Located: 75 Pettys Drive, Orient. SCTM# 1000-14-2-4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable e LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR CHRIS & ANNA TRIANTAFILLOU 75 PETTYS DRIVE SOUTHOLD,NY SCTM#1000-14-2-4 LWRP Policies 4, 5& 6 The proposed development of the property has been designed to conform to the required 100-foot setback from the top of bluff set forth by Sections 280-116(A)(1) and 275-3(D)(1)(b) of the Town Code, as all structures and sanitary system components will be set back 100 or more feet from the top of bluff. And to mitigate potential impacts associated with the proposed construction, all clearing, grading, and ground disturbance will occur no closer than 50 feet from the top of bluff, a 50-foot wide non-disturbance buffer will be perpetually maintained adjacent to the top of bluff; a low-nitrogen, UA sanitary system will be located at least 100 feet from the top of bluff and more than 200 feet from the surface waters of Long Island Sound; a stormwater drainage system and dedicated pool drywell will be located more than 100 feet from the top of bluff, and a project limiting fence will be installed along the 50-foot bluff setback to control and contain site disturbance and potential runoff during construction. Thus, as designed with the incorporated mitigation, the project will minimize the potential for damage or loss from erosion; protect groundwater quality; and protect the quality and function of the surrounding ecosystem, including the adjacent bluff, beach,and tidal waters of Long Island Sound,consistent with the standards for issuance of a Town Wetlands Permit set forth in Section 275-12 of the Town Code and with the goals of Policies 4, 5 and 6 of the Local Waterfront Revitalization Program.
