Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 17, 2025 regarding the above matter:
WHEREAS, Costello Marine Contracting Corp. on behalf of ESTATE OF THEODORE A.
EIRING applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated
July 7, 2025, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
September 17, 2025, at which time all interested persons were given an opportunity to be
heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 275 of the Southold
Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees APPROVE the application of ESTATE OF THEODORE
A. EIRING to construct a 1,840sq.ft. (footprint) two-story dwelling with 320sq.ft. attached

Permit to construct and complete project will expire three years from the date the permit is
signed. Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

Dear Chairperson Weisman and Board:
We respectfully request another one year extension of the Board's decision
filed with the Town Clerk on December 29, 2020. The successor executor is
selling the parcel with all permits in place. The PROPERTY IS IN CONTRACT
and the contract is conditioned on all permits, as extended, for the same house
approved in 2020 to be constructed. The following permits were issued:
I- Health Department approval 11/22/24 (expires 2027)
2. Southold Town Trustees 8/23/21 (with an extension to September 2025). A
new application was filed which is for a 3 year permit (same detailed plans
and buffers, as approved in 202 1)
3. NYSDEC 1/28/2 1(expires 1/27/2026)
4. Zoning Board of Appeals #7427
The pennit process has been difficult due to no fault of the estate. The first
executor, Stephen Gutleber died during the application process and a new executor
had to be appointed to continue with the Health Department applications.
