POLICY: At the beginning of scheduled Town Board meetings, the attending public is encouraged to briefly address the Town Board relating to agenda resolutions prior to their enactment; the public will also be given time at the conclusion of the regularly scheduled business agenda to address the Board on any given topic. ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting. The video of the meeting is usually available to watch live during the meeting. RESOLVED that the Town Board of the Town of Southold authorizes and directs the Town Supervisor Albert J. Krupski, Jr. to execute the 48 month Blended Lease Agreement dated 2/10/2026 between the Town of Southold and Canon U.S.A., Inc., in connection with the lease of five (5) Canon replacement copy machines, two of which are located at Town Hall and three of which are located at Town Hall Annex, at a total monthly cost of$1,530.00, in accordance with Agreement MA 6196, Transaction 521545299, subject to the approval of the Town Attorney. 2026-194 Category: Special Events Department: Town Clerk Strawberry Festival 2026 RESOLVED that the Town Board of the Town of Southold hereby grants permission to the Mattituck Lions Club to use Strawberry Fields in Mattituck, NY from June 17th through June 21 st, 2026, at Strawberry Fields, Mattituck,NY provided: 1. Town Clerk has recieved a Two Million Dollar Certificate of Insurance naming the Town of Southold and the County of Suffolk as an additional insured. 2. Coordinate traffic control upon notification of the adoption of this resolution. 3. No permanent markings be placed on town, county or state roads or property for the event. 4. Any road markings or signs for the event be removed within twenty- four(24)hours of the completion of the event. 5. No alcohol is to be served at the event as per Town Code. Alcohol is prohibited on all Town and County Parks. Page 9 of 81 Some of the requirements for issuing a Special Permit may be waived. Provided they adhere to all conditions on the application and permit and to the Town of Southold Policy for Special Events and subject to the Renewal of Contract with Suffolk County Land Preservation. Subject to a renewal of the applicable lease for the parcel between the Town of Southold and the County of Suffolk and any user fee imposed by the County of Suffolk. This Permit is subject to revocation if the applicant fails to comply with any of the conditions of the Approval or is unable to properly control traffic flow into and out of the event. 2026-195 Category: Special Events Department: Town Clerk Special Event- 2026 Shamrock Shuffle 5K RESOLVED that the Town Board of the Town of Southold hereby grants permission to Mattituck- Cutchogue Athletic Booster Club to use the following route for its 2026 Shamrock Shuffle 5K on Sunday, March 15, 2026, 7:OOAM to 12:OOPM: beginning on the eastern side of Tasker Park on Carroll Avenue, right onto County Road 48, right onto Old North Road @ Wesnofske Farms, right onto Ackerly Pond Lane, right onto Lower Road, right onto Route 25 to the finish at Greenport Brewery,provided they follow all the conditions in the Town's Policy for Special Events on Town Properties. The fees have been waived for this event with the exception of the $1,500.00 clean-up deposit(deposit to be returned after event upon recommendation of Chief Grattan, Southold Town Police Department). Krupski, Jr. to execute the Southold Nutrition Contract between the Suffolk County Department of the Aging and the Town of Southold, for the period January 1, 2026 through December 31, 2026, with an option to extend the Contract to be exercised at the County's discretion to June 30, 2027, on the same terms and conditions, for a maximum of 32,788 home delivered meals and a maximum of 14,500 congregate meals annually, in accordance with a subrecipient grant award and at no cost to the Town; subject to the approval of the Town Attorney. 2026-205 Category: Contracts-Lease &Agreements Department: Town Attorney Extension to the Professional Services Agreement with Cornell Cooperative Extension of Suffolk County RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Albert J. B8020-544510 SEQRA Consultant. 2026-209 Category: Local Law Public Hearing Department: Town Attorney BESS Moratorium Public Hearing WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 26th day of February 2026, a Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System (BESS) facilities"now, therefore,be it RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,New York, on the 21st day of April 2026 at 6:00 P.M. at which time all interested persons will be given an opportunity to be heard, RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to send the following proposed Local Law to the Suffolk County Planning Department and the Southold Town Planning Board for their recommendations and review. The proposed Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System (BESS) facilities"reads as follows: LOCAL LAW NO. 2026 A Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System (BESS) facilities". BE IT ENACTED by the Town Board of the Town of Southold, as follows: I. PURPOSE - Moratorium Extension In furtherance of Local Law 2025-4, which extended the Battery Energy Storage System (BESS) moratorium, the Town Board acknowledges that BESS facilities are a key component to the viability and promotion of renewable energy sources. The Town Board acknowledges the storage systems play an important role in reducing demand and costs associated with grid infrastructure, add capacity while lessening the burden on existing infrastructure and deter the use of fossil fuels. However, significant public health and safety concerns relative to the potentially volatile nature of lithium-ion batteries and battery storage operations remain. These public health and safety concerns include location of mega- watt scale facilities in close proximity to established residential areas. On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released Page 14 of 81 recommendations for inclusion in the New York Fire Code. In July 2025, the Code Council adopted the Fire Safety Working Group's recommendations for the 2025 NYS Fire Code, which took effect January 1, 2026. 