Center Auditorium, 1170 Peconic Lane, Peconic, NY 11958.
POLICY: At the beginning of scheduled Town Board meetings, the attending public is
encouraged to briefly address the Town Board relating to agenda resolutions prior to their
enactment; the public will also be given time at the conclusion of the regularly scheduled
business agenda to address the Board on any given topic.
ONLINE ACCESS: The Tentative Agenda is generally available the Friday before the meeting.
The video of the meeting is usually available to watch live during the meeting. Minutes with
adopted resolutions are available 1 to 2 days after the meeting. A full copy of the minutes,

Number 2026-010 of the Fishers Island Ferry District, adopted February 5, 2026, which reads as
follows:
WHEREAS Frederick Stanley II has performed with merit in the duties of a part time deckhand, and
WHEREAS the manager has recommended that said deckhand be promoted to full-time deckhand;
and
THEREFORE, it is RESOLVED that Mr. Stanley be promoted to full-time deckhand and the wages
be increased from $19.48 per hour to $20.00 per hour with effect February 19, 2026.

WHEREAS employee Abigail Voigt has demonstrated the skills, experience, and commitment
necessary to assume increased responsibilities within the District:
WHEREAS her manager has recommended that she be promoted to Cashier (Commercial
Reservationist) and her wages be increased to $30.00.
THEREFORE, it is RESOLVED that Ms. Voigt be promoted to Cashier (Commercial Reservationist)
and her wages be increased from $23.20 per hour to $30.00 per hour with effect February 19, 2026.

Supervisor Albert J. Krupski, Jr. to execute a contract with Hinck Electrical Contractor, Inc.. pursuant
to the terms and conditions of the accepted contract#TSIM032522 to expire March 24, 2027 by
Suffolk County, and extended to the Town of Southold pursuant to §103(16) of the General
Municipal Law, for the maintenance of nine (9) Traffic Signals on County Road 48, at a cost of

Town of Southold and Canon U.S.A., Inc., in connection with the lease of five (5) Canon replacement
copy machines, two of which are located at Town Hall and three of which are located at Town Hall
Annex, at a total monthly cost of$1,530.00, in accordance with Agreement MA 6196, Transaction
521545299, subject to the approval of the Town Attorney.

Strawberry Festival 2026
RESOLVED that the Town Board of the Town of Southold hereby grants permission to the Mattituck
Lions Club to use Strawberry Fields in Mattituck, NY from June 17th through June 21 st, 2026, at
Strawberry Fields, Mattituck,NY provided:
1. Town Clerk has recieved a Two Million Dollar Certificate of Insurance naming the Town of
Southold and the County of Suffolk as an additional insured.
2. Coordinate traffic control upon notification of the adoption of this resolution.
3. No permanent markings be placed on town, county or state roads or property for the event.
4. Any road markings or signs for the event be removed within twenty- four(24)hours of the
completion of the event.
5. No alcohol is to be served at the event as per Town Code. Alcohol is prohibited on all Town
and County Parks.

Some of the requirements for issuing a Special Permit may be waived. Provided they adhere to all
conditions on the application and permit and to the Town of Southold Policy for Special Events and
subject to the Renewal of Contract with Suffolk County Land Preservation. Subject to a renewal of
the applicable lease for the parcel between the Town of Southold and the County of Suffolk and any
user fee imposed by the County of Suffolk. This Permit is subject to revocation if the applicant fails to
comply with any of the conditions of the Approval or is unable to properly control traffic flow into
and out of the event.

Special Event- 2026 Shamrock Shuffle 5K
RESOLVED that the Town Board of the Town of Southold hereby grants permission to Mattituck-
Cutchogue Athletic Booster Club to use the following route for its 2026 Shamrock Shuffle 5K on
Sunday, March 15, 2026, 7:OOAM to 12:OOPM: beginning on the eastern side of Tasker Park on
Carroll Avenue, right onto County Road 48, right onto Old North Road @ Wesnofske Farms, right
onto Ackerly Pond Lane, right onto Lower Road, right onto Route 25 to the finish at Greenport
Brewery,provided they follow all the conditions in the Town's Policy for Special Events on Town
Properties. The fees have been waived for this event with the exception of the $1,500.00 clean-up
deposit(deposit to be returned after event upon recommendation of Chief Grattan, Southold Town
Police Department). Failure to comply with all provisions and conditions will result in the revocation
of the permit.

