seem justified or necessary. The narrow band of tidal marsh vegetation, inherently limited by slope and shading from adjacent trees, would be minimally impacted by pulling a kayak through the area several times during the growing season, whereas the permanent placement of a dock will shade the grass and likely lead to permanent impacts. Therefore, the proposed"kayak dock"is intended to provide a fixed point of elevated structural access over the existing vegetated wetland to allow for dockage and use of small watercraft, such as a kayaks, canoes, and dinghies in water that is too shallow at low tide to accommodate a floating dock and larger boats. Without such a fixed point of structural access, small watercraft would need to be dragged through the vegetated wetland, creating the potential for the loss of wetlands vegetation along the shoreline. Many similar fixed docks/walkways have been approved by the Board of Trustees throughout Richmond Creek where similarly shallow waters are common, and although never constructed,the Trustees have twice previously approved substantially similar dock structures for the subject property in 2006 (Wetlands Permit 6369) and 2015 (Wetlands Permit 8695). And consistent with these prior approvals,to mitigate any potential impacts of the project on the adjacent tidal wetland area and Town waters,the proposed dock structure is again designed with the minimal scope necessary to reach at least 12 inches of water depth at mean low tide; would be elevated and constructed with open-grate decking to allow sunlight to penetrate both through and beneath the dock to ensure the continued viability of vegetation below it; would be located at least 15 feet from the laterally extended southerly property line; and would encroach upon less than one-fourth the width of the waterway. Therefore,the proposed"kayak dock" is intended to provide a fixed point of elevated structural access over the existing vegetated wetland to allow for dockage and use of small watercraft, such as a kayaks, canoes, and dinghies in water that is too shallow at low tide to accommodate a floating dock and larger boats. Without such a fixed point of structural access, small watercraft would need to be dragged through the vegetated wetland, creating the potential for the loss of wetlands vegetation along the shoreline. Many similar fixed docks/walkways have been approved by the Board of Trustees throughout Richmond Creek where similarly shallow waters are common, and although never constructed,the Trustees have twice previously approved substantially similar dock structures for the subject property in 2006 (Wetlands Permit 6369) and 2015 (Wetlands Permit 8695). And consistent with these prior approvals,to mitigate any potential impacts of the project on the adjacent tidal wetland area and Town waters,the proposed dock structure is again designed with the minimal scope necessary to reach at least 12 inches of water depth at mean low tide; would be elevated and constructed with open-grate decking to allow sunlight to penetrate both through and beneath the dock to ensure the continued viability of vegetation below it; would be located at least 15 feet from the laterally extended southerly property line; and would encroach upon less than one-fourth the width of the waterway. The proposed dock would thus not adversely impact public navigation or recreational use of Town Creek; cause a"fragmentation of ecological communities;"result in the physical loss, degradation, or functional loss of ecological components; or otherwise adversely impact the wetlands or tidal waters of the Town, consistent both with the construction and operation standards for docks set forth by Town Code Section 275-11(C)(2) and Policy 6 of the LWRP. -See attached addendum- Attach additional sheets if necessary Policy 7.
