SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk.County Administrative Code Sections A 14- 14 to 23. LWRP DETERMINATION: The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. REQUEST MADE BY APPLICANT: The Applicant requests a Special Exception under Zoning Code Section 280-13(B)(13). The Applicant is owner of the subject property requesting authorization to establish an Accessory Apartment in an existing accessory structure, at: 110 Soundview Road,Orient,NY. SCTM No. 1000-15-3-331 PROPERTY FACTS/DESCRIPTION: The subject,non-conforming, 20,794 square feet, 0.465 acre pentagonal-shaped property is located in the R40 Zoning District with two road frontages and measures 135.00 feet along Sound View Road,then continues 147.97 feet along a residentially developed lot to the east, then runs 72.00 feet'and continues 90.00 along a residentially developed lot to the south,then runs 125.00 feet along Ryder Farm Road. The parcel is developed with a two phis story wood frame residence with substantial enclosed',porches, decking and roof terraces with a garage beneath, access stoops, attached structures, attached planters, substantial paved areas, an inground swimming pool, and a detached two- story wood frame garage,with an unfinished second floor(subject of this application). All as shown on a survey prepared by John T. Metzger, Licensed Surveyor, and last revised January 4, 2022. ADDITIONAL INFORMATION: T he applicant provided architectural plans consisting of demolition and construction plans, elevations, and site photos, labeled A 10 1 and A301, prepared by John Jacob Pschenica, Registered Architect, dated October 10, 2025, relative to the creation of an accessory apartment in the accessory garage structure. Page 2, February 19,2026 #8075SE Lawrence—Accessory Apartment SCTM No. 1000-15-3-33 The applicant provided copy of the Town of Southold records relative to parcel development, including: • Certificate of Occupancy#42970, dated April 2, 2022 covering the construction of the house. • Certificate of Occupancy#42971, dated April 2, 2022 covering an accessory garage. • Certificate of Occupancy#42972, dated April 2,2022 covering an accessory inground swimming pool. Prior Zoning Board of Appeals relief was granted in file#6870,dated August 13,2015, permitting the initial construction of the residence. The Southold Town Building Department provided a"Verification of Livable Floor Area" dated October 27, 2025, indicating the proposed accessory apartment will contain 527 square feet and that the improvement will conform to Section 280-13B(13)(a)of the Code. The applicant's survey illustrates that the Suffolk County Board of Health permits the construction of up to 7 total bedrooms; presently the home contains 5 bedrooms. The accessory apartment proposes the addition of two bedrooms. The applicant provided the following documentation relative to fulfilling residency and tenant requirements for a Special Exception: • Copy of a lease(incomplete and not executed)between the property owner and Dawn Kimmins. • Copy of New York State-issued Driver License for each Kerry Jeannine Kimmins(Lawrence)and John Eric Lawrence, both with a street address of 7 Club House Court, East Setauket,NY. • Copy of a PSEG Long Island electric bill for the subject premises. • Copy of a Suffolk County Clerk recorded deed for the subject premises dated June 23, 2025. The applicant has stated that the accessory apartment is for the sole use of her mother, Dawn Kimmins. On February5 2026, the applicant provided the Zoning Board of Appeals with a copy of a birth certificate illustrating familial status(mother-daughter)along with a copy of the proposed lease for the premises. The lease provided is incomplete. Two neighbors spoke during the public hearing,discussing the history of the house and the prior relief granted, along with voicing concerns about prior rentals, noise, and parking issues. The applicant acknowledged that when a Special Exception allowing the establishment of an accessory dwelling unit in an accessory structure is granted,that one of the units is to be for the sole exclusive occupancy of the property owner,the other unit shall be leased to a family member or person on the Affordable Housing Registry and they are not permitted to rent either other than as stipulated in this determination. Furthermore, the applicant acknowledged understanding that the Special Exception is non- transferable. An interior site inspection of the accessory structure was conducted on January 22,2026 by members of the Zoning Board of Appeals. Sufficient parking exists to conform with the Town Code requirements. No other members of the public spoke in favor of or against this application. