At the March 18 hearing,the Board of Trustees reviewed the Morrisseys'application for a residential swimming pool. Following the Board's discussion,the applicant obtained alternative pool layout options from the pool contractor. In response,the contractor evaluated potential alternatives but did not recommend significant relocation of the proposed pool. The contractor has submitted a written explanation (annexed hereto, Exhibit A)detailing that relocation of the pool beyond 53 feet from the bulkhead would necessitate substantial additional excavation and the construction of additional retaining walls, rendering such modification impracticable. The contractor also provided alternative configurations (Exhibit B); however, each would still require dimensional relief. We specifically explored the Board's suggestion of reversing the orientation of the pool and spa, but this did not make a material difference in terms of the setback. The applicant has diligently explored other potential configurations, but due to the existing topography and slope of the property, perhaps the most feasible alternative was to relocate the pool no more than 3'from the original proposal,thus, about 53'from the bulkhead, requiring a relief of about 7'. This scenario, however,will most likely endanger the tree in the patio area. The applicant seeks to preserve the tree; however, relocating the pool and deck closer to it may adversely impact its root system. We further respectfully submit that the subject property contains less than 30' of bulkheaded waterfront,with a dock situated along the outer edge.Additionally,there is a 20'sand buffer adjacent to the bulkhead.As such,the requested variance will not result in any adverse environmental impact or disturbance to wildlife. We submit with emphasis that the Morrisseys commenced this process in good faith in 2025, including a site visit by the Board of Trustees in May 2025.At that time, no indication was provided regarding any forthcoming amendments to the Code establishing a 60-foot setback requirement for swimming pools. The primary constraints of this property are the proximity Cf the bulkhead and the existing hillside, which divides the property into two levels. Our goal is to determine the best possible pool placement when designing. VVe have selected this location because it is far enough from the bulkhead for structural integrity, positioned on the lower side of the slope to limit excessive excavation and disturbance, and keeps the pool toward the rear of the property, away from the two roads. In regard to the proposed pool location and setback from the bulkhead, our goal has been to design the least invasive layout possible while accounting for drainage, soil stability, and proximity hothe bay. At the proposed location, there is an existing hill that runs the length of the property, approximately 64 feet from the bulkhead. The original design positions the pool approximately 3 feet from this hill in order to minimize excavation and limit soil disturbance. Increasing the setback further would require significantly more excavation into this hi||side, resulting in the need for additional retaining walls and a substantial alteration to the existing landscape and the mature tree. When designing pools, vVe carefully account for rainwater and overflow runoff from both the pool and surrounding areas. In our professional opinion, relocating the pool further from the bulkhead would increase runoff toward the bay and surrounding properties. This is due tothe additional fill that would be required on the bay side uf the pool, creating a steeper slope iMthat direction. Mitigating this issue would require additional retaining vvaUS and drainage systems to redirect water away from the bay. An existing 35' x 25' sand buffer i8to F8nn8in to keep runoff from getting into the bay area as well. From both e8tnJctuoa| and environmental standpoint, the most appropriate and least disruptive design is to construct the pool within the natural slope of the hill. Based on these factors, we believe the optimal placement is no further than 50 feet from the bulkhead. A 53' setback iS possible. The proposed pool is located slightly more than fifty (50) feet landward of the existing bulkhead. We acknowledge that the Town of Southold has since adopted a local law requiring a sixty (60)foot setback for swimming pools from the wetlands boundary. The property owner, unaware of this upcoming change of requirements, engaged the New York State Department of Environmental Conservation (DEC) in August 2025 and received a Letter of No Jurisdiction on December 16, 2025. However, no wetlands boundaries are present on the property as defined under Town Code§ 275, thus, the proposed pool location is not expected to result in any environmental impact. The proposed project includes the construction of a lower masonry pool deck, an upper masonry pool deck, pool fencing, landscaping, pool equipment, and a small storage shed. The project also includes a two-foot, six-inch (2'6") retaining wall located landward of the pool. The pool contractor has advised that the retaining wall must be constructed at the proposed height to prevent stormwater runoff from flowing into the pool patio area, which could otherwise result in paver settlement over time.
