SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planing under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT: The Applicant-Owner requests a Special Exception under Zoning Code Section 280-13(13)(13)to establish an Accessory Apartment in a proposed modular accessory structure. PROPERTY FACTS/DESCRIPTION:The subject property is a non-conforming 20,000 square foot parcel in the R-40 Residential Zoning District. The property has 100.00 feet fronting Saltaire Way on the west side, has 200.00-foot property fines on the north and south side that connect to the 100.00 foot easterly property line along an adjacent agricultural parcel. The parcel is developed with a two-story frame dwelling with attached two-car garage, an open rear deck, an open side deck, a covered front entry, and a rear yard shed, all as shown on a survey prepared by Angelo Joseph Cecere, L.S., last revised October 21, 2025. ADDITIONAL INFORMATION: The applicant intends to purchase a"Rolling Acres 103"modular home from Leland Cabins and included photos of similar modular homes made by that company. The application included a drawing titled, "16 x 44 Rolling Acres 103," p-1,and "Cabin Specifications,"p-2,for client Diane Bianculli, prepared by Joe i Page 2, February 19, 2026 #8076SE Diane E. The"Cabin Specifications" indicate two bedrooms and two bathrooms;the drawing indicates one bedroom, one bathroom, one study, and one storage room. During the public hearing the applicant provided a"Preliminary Plan Set"titled "Bianculli 450 Saltaire Way Mattituck NY 11952,"dated January 15, 2026, pp. 1, 2, 2A, 3,4, 4A,413, 5, 5.1, and 5.2, prepared by Glenco, Inc. for builder Rolling Cabins of Munfordville, Kentucky and depicting a 16.0 foot by 44.0 foot structure with a 22.0-foot wide covered front porch, 2 bedrooms,'l bathroom, a kitchen, living room, dining room, and storage room, mounted on a foundation with a crawlspace of approximately 3.2 feet. The Southold Building Inspector determined the apartment livable floor area to be approximately 664 square feet, as noted in"Verification of Livable Floor Area" submitted to the ZBA, received January 28, 2026. The property is covered by four Certificates of Occupancy: No. Z-3254 dated August 30, 1968 pursuant to Building Permit 3654-Z dated October 3, 1967, for a private one family dwelling. No. Z-20293 dated October 21, 1991 pursuant to Building Permit 20212-Z dated October 18, 1991;for "replace and enlarge existing deck addition to one family dwelling." No. Z-28486 dated June 5, 2002 pursuant to Building Permit 26595-Z dated June 19, 2000, for a one- story addition and deck additions to a single-family dwelling. No. 38644 dated November 4, 2016 pursuant to Building Permit 39840 dated June 4, 2015,for a front porch addition to an existing one family dwelling. The application included a copy of a NYS Department of Health Certificate of Live Birth for Philip Machael Bianculli, date of birth January 21, 1989,to parents Diane Elizabeth Manus and Michael James Bianculli. The application included two utility statements(Burt's Reliable and PSEG)addressed to the applicant at the subject address and an undated, one-page two-year lease agreement between the applicant and Philip Bianculli. The Board received letters from two neighbors objecting to the proposed accessory apartment. One letter suggested the accessory structure would adversely affect community character, expressed concerns about proximity of parked cars to their pool, noted that the adjacent farmland was not identified on the application's Agricultural Data Statement and included a copy of Covenants and Restrictions for Mattituck-Saltaire, Inc. which limit lots to one private dwelling on each. According to town records, the neighboring farm lot referred to is not listed as an Agricultural District parcel, so it was not required to be listed on the Agricultural Data Statement. As indicated in the Declaration of Covenants, and advised by the Board's counsel,the restrictions had expired on January 1, 1982. The second letter also noted the absence of the identification of the adjacent farmland, noted the homeowners' association limitation of one dwelling per lot, reported that the applicant indicated plans to include a basement and porch with the accessory structure, and questioned whether, with a rebuilt swimming pool, lot coverage limits may be exceeded. Two neighbors and several other residents of the Mattituck Saltaire community testified at the public hearing in opposition to the project. f Page 3, February 19, 2026 #8076SE Diane E. Bianculli SCTM No. 1000-100-1-3 7 FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 5, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13) to establish an Accessory Apartment in an Accessory Structure and finds.that the applicant does NOT comply with all of the requirements for the reasons noted below: The dwelling unit does not comply with the definition of"accessory apartment" in §280-4 of the code. Town Code in §280-4 defines an "accessory apartment" as "An apartment created in a presently existing one-family dwelling unit or accessory structure pursuant to §280-13A(6)or§280-13B(13)." The proposed accessory apartment will not be created in an already-existing