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 5, 2026 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of Page 3, February 19,2026 #8075SE Lawrence—Accessory Apartment SCTM No. 1000-15-3-33 the property and the surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant. In considering this application, the Board has reviewed the code requirements set forth pursuant to Article III, Section 280-13(B)(13)to establish an Accessory Apartment in an Accessory Structure and finds that the applicant does comply with all of the requirements for the reasons noted below: 1. The owner confirms that the accessory apartment shall contain no less than 220 square feet and shall not exceed 750 square feet of livable floor area and shall have no more than two bedrooms and one bathroom with the entirety of the livable floor area of the accessory apartment located on one floor of the accessory structure. The architectural plans prepared by John Jacob Pschenica, Registered Architect, dated October 10,2025 propose an accessory apartment with one full bathroom entirely on the second floor of the accessory garage structure with a'conforming 527 square feet of livable floor area, as verified by the Building Department's"Verification of Livable Floor Area" request by the ZBA dated October 27, 2025. 2. The accessory dwelling unit complies with the definition of same in §280-4 of the code. 3. The applicant herein owns the property as documented by copy of the deed as recorded by the Clerk of Suffolk County, copy of a PSEG electric bill and personal testimony and confirms that: occupancy of the resident structures on the premises shall be subject to the issuance of an annual rental permit in accordance with 280-13D and the following requirements: one of the dwelling units shall be for the sole, exclusive occupancy of the owner or family member, as defined in chapter 280-4. The other dwelling unit shall be leased for year-round occupancy, evidenced by a written lease for a term of one or more years,to a family member or a resident who is currently on the Southold Town Affordable Housing Registry and eligible for placement. The applicant testified that the tenant of the accessory apartment will be the applicant's mother, Dawn Kimmins, as evidenced by a copy of her birth certificate. 4. The owners' plans comply with the on-site parking requirements of three spaces,two for the principal dwelling and one for the accessory apartment, and provide for a total of three (3) parking spaces, as shown on the survey prepared by John T. Metzger, Licensed Surveyor and last revised January 4, 2022. 5. Only one accessory apartment will be on the subject property and no Bed and Breakfast facility, as authorized by Section 280-13(B)(14) hereof, shall be permitted in or on premises for which an accessory apartment is authorized or exists. 6. This conversion is/shall be subject to a building permit, inspection by the Building Inspector, approval by the Suffolk County Department of Health Services of the water supply and sewage disposal system(s) and the issuance/renewal of an annual permit in accordance with Chapter 280-13D. 7. No special exception shall be granted unless the Zoning Board of Appeals, in addition to the considerations, determinations and findings required in Chapters 280-142 (General Standards)and 280-143 (Matters to be Considered), specifically finds and determines the following: a) That the granting of the special exception will not adversely impact the privacy and use and enjoyment of any adjoining parcel. b) That the granting of the special exception will not adversely impact the character of the neighborhood in which it is located. c) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the surrounding neighborhood. Page 4, February 19,2026 #8075SE Lawrence—Accessory Apartment SCTM No. 1000-15-3-33 d) That the cumulative effect of approving the present application along with previously approved applications will not have a cumulative adverse impact on the school district in which the property is located. e) That sufficient off-street parking exists on the subject property to accommodate the proposed accessory apartment. f) Whether adequate buffer yards and screening can and will be provided to protect adjacent properties from possible detrimental impacts of the proposed use. RESOLUTION OF THE BOARD: In considering the entire record and the applicable code requirements, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the Special Exception Permit as applied for, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant is to provide the Zoning Board of Appeals with a copy of a completed, signed and notarized lease between the property owner and the tenant, Dawn Kimmins, prior to issuance of the Certificate of Occupancy on the accessory apartment and the associated rental permit. 2. This Special Exception Permit requires an annual renewal by a Code Enforcement Officer. It is the applicant's responsibility to apply to the Building Department each year to renew the accessory apartment permit. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. 3. This Special Exception permit cannot be transferred to new owners. 