The property is located adjacent to the Long Island Sound at 1460 The Strand in East Marion. The Notice was issued,for an application to construct an accessory swimming pool, and to legalize three (3) as built accessory decks. The swimming pool is proposed to be located less than the code required 100 feet from the top of the bluff at 65.9', and the patio is at 52.9'; and the three accessory decks are seaward of the top of the bluff (decks 1 & 2: 60+/- sf each, deck 3, the most seaward: 209 sf (23.5' x 8.9')) The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,'as well as the records available to me, the proposal is recommended as INCONSISTENT with the below LWRP policies. Policy 4. Minimize the loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. 1. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for a. structures that functionally require a location on the coast or in coastal waters. (example: a dock) The three accessory decks and pool do not require a location on the coast. According to FEMA, the parcel is susceptible to storm damage. At least two of the deck structures that are seaward of the top-of bluff are located within a VE (Velocity Hazard) flood zone, and all three decks are in the Coastal Erosion Hazard Area. The decks are subject to repetitive loss from erosion due to storm surges and flooding and should be removed. The pool structures, to be consistent with the policy to minimize the loss of structures from erosion, should be located 100' from the bluff or not permitted at all. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The decks are part of the beach stairs. The application was reviewed by pre-submission to Trustees and only the lower deck needs to be addressed(reduced in size). The pool was proposed closer to the top of the bluff and the Trustees recommended that the pool be tucked in closer to the back of the house and deck. The parcel is lot 120 in Map of Peddle Beach Farms and many homes in Pebble Beach have accessory pools adjacent to the top of the bluff. The proposed pool has been pushed as far back as practical after reducing the balcony and deck to fit the pool. The beach stairs and lower deck exist. The owner resurfaced the lower deck with thru-flo decking material believing that they are making environmental improvements.The lower deck is 23.4 x 8.9 x 23.5 x 8.8(208.26 SF)Middle deck is 13.4 x 3.6 x 9.8 x 5.4(@48 SF)and upper deck is 13.5 x 3.6 x 4'x 2.2 x 9.2 x 5.4(@65 SF). 2.The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because:The house exists and was constructed in 1983.The only practical location of the pool is in the rear yard(waterfront side)and to maximize the distance from the top of the bluff the pool is connected to the, rear of the house by an elevated deck. Seaward of the deck is a patio on grade. The decks associated with the beach stairs exist and were constructed with the beach stairs. The lower deck, if reduced in size,will require changes to the structural supports and cause more environmental disturbance to the property than leaving the decks in place. The house was purchased with the decks and stairs,as constructed. 3.The amount of relief requested is not substantial because:The lots were developed prior to bluff setbacks and the house is in line with neighboring homes. The proposed pool at 65.9 is a reasonable variance and consistent with the setback variances for pools granted in Pebble Beach subdivision. Most of the waterfront lots on The Strand have requested variances for pools and been granted variances for the setbacks to the bluff.
