The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with the LWRP. While the location of the pool relative to the wetlands is consistent with the policies of the LWRP, the location of the pool with respect to the zoning is not. Policy 1 is to foster a pattern of development in the town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location and minimizes adverse effects of development. This proposal is out of character with the community and does not minimize adverse effects of development. The pool is proposed in the side yard only 15' from the street. The front yard setback is 40' in the AC zoning district for non-conforming lots of this size. Similar to the subject parcel,,the neighboring lots on either side have houses close to the road due to the headwaters of Jockey Creek running through the back of the parcels, but neither parcel has a pool. To minimize the potential adverse effects of this development of the pool, and thus be able to find this action consistent with the LWRP, consider the following options: 1. Remove the pool entirely. Construction of the pool was begun without a permit. The applicant has applied for permits in the past including on this parcel, and should have been aware that the pool would require a building permit, a wetland permit, would not be permitted in the side yard and 15' from the street without significant variances. 2. If the Board is inclined to give a variance, reducing the size of the pool and reducing the area that is fenced in around the pool could be an option.
