SCTM No. 1000-107-10-9.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further requirements under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief,permit,or interpretation requested I this application is listed under the Minor Actions exempt list and.is not subject to review under Chapter 268. DEPARTMENT OF LAND PRESERVATION: The application was referred to the Department of Land Preservation. On December 29, 2025, a memo of response was received regarding this application which disclosed that the proposed improvement of an accessory apartment is contained to the development rights intact portion of the property and does not encroach on preserved lands. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(B)(13)to establish an Accessory Apartment in an existing accessory structure. PROPERTY FACTS/DESCRIPTION: The subject property known as Lot 1 is a 130,680 square foot parcel located in the Agricultural Conservation(A-C)Zoning District. The northerly property line measures 320.02 feet and is adjacent to Wickham Avenue,the easterly property line measures 409.06 feet,the southerly property line measures 318.74 feet and is adjacent to Lot 2, and the westerly property line measures 397.52 feet and is adjacent to Mill Lane. The parcel is improved with a two-story frame dwelling with a detached frame garage located to the rear of the dwelling, a two-story frame barn located northeast of the dwelling adjacent to Wickham Avenue, and a frame 10 ft. by 20 ft. frame shed located at the rear of the barn as shown on the survey map prepared by Nathan Taft Corwin III,LS and dated October 28,2017. AMENDED APPLICATION: At the February 5,2026 Public Hearing the representative for the owner was asked to provide proof of the relationship of the owner and the person who will occupy the accessory Page 2,March 5,2026 #8078SE,Vinbar Realty SCTM No. 1000-107.40-9.1 apartment along with revised plans that do not exceed the code permitted maximum of 750 square feet of livable floor area. (On December 2, 2025,the Chief Building Inspector determined the livable floor area of the proposed accessory apartment to be non-conforming at 795 square feet+/-, as applied for). On February 17, 2026,the applicant submitted a copy of a birth certificate of Marie Louise Claps dated October 11, 1955, a marriage certificate between Franklin Brooks and Marie Louise Claps as proof as relationship as the sister of Vincent Claps,and a residential lease agreement between Marie Brooks and Vincent Claps. An Amended Floor Plan was also submitted, last revised February 12, 2026,depicting the accessory apartment with a conforming 748.76 square feet of livable floor area. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 5, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply,AS AMENDED,with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The amended floor plan last revised on February 12, 2026 shows a proposed apartment with a conforming 748.76 square feet of livable floor area with one bedroom and one full bath all located on the second floor of the existing accessory structure. 2. The dwelling unit complies with the definition of same in §280-4 of the code. 3. The applicant herein, owns the property as documented by Real Estate Tax Receipt, and Property Deed and confirms that: occupancy of the resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member,as defined in Chapter 280- 4. The other dwelling unit shall be leased for year-round occupancy evidenced by a written lease for a term of one or more years to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be the owner's sister, as evidenced by a Birth Certificate and Certificate of Marriage of Marie Louise Claps Brooks. 5. The owners' plans comply with the on-site parking requirements of three spaces, two for the principal dwelling and one for the accessory apartment, and provide for a total of 3 parking spaces, as shown on the survey prepared by Nathan Taft Corwin III and dated October 28, 2017. 6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory apartment is authorized or exists. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s)and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 8. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations,determinations and findings required in Chapters 280-142 (General Standards)and 280-143 (Matters to be Considered) specifically finds and determines the following: a) That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. b) That the granting of the special exception.will not adversely impact the character of the neighborhood in which it is located. c) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. d) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. e) That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. f) Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Weisman (Chairperson), seconded by Member Planamento, and duly carried, to GRANT the Special Exception Permit as AMENDED and VERIFIED by the Southold Town Building Inspector having 749 square feet of conforming livable floor area as shown on the Floor Plans prepared by Louis G. Schwartz, LPE, last revised February 12, 2026. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 2. This Special Exception permit cannot be transferred to new owners. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void.