1. The Town Board finds that in order to review and comply with the newly effected Code, it will require extensive time and would not be resolved in the next months. The Town Board acknowledges and understands the need for clear and concise laws to successfully work toward a safe and effective Bess Code; 2. With the new State Fire Code in effect, the Town Board now must reconvene the Town of Southold BESS Task Force to review the new Code, make recommendations to the Town Board for adopting a BESS Code that complies and aligns with the NYS Fire Code; 3. Due to unforeseen circumstances which include discontinuing the work with the Zoning Code Consultants, and other matters, the ongoing comprehensive zoning update project being conducted by the Town is not near completion. The new Zoning Code is expected to be advertised for public comment in the next few months, which will require an extensive public comment time and may delay the adoption by additional months. The Town Board does not find it possible now to adopt a BESS code where the zoning update is still being formulated. The BESS code is an integral part of the Zoning Code for the Town. The zoning update, in conjunction with the Town's Comprehensive Plan and other applicable town laws that will affect the BESS facilities,require guidance from the NYS Fire Code as well as the Towns Task Force. The timeline for the Zoning Update, due to circumstances beyond the Towns control, will be extended considerably. A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local Law 8-2023, on January 31, 2023, with an effective date of April 11, 2023. The one (1) year moratorium was further extended by the Town Board of the Town of Southold as Local Law 2024- 6 with an effective date of April 3, 2024. Further extension was adopted by Local Law 2025-4 effective April 22, 2025 and the current moratorium is set to expire on April 22, 2026. The moratorium as originally enacted, extended, and still intended to provide sufficient time for the Town to undertake a thorough examination of these systems to identify any possible threats to public health, safety and welfare as well as evaluate the potential for environmental degradation. The Town Board finds it necessary to extend the moratorium already in effect, the terms of which remain unchanged and are set forth below. This action is necessary in order to protect the character, public health, safety and welfare of the residents of the Town of Southold. II. ENACTMENT OF A TEMPORARY MORATORIUM Until twelve (12) months from the effective date of this Local Law, after which this Local Law shall lapse and be without further force and effect and subject to any other Local Law adopted by the Town Board during the twelve (12) month period, no agency, board, board officer or employee of the Town of Southold including, but not limited to, the Town Board, the Zoning Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s), issuing any building permit pursuant to any provision of the Southold Town Code, shall issue, cause to be issued or allow to be issued any approval, special exception, variance, site plan, building permit, subdivision, or permit for any use identified as a Battery Energy Storage System (BESS) facility. III. EXCLUSIONS This Local Law shall not apply: 1) To any person or entity who/which has, prior to the effective date of this Local Law, obtained all permits required for such a facility and,relying upon such permission, has undertaken significant development of such facility. AUTHORITY TO SUPERSEDE To the extent and degree any provisions of this Local Law are construed as inconsistent with the provisions of Town Law, this Local Law is intended, pursuant to Municipal Home Rule Law, to supersede any said inconsistent authority. V. VARIANCE TO THIS MORATORIUM Any person or entity suffering unnecessary hardship as that term is used and construed in Town Law section 267-b (2)(b), by reason of the enactment and continuance of this moratorium may apply to the Town Board for a variance excepting the proposed use from the temporary moratorium and allowing issuance of a permit all in accordance with the provisions of the Southold Town Code. VI. SEVERABILITY If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the remainder of this Local Law. VII. The proposed Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System (BESS) facilities" reads as follows: LOCAL LAW NO. 2026 A Local Law entitled, "A Local Law in relation to a twelve(12) month Extension of a Temporary Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System (BESS) facilities". BE IT ENACTED by the Town Board of the Town of Southold, as follows: I. PURPOSE - Moratorium Extension Page 72 of 01 In furtherance of Local Law 2025-4, which extended the Battery Energy Storage System (BESS) moratorium, the Town Board acknowledges that BESS facilities are a key component to the viability and promotion of renewable energy sources. The Town Board acknowledges the storage systems play an important role in reducing demand and costs associated with grid infrastructure, add capacity while lessening the burden on existing infrastructure and deter the use of fossil fuels. However, significant public health and safety concerns relative to the potentially volatile nature of lithium-ion batteries and battery storage operations remain. These public health and safety concerns include location of mega-watt scale facilities in close proximity to established residential areas. On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released recommendations for inclusion in the New York Fire Code. In July 2025, the Code Council adopted the Fire Safety Working Group's recommendations for the 2025 NYS Fire Code, which took effect January 1, 2026. 