Building Permit Application for Garage Alteration
Inspection—Existing Septic System
On October 14, 2023, I inspected the existing septic system at the noted location. The
inspection covered the location and size of the septic system components.
The inspection results are:
—The System includes a precast concrete septic tank(1250 gallon) and six precast
concrete galley leaching boxes. Each galley is a precast concrete box(8'long x 4'wide x
2'deep) with concrete covers. System i&performing as designed.
-The System size conforms to the SCDOH requirements for a(0 to 4)bedroom house as
of the date of installation and approval. The size of the System components is based upon
SCDOH Standards.
- The System construction was approved by SCDOH on May 11, 2023 (copy of approval
attached).
Result—Based upon inspection of this site and to the best of my knowledge, belief and
professional judgment,the Septic System, as installed, complies with the SCD
Requirements for a four(4)bedroom house.

Building Permit Application for Garage Alteration- General Information
This Application is being filed to obtain a building permit to do alterations to the existing
garage building. The alterations will convert the existing second story of the garage into
an accessory apartment for the owner's family use. The proposed alterations do not
change the exterior perimeter, height or overall size of the building. There are no changes
proposed to the exterior walls or roof lines.
The first floor alterations include adding an entrance door and modifying the staircase. A
bathroom and kitchen area will be added to the second floor. The required egress will be
provided by new windows and the modified staircase.
Based upon the Lot Size of 34,028 sq.ft.:
The allowable maximum gross floor area(GFA) on the property is 4652 sq.ft.
The existing gross floor area(GFA) on the property is 1059 sq.ft.
The proposed increase in gross floor area(GFA) on the property is 676 sq.ft.
The proposed total gross floor area(GFA) on the property will be 1735 sq.ft.
The proposed work is within the limits established by Local Law 10 of 2022.

On December 21, 2024, I inspected the construction at the noted location. The inspection
covered the framing for the accessory apartment in the existing garage structure. The
areas inspected included the first floor, second floor and roof of the addition. The framing .
work included exterior and interior walls, floors, staircase, ceiling and roof.
The inspection results are:
Items inspected included lumber type/grade, lumber size, dimensional spacing, framing
connections, header sizes, bearing, continuity strapping and integration with the structure.

On December 21, 2024, I inspected the construction for the accessory apartment at the
noted location. The inspection covered the plumbing roughing for the Drainage Waste
and Vent System(DWV) and the Water Supply System(WS). The inspection results are:
1 —DWV— System was exposed and readily viewed. I observed the drainage and vent
lines. System constructed as required.-New installation is connected to the existing
system.
2—WS—System was fully exposed, pressurized and readily viewed. I observed the hot
and cold water supply lines. System constructed as required. New installation is
connected to the existing water supply system.
Result—Based upon inspection of this project and to the best of my knowledge, belief

On April 17, 2025, I inspected the insulation and caulking installed at the noted location.
The inspection covered the exterior walls and the ceiling/roof for the alteration to the
existing accessory structure. The inspection results are:
1 —Walls—Insulation provided and installed by general contractor. Insulation provided
rated as R-23. The insulation provided was done in compliance with the applicable
sections of the IRC,NYS and Southold Town Building Codes.
2—Ceiling/Roof—Insulation provided and installed by general contractor. Insulation
provided rated as R-46. The insulation provided was done in compliance with the
applicable sections of the IRC,NYS and Southold Town Building Codes.
Result-The insulation and caulking installation as verified by inspection is compliant
with all applicable codes and conforms with the design specifications. The insulation was
installed in compliance with the IEC Code for Existing Buildings, in particular Section
R503 Alterations; Paragraph R503.1.1 Building Envelope.
Based upon inspection of this project and to the best of my knowledge,belief and