one-family dwelling unit or accessory. structure. Specifically, §280-13A(6) permits "one accessory apartment in an existing one-family dwelling," while §280-13B(13) permits"one accessory apartment in a lawfully existing detached accessory garage, barn or storage building." The proposed accessory apartment meets neither of these conditions as it is not located in the existing one-family dwelling and is not proposed to be located in a lawfully existing detached accessory garage, barn, or storage building. None of the certificates of occupancy provided legalize an existing detached accessory garage, barn, or storage building, and the Board's site inspection confirmed that the sole accessory structure on the property is a 10-foot by 14-foot shed in the rear yard. My husband and I are in opposition to this second dwelling being erected. My first complaint after reviewing her application is there are several questions left unanswered or improperly being answered. One issue is her answer regarding the Agricultural Data Statement. She has said no to question 7 stating she is not within 500 feet of a farm. The property adjacent to the rear of her lot is coded 120 and is zoned for field crops. To the best of my knowledge this has been a farm since before i moved here in 1987. She neglected to provide the name and address of the farm land. Our homeowners association, Mattituck-Saltaire Inc., states there is only one dwelling allowed per lot. Due to the new town rules we are now allowed to take our small, quiet neighborhood and potentially double the amount of the homes if others decide to follow suit. This will increase the amount of people and traffic. We have always been happy when development rights have been sold on land enabling it to. remain free of houses and to maintain open space. This is doing the opposite of that which will lead to overcrowding our town. The farm view we have enjoyed all these years will now be blocked by this second dwelling and if she carries the driveway to this structure we will be staring at her cars instead. Also she said her plans are to include a basement as well as a porch. These plans are not reflected on her application. I do not mean this as a personal attack but who is to say she will use this basement as living space rather than storage. It would then become two stories. She also intends to replace her pool which that and the porch may be over the limit of square footage allowed. How is it that a half acre lot is allowed the same size second dwelling as a 1, 5 or 10 acre lot. This seems proportionally off.As the adjoining lot it is difficult to think that when I sit in my backyard or look out my back windows I will now be looking at this second dwelling losing any privacy. We recently found out that our neighbor has applied for a "Special Exemption for an accessory apartment in a new accessory structure". The proposed exemption is for 450 Saltaire Way in Mattituck and we live to the North at 550 Saltaire Way. Naturally, we are very upset about the possibility of having a second house just 10 feet from our property line. A second house on the 100' x 200' lot will drastically change the character our neighborhood. If this 704 ft.z, 16' x 44', house is allowed, it will negatively change the character and style of our community. In addition, our Mattituck-Saltaire Inc. Association has deeded covenants and restrictions in place stating "no building other than one private dwelling for the use and occupancy of one family shall be erected on any one lot'. We have enclosed a copy of protective covenants for reference. We moved into our home in 1985. Patti has had the privilege of being raised in Mattituck and then raising our three children in Mattituck. We have cherished our relaxed rural lifestyle and outdoor recreation. This new house will sit next to our pool and patio where we spend much of our time with family and friends. We are blessed with our open farm and vineyard views. A second house will impact our views, block our sky plane, sunrise, moonrise, night sky and impact our privacy. They are planning for a front deck on their ADU which will directly face the back of our house and the adjoining neighbor. They could potentially be parking cars in close proximity to our pool area. This house will cause additional light pollution to our night sky. We have reviewed the application and have some questions: • Is Mattituck considered urban as the application states? • Why does it state that the land to the east is not farmland? The tax records state that it is and has been since we've moved here. • Is a full basement allowed and why is it not on the application? • The code states one story, but what is the exact height restriction? • How many bedrooms and bathrooms are stated on the application? The plans submitted show a two bedroom, two bathroom dwelling. • What about the water runoff? We are aware that if the owner or family member does not live in this ADU, it is put on the Southold Town Affordable Housing Registry. We have concerns about our home equity. We all know that our potential buyer would not choose to buy our home with two large structures next door and with blocked farm and sky views over a similar home in our town.
