SOUTHOLD TOWN PLANNING BOARD
May 16 , 1973
A regular meeting of the Southold Town Planning
Board was held at 7 :30 p.m. , Wednesday, May 16 , 19731,
at the Town Office, Main Road, Southold, New York.
There were present: Messrs. John Wickham, Chairman;
Henry Moisa, Vice Chairman; Henry Raynor; Frank Coyle;
Alfred Grebe.
Also present: Howard Terry, Building Inspector
Mr. and Mrs. Andrew Cassidy appeared before the Board
in regard to a proposed minor subdivision on their property,
off Albertson Lane, Southold. Four lots are proposed.
The plan shows Mr. Cassidy' s house is directly adjacent, to
the proposed subdivision. Mr. Wickham informed Mr. Cassidy
that the Board cannot grant minor subdivisions when the
owners has adjacent property not included in the subdivision.
The property would have to be included as a lot and then he
could have only three more lots on the approximately five
acre parcel. Mr. Cassidy said he was part owner of other
property adjoining the proposed subdivision with his brother.
The Board told Mr. Cassidy he could make the, property into

a major subdivision, but the. roads have to be built to
Town Specifications. ' Mr. Cassidy stated there was no
public water in the area. Mr. Cassidy said he would
review the possibilities open to him and come back to the
Board later.
Joseph Snellenberg, Esq. , presented the final map
for Russell and Elinor Freund (Pearson property) of a
minor subdivision off South Harbor Road, Southold. The
map showed the changes in the right of way as requested
by the Board. Mr. Snellenberg submitted the application
for approval and fee. The Board told Mr. Snellenberg the
right of way must be improved with bank run and Mr. Snellenberg
said that would be done. Mr. Snellenberg said he is waiting
for final Health Department approval and will send a copy
of the covenants and restrictions to be placed on the
property to the Board.
Michael Weinstein, Esq. , presented the Board with the
minor subdivision map for Milton Mehlman off Platt Road,
Orient. The map has been approved and stamped by the Health
Department. He also submitted the application for approval
and fee. Mr. Weinstein said the covenants and restrictions
that will be placed on the property are being prepared and
will be submitted to the Board.
Messrs. Joseph Donovan, Eugene Haberman, Lefferts P.
Edson, Esq. , and Rudolph Bruer, Esq. , appeared before the
Board in regard to Pebble Beach Subdivision at East Marion.
Maps were submitted to the Board showing the bluff line.
The 100 foot setback recommended by the County from the bluff
line is to be used as the end of the building line. The
Ordinance also requires a 35 foot setback from the road;
this would leave approximately 50 feet within which the house
can be located. Mr. Donovan asked the Board about averaging

the rear building line along the bluff. The map shows
two places along the bluff where the line is cut in deeper.
Mr. Donovan said generally 50 feet is enough for most
houses. They would not touch the growth on the bank or
within the restricted area. The Board informed Mr. Donovan
some type of redesign will be required on the roads in
conformance to the recommendations of the Planning Commission.
Mr. Wickham said the Board will make an on site inspection
and if it indicates the two gullys are stabalized with trees
they would be willing to run the line straight. Mr. Wickham
said the Board does not want to held this up unduly for
any reason and will require : (1) an official submission
under Article IV, Section III of the Subdivision Regulations;
the map must show the adjacent property to the east; (2) the
requirement of indicating 12" or larger trees on the map
will be waived; (3) the map must show contours at two feet
on existing roads, plus the approximate grade; on non existing
roads, grades of proposed streets and profiles of water and
sewer lines and the storm drainage plan; (4) proposed lot ,
lines with suggested locations of buildings. Mr. Wickham
said after the preliminary hearing the plans will be officially
submitted to the Planning Commission and they will make
pertinant recommendations . Mr. Donovan said he would send
the filing fee and the application has been submitted.
Mr. Wickham also told Mr. Donovan the Board will need twelve
copies of the site plan for the preliminary hearing. The
Board expects to have the preliminary hearing between June lst
and 20th.
Rudolph Bruer, Esq. , and John Pontino appeared before
the Board in regard to Mr. Pontino ' s proposed subdivision
at Peconic. Mr. Bruer said water tests have been requested but
have not come through yet. The Board informed Mr. Bruer and
Mr.Pontino that 5% of the area will be required for park and
playground and the frontages will have to be 150 feet. The
park and playground will be maintained by a property owner ' s
association. The Board will also need road profiles and a
drainage plan, which must be submitted to the Superintendent
of Highways and Highway Committee of the Town Board. The
lot on the northeasterly corner of the property is in the
same ownership and must have a lot number and be included in
the subdivision.