On November 5,2025,I inspected"the window protection installed at the noted location.
The inspection covered the window at the top of the staircase.
The inspection results are:
1 —The window sash was covered by.a permanently installed Acrylic Sheet
manufactured by Optix. This material is approximately 1/4"thick and confirmed to be
Shatter Resistance Safety Glazing.
2—The Acrylic Installation exceeds the strength of typical glass and provides protection
from shattering and glass.failure.
Result-Based upon inspection of this project and to the best of my knowledge, belief
and professional judgment, construction as installed provides code compliantprotection
for the window location. The installation as verified by inspection is compliant with all

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration
in this application and determines that this review falls under the Type II category of the State's List of
Actions, without further requirements under SEQRA.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront
Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 25, 2024.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available, it is recommended that the proposed action is CONSISTENT
with LWRP policy standards and therefore is CONSISTENT with the LWRP.
REQUEST MADE BY APPLICANT: The Applicants-Owners requests a Special Exception under
Zoning Code Section 280-13(B)(13) to establish an Accessory Apartment in an existing accessory
structure.
PROPERTY FACTS/DESCRIPTION: The subject property is a nonconforming 34,028.34 sq. ft. parcel
located on the Residential R-40 Zoning District. The northerly property line measures 205.07 feet and
fronts New Suffolk Avenue, the easterly property line measures 126.68 feet and fronts Deep Hole Road,
the southerly property line measures 217.50 (227 Deed) feet and the westerly property line measures
159.29 (182.79 Deed) feet. The parcel is improved with a one-story frame dwelling with basement and
attached deck, and a two story frame garage, as shown on the survey reap prepared by Vasiliy Suslin, LS,
and last revised July 2, 2022.
ADDITIONAL INFORMATION: The first floor of the garage contains a full set of stairs to the second
floor with a new proposed door connecting the two. The board advised the applicant to remove the
interior door so the only access to the second floor is via exterior door. The board requests same so the
apartment doesn't end up being two stories which isn't allowed per the Code. The main dwelling will be
used by the owner and the parents will be using the apartment over the garage. The board infonned the
owner that she can't rent the house if she has an accessory apartment leased and occupied by her parents.
Further, the apartment can only be occupied by the parents. It cannot be used as a guest house any other
time. The parents will use the apartment when they are here from Florida.

On March 19, 2024, (dated October 30, 2023)the applicant's representative submitted a letter that he
originally submitted to the Town's Building Department, describing in detail his inspection of the existing
septic system on the premises. Based upon the inspection, he noted that"to the best of his knowledge,
belief and professional judgment, the Septic System, as installed, complies with the SCDOH requirements
for a four(4) bedroom house." On May 11, 2023,the Office of Wastewater Management, of the
Department of Health Services (SCDHS) submitted an acknowledgement to the homeowner that the
sanitary system replacement was completed in accordance with the SCDHS standards.
In addition to his letters, the applicant's engineer submitted a revised plan, dated.March 8, 2024, showing
the removal of an entry door which eliminated tenant's access to the garage.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 7, 2024, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection
of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the
following facts to be true and relevant.
In considering this application, the Board has reviewed the code requirements set forth pursuant to Article
I11, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds that
the applicant does comply with all of the requirements for the reasons noted below:
1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not
exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom
with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory
structure. The architectural/engineered plans prepared by Nicholas Mazzaferro, P.E., and last revised
October 31, 2023, propose an accessory apartment with one full bathroom entirely on the second floor of
the two-story building in the accessory structure with a conforming 565 square feet of livable floor area.
On December 29, 2023, The Building Department's "Verification of Livable Floor Area" verified the
livable floor area to be 538 sq. ft.
2. The dwelling unit complies with the definition of same in §280-4 of the code and Section 280-13(B)(13)
of the Zoning Code.
3. The accessory structure does comply with the code requirement as defined in Section 280-13(B)(13)(e)
of the Zoning Code which states the accessory structure must have been certified a minimum of three years
prior to the establishment of the accessory apartment. The prior owners were issued a Certificate of
Occupancy No: Z-22983 for the subject accessory structure dated May 4, 1994.
4. The applicant herein, has membership interest in the property as documented by Articles of Organization
filed with the NYS Department of State on September 2, 2021, an Operating Agreement between 70 Deep
Hole Drive, LLC and 728 Post Road, LLC, dated December 15, 2023, a Bargain and Sale Deed, dated
September 14, 2021, and confirms that: occupancy of the residential structures on the premises shall be
subject to the issuance of an annual rental permit in accordance with 280-13D and the following
requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family
member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy
evidenced by a written lease for a term of one or more years to a family member or a resident who is
currently on the Southold Town Affordable Housing Registry and eligible for placement.
Brady Leifer, listed as a Member in the LLC Operating Agreement, will be the owner/occupant of the main
dwelling and the owner's parents will occupy the accessory apartment as evidenced by a signed lease by