Club to hold its 2-day Donald Ross Invitational on Friday, July 7th and Saturday, July 18th, 2026,

Retirement Resolution for Elected Officials
WHEREAS, the State of New York has set additional reporting requirements in Section 315.4 of the
New York Codes, Rules and Regulations which requires all elected and appointed officials whose
terms start on or after August 12, 2009, who are members of the New York State and Local
Retirement System and who do not participate in their employer's time keeping system to prepare a

log of their work-related activities for three consecutive months and submit their logs to the clerk or
secretary of the governing body within 150 days of the start of their term;

2026 Southold Nutrition Contract
RESOLVED, that the Town Board of the Town of Southold hereby authorizes and directs Supervisor
Albert J. Krupski, Jr. to execute the Southold Nutrition Contract between the Suffolk County
Department of the Aging and the Town of Southold, for the period January 1, 2026 through
December 31, 2026, with an option to extend the Contract to be exercised at the County's discretion
to June 30, 2027, on the same terms and conditions, for a maximum of 32,788 home delivered meals
and a maximum of 14,500 congregate meals annually, in accordance with a subrecipient grant award
and at no cost to the Town; subject to the approval of the Town Attorney.

Cooperative Extension of Suffolk County, to provide for technical services in support of the Local
Waterfront Revitalization Program (LWRP) for the Town of Southold, through September 30, 2026,
under the same terms and conditions established by the original Agreement dated October 7, 2025,
except that the hourly rate shall be increased to $90.00 per hour, all in accordance with the Town

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County,
New York, on the 26th day of February 2026, a Local Law entitled, "A Local Law in relation to a
twelve (12) month Extension of a Temporary Moratorium on the issuance of approvals and/or
permits for Battery Energy Storage System (BESS) facilities"now, therefore,be it
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold,New York, on the 21st
day of April 2026 at 6:00 P.M. at which time all interested persons will be given an opportunity to
be heard,
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town
Clerk to send the following proposed Local Law to the Suffolk County Planning Department and the
Southold Town Planning Board for their recommendations and review.
The proposed Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a

A Local Law entitled, "A Local Law in relation to a twelve (12) month Extension of a Temporary
Moratorium on the issuance of approvals and/or permits for Battery Energy Storage System
(BESS) facilities".
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
I. PURPOSE - Moratorium Extension
In furtherance of Local Law 2025-4, which extended the Battery Energy Storage System (BESS)
moratorium, the Town Board acknowledges that BESS facilities are a key component to the viability
and promotion of renewable energy sources. The Town Board acknowledges the storage systems play
an important role in reducing demand and costs associated with grid infrastructure, add capacity while
lessening the burden on existing infrastructure and deter the use of fossil fuels. However, significant
public health and safety concerns relative to the potentially volatile nature of lithium-ion batteries and
battery storage operations remain. These public health and safety concerns include location of mega-
watt scale facilities in close proximity to established residential areas.
On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released

recommendations for inclusion in the New York Fire Code. In July 2025, the Code Council adopted
the Fire Safety Working Group's recommendations for the 2025 NYS Fire Code, which took effect
January 1, 2026.
1. The Town Board finds that in order to review and comply with the newly effected Code, it
will require extensive time and would not be resolved in the next months. The Town Board
acknowledges and understands the need for clear and concise laws to successfully work toward a
safe and effective Bess Code;
2. With the new State Fire Code in effect, the Town Board now must reconvene the Town of
Southold BESS Task Force to review the new Code, make recommendations to the Town Board
for adopting a BESS Code that complies and aligns with the NYS Fire Code;
3. Due to unforeseen circumstances which include discontinuing the work with the Zoning Code
Consultants, and other matters, the ongoing comprehensive zoning update project being conducted
by the Town is not near completion. The new Zoning Code is expected to be advertised for public
comment in the next few months, which will require an extensive public comment time and may
delay the adoption by additional months. The Town Board does not find it possible now to adopt a
BESS code where the zoning update is still being formulated. The BESS code is an integral part of
the Zoning Code for the Town. The zoning update, in conjunction with the Town's Comprehensive
Plan and other applicable town laws that will affect the BESS facilities,require guidance from the
NYS Fire Code as well as the Towns Task Force. The timeline for the Zoning Update, due to
circumstances beyond the Towns control, will be extended considerably.
A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local Law
8-2023, on January 31, 2023, with an effective date of April 11, 2023. The one (1) year
moratorium was further extended by the Town Board of the Town of Southold as Local Law 2024-
6 with an effective date of April 3, 2024. Further extension was adopted by Local Law 2025-4
effective April 22, 2025 and the current moratorium is set to expire on April 22, 2026.
The moratorium as originally enacted, extended, and still intended to provide sufficient time for
the Town to undertake a thorough examination of these systems to identify any possible threats to
public health, safety and welfare as well as evaluate the potential for environmental degradation.
The Town Board finds it necessary to extend the moratorium already in effect, the terms of which
remain unchanged and are set forth below. This action is necessary in order to protect the
character, public health, safety and welfare of the residents of the Town of Southold.
II. ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12) months from the effective date of this Local Law, after which this Local Law
shall lapse and be without further force and effect and subject to any other Local Law adopted by
the Town Board during the twelve (12) month period, no agency, board, board officer or employee
of the Town of Southold including, but not limited to, the Town Board, the Zoning Board of
Appeals, the Trustees, the Planning Board, or the Building Inspector(s), issuing any building
permit pursuant to any provision of the Southold Town Code, shall issue, cause to be issued or
allow to be issued any approval, special exception, variance, site plan, building permit,
subdivision, or permit for any use identified as a Battery Energy Storage System (BESS) facility.
III. EXCLUSIONS
This Local Law shall not apply:
1) To any person or entity who/which has, prior to the effective date of this Local Law,
obtained all permits required for such a facility and,relying upon such permission, has
undertaken significant development of such facility.