Mr. Bruer presented the map for minor subdivision for
Kimon and Woodene Retzos at East Marion, which has been
approved and stamped by the Department of Health. The
application and filing fee have been submitted.
Mr . George Ahlers appeared before the Board in regard
to Southold Commons Apartments . He asked the Board about
accepting efficiency apartments with less than 850 square
feet. He said he plans to have 16 efficiency apartments
with 645 square feet; 32 two bedroom apartments with 1005
square feet and 105 one bedroom apartments with approximately
850 square feet. Mr. Wickham said he would take to the
Town Attorney on this and let him know.
Dr. Albert Sunshine appeared before the Board with
a revised site plan for a professional building at Mattituck.
He Eaid the plan now shown eleven parking spaces and all
information required by the Board.
On motion of Mr. Raynor, seconded by Mr. Grebe , it was
RESOLVED that the Southold Town Planning Board approve
the site plan for a professional building off Sound Avenue,
Mattituck, for Dr. Albert Sunshine. The driveway and parking
area is to be paved with bluestone.
Vote of the Board: Ayes : Messrs . Raynor, Grebe, Coyle ,
Moisa, Wickham.
ChiLrles Cuddy, Esq. and Donald Denis appeared before the
Board in regard to Inlet East Estates Subdivision off Reeve
Avenue, Mattituck. The Board discussed with them the proposed
drainage area. Mr. Denis said the drainage area was changed
at the request of the Superintendent of Highways . The Board
informed them the requirements for frontage is going to be
changed to 150 feet and the map will have to comply. Also
the park and playground must be 5% of the total area. The
map does not have Health Department approval yet. Mr. Denis
said he would have the changes made on the map.

Mr. Frank Knispel came before the Board in regard
to his site plan for the storage buildings at Naugles
Dock. The map had been submitted to the Soil and Water
Conservation District and they have made recommendations
on the terracing of the slope and planting. Mr. Knispel
said he will follow these recommendations and would like
to have site plan approval, so that excavation can be
started. The Board discussed the proposal of the Soil &
Water Conservation District at some length. The Board
suggested Mr. Knispel have further discussions with
Mr. Barnett of Soil and Water Conservation and he said
he would.
Mr. Ben Mendozza presented a revised preliminary
subdivision map of his property off Bergen Avenue, Mattituck,
showing 150 feet at the building line on lot #11 .
Mr. Mendozza said the Capt. Kidd Water District will supply
water to the subdivision and presented a letter from them
to that effect. The Board told Mr. Mendozza that the park
and playground must be maintained by a property owners
association. The Board said the following will be required
before a preliminary hearing can be held: (1) Test holes
must be made and the Health Department must give their
approval; (2) twelve copies of the site plan, road profiles
and profiles for the water lines; (3) affidavit of disclosure
with the names and address of all persons having an interest
in the subdivision; (4) subdivision application and filing
fee; (5) legal description of the property; (6) a copy of
the contract with the water district.
The Board had decided at its regular meeting on March 15th,
1973 , that all developers must submit copies of the sketch plan
to the Board one week prior to the meeting. The Board will
not discuss any more new proposals unless this has been done.
The Board received a proposed minor subdivision for
Armond Bartos at East Marion.
On motion of Mr. Coyle , seconded by Mr. Moisa, it was
RESOLVED that the Board table discussion of the proposed
minor subdivison for Armand Bartos until the next meeting
of the Planning Board.

Vote of the Board: Ayes : Messrs . Coyle, Moisa, Wickham,
Grebe, Raynor.
The Board discussed the revised preliminary plan for
Fairway Farms (Case Estate subdivision) . The application
and filing fee have been submitted. The Board will require,"
the following: (1) frontage on lots #33 and #34 be made 150
feet; (2) a legal covenant on lot #10 stating that it will
be held out and not sold for a period of two years after completion of
roads , for Possible future drainage; (3) the engineer ' s certification
on the map that all lots are 40 , 000 square feet or more
and stamped that no lot lines can be altered; (4) Health
Department approval and (5) a legal description of the
property.
On motion of Mr. Raynor, seconded by Mr. Moisa, it was
RESOLVED that the next regular meeting of the Planning
Board will be held June 13 , 1973 .
Vote of the Board: Ayes : Messrs . Raynor, Moisa, Grebe,
Wickham, Coyle .
The meeting was adjourned at 11 :15 p.m.
