That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. The proposed plan involves in-kind replacement of a bulkhead while raising it 14" consistent with the requirements of Chapter§275-2 A of the Wetlands Law of the Town of Southold under §275-11 "Construction and operation standards." C. In water. (3) Dredging. (a) Creeks. [1] Only maintenance dredging (as defined in § 275-2) is permitted, unless the applicant owns underwater land or the applicant is requesting permission to dredge in connection with installation of low-sill bulkheads. All maintenance dredging permits shall be valid for a period no greater than 10 years. [2]Dredging may be permitted when it can be demonstrated that the actions of man have resulted in impairment to water quality or habitat value. Dredge material placed behind the bulkhead should be placed in such a way that it can be topped with existing topsoil or clean sand fill. Otherwise, the vegetation in the proposed non-turf vegetated buffer will not survive. Alternatively, the buffer could be created with unvegetated gravel.