2) To any application by a municipal corporation or special district or fire district
IV. AUTHORITY TO SUPERSEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent with the
provisions of Town Law, this Local Law is intended, pursuant to Municipal Home Rule Law, to
supersede any said inconsistent authority.
V. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in Town
Law section 267-b (2)(b), by reason of the enactment and continuance of this moratorium may
apply to the Town Board for a variance excepting the proposed use from the temporary
moratorium and allowing issuance of a permit all in accordance with the provisions of the
Southold Town Code.
VI. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the
remainder of this Local Law.
VII. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

hereby sets Tuesday, March 40, 2026, at 6 p.m., Peconic Community Center Auditorium, 1170
Peconic Lane, Peconic, New York as the time and place for a public hearing for the purchase of
property from Southold Ventures Inc. Said property is identified as SCTM#1000-44.-3-4.3. The
total area of the property is 54.13+ acres. The address of the property is 2955 Albertson Lane in
Greenport. The property is located on the westerly side of Albertson Lane and extends to the
southerly side of County Road 48, the northerly side of Colony Road, and the easterly side of
Bayview Avenue. The property is located within the R-80 Zoning District. The property is adjacent to
324.59 acres of open space owned by the County of Suffolk and Town of Southold.
The proposed acquisition is for the Town of Southold, in a joint 50%/50%partnership with the
County of Suffolk, to acquire fee title to the entire 54.13 F1-acre property for open space preservation.
The exact area of the purchase is subject to survey. The purchase price for the entire 54.13 L acre
parcel is $120,000 (one hundred twenty-thousand dollars)per acre, estimated at$6,495,600 (six
million four hundred ninety-five thousand six hundred dollars). The purchase price will be adjusted at
time of closing based on the final surveyed acreage. The purchase will be funded by the Town's
Community Preservation Fund and the County of Suffolk in a 50%/50%partnership, which will
include the purchase price and any related acquisition costs associated with the purchase of this
property.
The property is listed on the Town's Community Preservation Project Plan as property that should be
acquired for the establishment of parks, nature preserves, or recreation areas;preservation of open
space; preservation of fresh and saltwater marshes or other wetlands; and establishment of wildlife

refuges for the purposes of maintaining native animal species diversity, including the protection of
habitat essential to the recovery of rare, threatened or endangered species. The purpose of this
acquisition is for open space,passive recreational purposes, wetland protection, and natural habitat
protection. Proposed uses of the property may include the establishment of a nature preserve and/or
passive recreational area with trails and limited parking for access purposes, all subject to a
management plan that will be developed for the property.
The Land Preservation Coordinator has reviewed the acquisition in accordance with Chapter 117
(Transfer of Development Rights) of the Code of the Town of Southold. Sanitary Flow Credits may
be available for transfer from the property upon the purchase of the property. The County of Suffolk
will determine if Sanitary Flow Credits (a/k/a County Workforce Housing Development Rights) are
available, and if so, the number of Sanitary Flow Credits available from the property. Any available
Sanitary Flow Credits will be divided between the County and the Town in accordance with the
50%/50%joint partnership percentage. The transfer of Sanitary Flow Credits will not be finalized,
and shall not occur, until the County/Town closes on the property, and the Town Board passes a
resolution allowing the transfer into the Town Sanitary Flow Credit Bank.
FURTHER NOTICE is hereby given that a more detailed description of the above-mentioned parcel
of land is on file in the Land Preservation Department, Southold Town Hall Annex, 54375 Route 25,

