Director LWRP Coordinator Date: December 3, 2025 Re: LWRP Coastal Consistency Review Sangrock Lee, #8065, SCTM# 1000-97.-7-1 This application is a Request for Variances from Article III, Section 280-15; to construct an accessory pool and amend a permit (#48463) for a single-family dwelling and add a roof top deck; and the Building Inspector's July 21, 2025 Notice of Disapproval based on an application for a permit to construct an accessory pool and permit for a single family dwelling and add a roof top deck at SCTM# 1000-97.-7-1. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands' under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The proposed actions are directly adjacent to Eugene's Creek on what is currently undeveloped land and for this reason every effort should be made to ensure that the proposed work is consistent with the LWRP. While the proposed actions appear to meet the minimum requirement of setbacks for the new pool, patio and residence, the fact that the wetland delineation is 5.years old and was undertaken in winter (February.3, 2020) when evidence of emergent plant material is often lacking, and the fact that rapid sea level rise means that tidal wetland boundaries are constantly migrating landward, means that this line should be re-established prior to final approval. Given the need to re-confirm the wetland boundary and the proximity of some construction activities within 100 feet of the wetland boundary, the Trustees should also review this application. Depending on the'confirmed location of the wetlands boundary, mitigation of the proposed action may be necessary to find it consistent with the LWRP.
