The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their-jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The proposed actions are directly adjacent to Downs Creek which has been identified as one of twenty one NYSDOS Significant Coastal Fish and Wildlife Habitats designated within Southold Town given their ecological significance. Given the sensitivity of this natural system and the difficulty of identifying wetland boundaries in such areas, with little elevational change and a mix of vegetation types, it is recommended that the wetland line be confirmed by the,Southold Town Trustees. Additionally, even if the wetland line as shown on the submitted plan is accepted on face value, the fact that the proposed new structure is within 0.8 feet of this line should necessitate confirmation by the Trustees. Given the large size of the lot and the location of the existing home and pool, it appears there is enough land to move the new garage and the existing shed structure to the rear yard and provide a greater buffer to the wetlands, which would be consistent with the LWRR Moving the locations of the structures would also be in compliance with Article III, Section 280-15 which states accessory buildings and structures shall be located in the required rear yard. With regard to the existing accessory shed currently located in the front yard it should be moved to the rear yard rather than approved where it is. The plans note that the structure is 35.5 feet from the wetland boundary, but interpretation of the plans indicate the structure is actually 30 feet from the defined wetland boundary. As noted above, the wetland line is suspect and should be confirmed by the Trustees prior to any approvals. Pursuant to Chapter 268, the Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