BE IT ENACTED by the Town Board of the Town of Southold, as follows:
I. PURPOSE - Moratorium Extension

In furtherance of Local Law 2025-4, which extended the Battery Energy Storage System (BESS)
moratorium, the Town Board acknowledges that BESS facilities are a key component to the
viability and promotion of renewable energy sources. The Town Board acknowledges the storage
systems play an important role in reducing demand and costs associated with grid infrastructure,
add capacity while lessening the burden on existing infrastructure and deter the use of fossil
fuels. However, significant public health and safety concerns relative to the potentially volatile
nature of lithium-ion batteries and battery storage operations remain. These public health and
safety concerns include location of mega-watt scale facilities in close proximity to established
residential areas.
On February 6, 2024, Governor Hochul's Inter-Agency Fire Safety Working Group released
recommendations for inclusion in the New York Fire Code. In July 2025, the Code Council
adopted the Fire Safety Working Group's recommendations for the 2025 NYS Fire Code, which
took effect January 1, 2026.
1. The Town Board finds that in order to review and comply with the newly effected Code,
it will require extensive time and would not be resolved in the next months. The Town Board
acknowledges and understands the need for clear and concise laws to successfully work
toward a safe and effective Bess Code;
2. With the new State Fire Code in effect, the Town Board now must reconvene the Town
of Southold BESS Task Force to review the new Code, make recommendations to the Town
Board for adopting a BESS Code that complies and aligns with the NYS Fire Code;
3. Due to unforeseen circumstances which include discontinuing the work with the Zoning
Code Consultants, and other matters, the ongoing comprehensive zoning update project being
conducted by the Town is not near completion. The new Zoning Code is expected to be
advertised for public comment in the next few months, which will require an extensive public
comment time and may delay the adoption by additional months. The Town Board does not
find it possible now to adopt a BESS code where the zoning update is still being formulated.
The BESS code is an integral part of the Zoning Code for the Town. The zoning update, in
conjunction with the Town's Comprehensive Plan and other applicable town laws that will
affect the BESS facilities, require guidance from the NYS Fire Code as well as the Towns
Task Force. The timeline for the Zoning Update, due to circumstances beyond the Towns
control, will be extended considerably.
A one (1)year moratorium was enacted by the Town Board of the Town of Southold as Local
Law 8-2023, on January 31, 2023, with an effective date of April 11, 2023. The one (1)year
moratorium was further extended by the Town Board of the Town of Southold as Local Law
2024-6 with an effective date of April 3, 2024. Further extension was adopted by Local Law
2025-4 effective April 22, 2025 and the current moratorium is set to expire on April 22, 2026.
The moratorium as originally enacted, extended, and still intended to provide sufficient time
for the Town to undertake a thorough examination of these systems to identify any possible
threats to public health, safety and welfare as well as evaluate the potential for environmental
degradation.

The Town Board finds it necessary to extend the moratorium already in effect, the terms of
which remain unchanged and are set forth below. This action is necessary in order to protect
the character,public health, safety and welfare of the residents of the Town of Southold.
II. ENACTMENT OF A TEMPORARY MORATORIUM
Until twelve (12)months from the effective date of this Local Law, after which this Local
Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the twelve (12) month period, no agency, board, board
officer or employee of the Town of Southold including,but not limited to, the Town Board,
the Zoning Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s),
issuing any building permit pursuant to any provision of the Southold Town Code, shall issue,
cause to be issued or allow to be issued any approval, special exception, variance, site plan,
building permit, subdivision, or permit for any use identified as a Battery Energy Storage
System(BESS) facility.
III. EXCLUSIONS
This Local Law shall not apply:
1) To any person or entity who/which has,prior to the effective date of this Local Law,
obtained all permits required for such a facility and, relying upon such permission, has
undertaken significant development of such facility.
2) To any application by a municipal corporation or special district or fire district
IV. AUTHORITY TO SUPERSEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent with
the provisions of Town Law, this Local Law is intended, pursuant to Municipal Home Rule
Law, to supersede any said inconsistent authority.
V. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and construed in
Town Law section 267-b (2)(b),by reason of the enactment and continuance of this
moratorium may apply to the Town Board for a variance excepting the proposed use from the
temporary moratorium and allowing issuance of a permit all in accordance with the provisions
of the Southold Town Code.
VI. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the
remainder of this Local Law.
VIL EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