the applicant and her parents for a period of 24 months at$1 a month. The applicant asserted that no other
person shall occupy the dwelling unit, and was asked to submit a legible birth certificate.
5. The owner's plan comply with the on-site parking requirements of three spaces, two for the principal
dwelling and one for the accessory apartment, and provide for a total of 3 parking spaces as shown on a
survey map prepared by Vasiliy Suslin, LS, and last revised July 2, 2022.
6. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as
authorized by Section 280-13(B)(14) hereof shall be permitted in or on premises for which an accessory
apartment is authorized or exists.
7. This conversion shall be subject to a building permit, inspection by the Building Inspector, approval by
the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and
the issuance/renewal of an annual permit in accordance with Chapter 280-13D.
8. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the
considerations, determinations and findings required in Chapters 280-142(General Standards)and 280-143
(Matters to be Considered) specifically finds and determines the following:
1. That the granting of the special exception will not adversely impact the privacy and use and
enjoyment of any adjoining parcel.
2. That the granting of the special exception will not adversely impact the character of the
neighborhood in which it is located.
3. That the cumulative effect of approving the present application along with previously approved
applications will not have a cumulative adverse impact on the surrounding neighborhood.
4. That the cumulative effect of approving the present application along with previously approved
applications will not have a cumulative adverse impact on the school district in which the property
is located.
5. That sufficient off-street parking exists on the subject property to accommodate the proposed
accessory apartment.
6. Whether adequate buffer yards and screening can and will be provided to protect adjacent
properties from possible detrimental impacts of the proposed use.
RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements,
motion was offered by Member Acampora, seconded by Member Dantes, and duly carried, to
GRANT the Special Exception Permit as applied for as shown on survey map prepared by
Vasiliy Suslin, LS, and last revised July 2, 2022, and architectural/engineered plans, Sheets A-2
thru A-4, last revised October 31 2023• and Sheet A-1 last revised March 8, 2024, all prepared
by Nicholas Mazzaferro, P.E.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer.
It is the applicant's responsibility to apply to the Building Department each year to renew the

accessory apartment permit. Failure to do so may require a public hearing before the Zoning
Board of Appeals to review potential action to revoke the Special Exception Permit granted

2. This Special Exception permit cannot be transferred to new owners.
3. When the primary dwelling is not being occupied by the owners,the principal dwelling may
not be rented to anyone else.
4. When the subject accessory apartment is not being occupied by the applicant's parents, as
applied for,the accessory apartment may not be rented to or occupied by anyone else.
5. Per Town Code, the applicants may not rent the principal dwelling or apply for a permit to
establish a bed-and-breakfast use as long as the accessory apartment approved herein exists.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in
delays and/or a possible denial by the Building Department of a building permit, and may require a new
application and public hearing before the Zoning Board of Appeals.
In the event that this is a special permit subject to conditions, the approval shall not be deemed effective
until such time that the foregoing conditions are met; and failucre to comply therewith will render this
approval null and void.
Any violations of the conditions, occupancy or other requirements described herein, may require a public
hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception
Permit granted herein.