4. The subject property (house or accessory apartment) is not eligible to be rented, outside of the Special Exception permit, as described herein. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision, may result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. In the event that this is a special permit subject to conditions, the approval shall not be deemed effective until such time that the foregoing conditions are met; and failure to comply therewith will render this approval null and void. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. (5-0) AesilieKanes Weisman, Chairperson Approved for filing 7� /2026 RESIDENTIAL LEASE AGREEMENT— 5 BY THIS AGREEMENT made and entered into on March 9th 2026 between John Lawrence and Kerry Kimmins Lawrence of 110 Soundview Ave, Orient, NY, herein after referred to as Lessor and Dawn Kimmins referred to as the Lessee. All transactions pertaining to this lease and conducted by Lessor with the designated representative will be legal and binding on the Lessee. This 2 year lease will commence on a date to be determined once the apartment is built. 1.Rent. Lessee responsible for the rent and agrees to pay equal monthly installments of $1,200 paid at the beginning of each and every month of the lease period, beginning with the first payment on or before TBD Date. The Lessee, if paying by the above installment method will pay the first month and the last months, rents at the time of signing of this lease agreement. The above payment will be made by the due dates to the Lessor by electronic banking methods.. If paid by mail, the post mark must be dated on or before the due date of payment. If the rent is not received by the 15" due day of the month, a late fee of$ 10.00 for the first day rent is late would be charged plus $ 5.00 for each additional day, up to a maximum of 5% of the rental amount. If the rent is paid after the 281" due day of the month, that payment with the stipulated late charges shall be made by a certified bankers check . money order or cash only If after the 30t" due day the rent is not received, Lessor shall have the right to resort to collection methods as accepted by law or at the option of the Lessor, may invoke Article 17 of this lease agreement. If the rent is paid by check and if the check is returned for insufficient funds or for any other reason related to the Lessee's bank account, there will be a $ 30.00 bounced check charge. The replacement check for this payment shall now be by a certified bankers check or cash only. Additionally, rent will still be considered due and any late charges as stated will apply till the bounced check transaction is complete. 2. Security Deposit On execution of this lease, Lessee deposits with Lessor$1,200 receipt of which is acknowledged by Lessor, as security for the faithful performance by Lessee of the terms hereof, to be returned to Lessee, without interest, on the full and faithful performance by him of the provisions hereof. If within 30 days the Lessee has vacated the premises it is in as good a condition as it was found, except for normal wear and tear, Lessee has returned keys and provided Lessor with a forwarding address, Lessor will return the deposit in full or give Lessee an itemized written statement of the reasons for and dollar amount of any of the security deposit retained by the Lessor. Lessor may withhold all or part of Lessee's security deposit necessary to 1. remedy any default by Lessee in the payment of rent 2. repair damage to the premises, except for ordinary wear and tear caused by Lessee 3. clean the premises if necessary, 4. compensate Lessor for any other losses as allowed under law. 5. pay for any unpaid utility bills. 6. Removal of any furniture left behind by tenants The security deposit shall NOT be used as the last months rent OR any months rent without the express written approval of Lessor Upon Approval of Landlord with Written Notice. If the rent for any extended term of this lease shall be increased, the Lessee will deposit the additional money with the Lessor as security to equal the increase in rent. 3. Quiet Enjoyment Lessor covenants that on paying the rent and performing the covenants herein contained, Lessee shall peacefully and quietly have, hold and enjoy the demised premises for the agreed term. 4. Use of Premises The demised premises shall be used and occupied by Lessee exclusively as a private residence and neither the premises nor any part thereof shall be used at any time during the term of this lease by Lessee for the purpose of carrying on any business, profession or trade of any kind , or for any purpose.other than as a private single family residence. Lessee shall comply with all the sanitary laws, ordinances, rules and orders of appropriate governmental authorities. At no time shall the Lessee use the premises to store or accommodate material not belonging to Lessee. 