RESOLVED that pursuant to the provisions of Chapter 185 (Open Space Preservation) and
Chapter 17 (Community Preservation Fund) of the Town Code, the Town Board of the Town of
Southold hereby sets Tuesday, March 10, 2026, at 6 p.m., Peconic Community Center
Auditorium, 1170 Peconic Lane, Peconic, New York as the time and place for a public
hearing for the purchase of property from Southold Ventures Inc. Said property is identified
as SCTM #1000-44.-3-4.3. The total area of the property is 54.13± acres. The address of the
property is 2955 Albertson Lane in Greenport. The property is located on the westerly side of
Albertson Lane and extends to the southerly side of County Road 48, the northerly side of
Colony Road, and the easterly side of Bayview Avenue. The property is located within the R-80
Zoning District. The property is adjacent to 324.59 acres of open space owned by the County of
Suffolk and Town of Southold.
The proposed acquisition is for the Town of Southold, in a joint 50%150%partnership with the
County of Suffolk, to acquire fee title to the entire 54.13❑-acre property for open space
preservation. The exact area of the purchase is subject to survey. The purchase price for the
entire 54.13❑ acre parcel is $120,000 (one hundred twenty-thousand dollars)per acre, estimated
at $6,495,600 (six million four hundred ninety-five thousand six hundred dollars). The purchase
price will be adjusted at time of closing based on the final surveyed acreage. The purchase will
be funded by the Town's Community Preservation Fund and the County of Suffolk in a
50%150%partnership, which will include the purchase price and any related acquisition costs
associated with the purchase of this property.
The property is listed on the Town's Community Preservation Project Plan as property that
should be acquired for the establishment of parks, nature preserves, or recreation areas;
preservation of open space; preservation of fresh and saltwater marshes or other wetlands; and
establishment of wildlife refuges for the purposes of maintaining native animal species diversity,
including the protection of habitat essential to the recovery of rare, threatened or endangered
species. The purpose of this acquisition is for open space,passive recreational purposes, wetland

protection, and natural habitat protection. Proposed uses of the property may include the
establishment of a nature preserve and/or passive recreational area with trails and limited parking
for access purposes, all subject to a management plan that will be developed for the property.
The Land Preservation Coordinator has reviewed the acquisition in accordance with Chapter 117
(Transfer of Development Rights) of the Code of the Town of Southold. Sanitary Flow Credits
may be available for transfer from the property upon the purchase of the property. The County of
Suffolk will determine if Sanitary Flow Credits (a/k/a County Workforce Housing Development
Rights) are available, and if so, the number of Sanitary Flow Credits available from the property.
Any available Sanitary Flow Credits will be divided between the County and the Town in
accordance with the 50%/50%joint partnership percentage. The transfer of Sanitary Flow
Credits will not be finalized, and shall not occur, until the County/Town closes on the property,
and the Town Board passes a resolution allowing the transfer into the Town Sanitary Flow Credit
Bank.
FURTHER NOTICE is hereby given that a more detailed description of the above-mentioned
parcel of land is on file in the Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.

11. Amendment- The Southold Town Code is hereby amended by removing the struck through
words and adding the underlined words as follows:
§ 71-1. Purpose
The purpose of this Agricultural Advisory Committee is to:

A. Recognize the importance of agriculture, including aquaculture and mariculture
operations, and its industry as both a vital economic driver of the local economy and a mode of
land use that provides the Town of Southold with both its rural and rustic character and
maritime culture.
C. Provide for the most beneficial relationship between the use of town waterways, lands,
buildings, aquacultural and agricultural practices and to further encourage the wise use and
management of the natural resources within the Town.
D. Provide the Town Board, Planning Board, Zoning Board of Appeals, and other relevant
Town boards and committees with a conduit for recommendations from the Town's
agricultural and aquacultural industries on the short and long term impacts of a variety of
matters and questions considered by these groups.
§ 71-3. Composition; membership; terms of office; removal.
A. The Committee shall be composed of up to eleven members appointed by the Town
Board. All members must be who are residents and ^ett!4 ^ s lopeFatoFs
satisfy at
least one of the following criteria:
(1) Up to seven (7) members shall be active owners or operators of bona fide land-
based agricultural farm operations within the Town of Southold.
(2) Up to two (2) members shall be residents with substantial and proven
experience in the agricultural or aguacultural/maricultural industry.
(3) Up to two (2) members shall be otherwise qualified to represent the interests of
these industries, as determined by the Town Board.
§ 71-4. Powers and duties.
The Agricultural Advisory Committee shall:

If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of
this law as a whole or any part thereof other than the part so decided to be unconstitutional or
invalid.