1. The Town Board finds that in order to review and comply with the newly effected Code, it will require extensive time and would not be resolved in the next months. The Town Board acknowledges and understands the need for clear and concise laws to successfully work toward a safe and effective Bess Code; 2. With the new State Fire Code in effect, the Town Board now must reconvene the Town of Southold BESS Task Force to review the new Code, make recommendations to the Town Board for adopting a BESS Code that complies and aligns with the NYS Fire Code; 3. Due to unforeseen circumstances which include discontinuing the work with the Zoning Code Consultants, and other matters, the ongoing comprehensive zoning update project being conducted by the Town is not near completion. The new Zoning Code is expected to be advertised for public comment in the next few months, which will require an extensive public comment time and may delay the adoption by additional months. The Town Board does not find it possible now to adopt a BESS code where the zoning update is still being formulated. The BESS code is an integral part of the Zoning Code for the Town. The zoning update, in conjunction with the Town's Comprehensive Plan and other applicable town laws that will affect the BESS facilities, require guidance from the NYS Fire Code as well as the Towns Task Force. The timeline for the Zoning Update, due to circumstances beyond the Towns control, will be extended considerably. A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local Law 8-2023, on January 31, 2023, with an effective date of April 11, 2023. The one (1)year moratorium was further extended by the Town Board of the Town of Southold as Local Law 2024-6 with an effective date of April 3, 2024. Further extension was adopted by Local Law 2025-4 effective April 22, 2025 and the current moratorium is set to expire on April 22, 2026. The moratorium as originally enacted, extended, and still intended to provide sufficient time for the Town to undertake a thorough examination of these systems to identify any possible threats to public health, safety and welfare as well as evaluate the potential for environmental degradation. Page 73 of 81 The Town Board finds it necessary to extend the moratorium already in effect, the terms of which remain unchanged and are set forth below. This action is necessary in order to protect the character,public health, safety and welfare of the residents of the Town of Southold. II. ENACTMENT OF A TEMPORARY MORATORIUM Until twelve (12)months from the effective date of this Local Law, after which this Local Law shall lapse and be without further force and effect and subject to any other Local Law adopted by the Town Board during the twelve (12) month period, no agency, board, board officer or employee of the Town of Southold including,but not limited to, the Town Board, the Zoning Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s), issuing any building permit pursuant to any provision of the Southold Town Code, shall issue, cause to be issued or allow to be issued any approval, special exception, variance, site plan, building permit, subdivision, or permit for any use identified as a Battery Energy Storage System(BESS) facility. III. EXCLUSIONS This Local Law shall not apply: 1) To any person or entity who/which has,prior to the effective date of this Local Law, obtained all permits required for such a facility and, relying upon such permission, has undertaken significant development of such facility. 2) To any application by a municipal corporation or special district or fire district IV. AUTHORITY TO SUPERSEDE To the extent and degree any provisions of this Local Law are construed as inconsistent with the provisions of Town Law, this Local Law is intended, pursuant to Municipal Home Rule Law, to supersede any said inconsistent authority. V. VARIANCE TO THIS MORATORIUM Any person or entity suffering unnecessary hardship as that term is used and construed in Town Law section 267-b (2)(b),by reason of the enactment and continuance of this moratorium may apply to the Town Board for a variance excepting the proposed use from the temporary moratorium and allowing issuance of a permit all in accordance with the provisions of the Southold Town Code. VI. SEVERABILITY If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the remainder of this Local Law. VIL EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State. The property is located on the westerly side of Albertson Lane and extends to the southerly side of County Road 48, the northerly side of Colony Road, and the easterly side of Bayview Avenue. The property is located within the R-80 Zoning District. The property is adjacent to 324.59 acres of open space owned by the County of Suffolk and Town of Southold. The proposed acquisition is for the Town of Southold, in a joint 50%150%partnership with the County of Suffolk, to acquire fee title to the entire 54.13❑-acre property for open space preservation. The exact area of the purchase is subject to survey. The purchase price for the entire 54.13❑ acre parcel is $120,000 (one hundred twenty-thousand dollars)per acre, estimated at $6,495,600 (six million four hundred ninety-five thousand six hundred dollars). The purchase price will be adjusted at time of closing based on the final surveyed acreage. The purchase will be funded by the Town's Community Preservation Fund and the County of Suffolk in a 50%150%partnership, which will include the purchase price and any related acquisition costs associated with the purchase of this property. The property is listed on the Town's Community Preservation Project Plan as property that should be acquired for the establishment of parks, nature preserves, or recreation areas; preservation of open space; preservation of fresh and saltwater marshes or other wetlands; and establishment of wildlife refuges for the purposes of maintaining native animal species diversity, including the protection of habitat essential to the recovery of rare, threatened or endangered species. The purpose of this acquisition is for open space,passive recreational purposes, wetland Page 76 of 01 protection, and natural habitat protection. Proposed uses of the property may include the establishment of a nature preserve and/or passive recreational area with trails and limited parking for access purposes, all subject to a management plan that will be developed for the property. The Land Preservation Coordinator has reviewed the acquisition in accordance with Chapter 117 (Transfer of Development Rights) of the Code of the Town of Southold. Sanitary Flow Credits may be available for transfer from the property upon the purchase of the property. The County of Suffolk will determine if Sanitary Flow Credits (a/k/a County Workforce Housing Development Rights) are available, and if so, the number of Sanitary Flow Credits available from the property. Any available Sanitary Flow Credits will be divided between the County and the Town in accordance with the 50%/50%joint partnership percentage. The transfer of Sanitary Flow Credits will not be finalized, and shall not occur, until the County/Town closes on the property, and the Town Board passes a resolution allowing the transfer into the Town Sanitary Flow Credit Bank.