5. Number of Occupants The Lessee agrees that the demised premises shall be occupied by no more than two persons, consisting of 2 Adults. The number of cars that the above occupants can park at the premises is strictly limited to 2 cars. 6. Condition of Premises Lessee stipulates that they have examined and satisfied themselves that the demised premises and all equipment contained therein including the grounds and all buildings and improvements and that they are, at the time of this lease, in good order, repair and good working condition and is in a safe, clean and habitable condition and agrees to accept it " AS IS". This "AS IS " condition is the condition of the property when the Good Faith Deposit agreement is signed. This examination and satisfaction by the Lessee should be done before the Good Faith Deposit is given and hence establishes the "AS IS " condition. The Lessee is given 3 further days after occupation to bring to Lessor's notice any discrepancy that Lessee may have noticed and needs attention, repair or simply struck off the lease. After this period, Lessee assumes responsibility for the premises till handing over at the end of the lease period. 7. Assignment and Subletting Lessee shall not assign this lease, nor sublet nor grant concession or license to use the premises or any part thereof. Any assignment or subletting or operation of law, shall be void and shall , at Lessor's option, terminate this lease. 8. Alterations and Improvements Lessee shall be responsible for damages caused by negligence and that of his family or invitees and guests. Lessee shall not paint, paper or otherwise redecorate or make improvements to the premises without the express prior consent of the Lessor. Improvements made shall become the property of Lessor and shall remain upon and be surrendered with the premises at the expiration or sooner termination of this lease. 9. Dangerous Materials Lessee shall not have on the leased premises any article or thing of a dangerous inflammable or explosive character that might unreasonably increase the danger of fire on the leased premises or that might be considered hazardous or extra hazardous by any responsible insurance company. 10. Maintenance and Repair Lessee will, at their sole expense, keep and maintain the leased premises and appurtenances in good and sanitary condition and repair during the term of this lease and any renewal thereof. 11. Entry by Lessor Lessee agrees to allow Lessor and his agents to enter the premises at any reasonable hour to repair, install or work upon any fixture or equipment in the premises and to perform such other work that the Lessor may decide is necessary. 12. Animals and Pets Lessee shall keep no domestic or other animals on or around the leased premises. 13.Subordination of Lease This lease and Lessee's leasehold interest hereunder are and shall be subject, subordinate and inferior to any liens or encumbrances now or hereunder placed on the premises by Lessor, all advances made under any such liens or encumbrances, the interest payable on any such liens or encumbrances, and any and all renewals or extensions of such liens or encumbrances. U.Surrender of Premises At the completion or cessation of the lease, the premises including all appliances and equipment and any other items provided under this lease will be handed over to the Lessor by the Lessee in good a state and condition as they were at the commencement of the lease, for the successful release of the security deposit. It will be mandatory that all carpets and rugs be vacuumed and steam cleaned and the refrigerator, the stove/oven, dishwasher, and any other equipment provided with the lease be handed over in the same clean condition as was given at the beginning of the lease. In the event any of these items are not found in the same condition as handed over, the Lessor will charge the Lessee the following fee structure as damages to be recovered by the 'security deposit. To vacuum clean carpets $ 50.00 per room To clean oven/cooktop $ 100.00 Keys not returned $ 5.00 per key Any other repairs or damages not listed above will be assessed by the Lessor appropriately and the charges will be deducted from the security deposit. The security deposit will be handed over to the Lessee after Lessee has completed all requirements of this lease and after deducting any monies per the above schedule of prices and/or other assessments to recover the cost of damages. The Lessor is allowed 30 days after the end of the lease term to return the balance of the security deposit. 15. Default If any default is made in the timely payment of rent, improper subletting, or if any default is made in the performance of or compliance with any other term or condition hereof, the lease, at the option of the Lessor shall terminate and be forfeited, and Lessor may re-enter the premises and remove all persons there from. 16.Waiver If the Lessor accepts the rent due under this lease or fails to enforce any terms of this lease, said action by the Lessor shall not be a waiver of any of the Lessor's rights. If a term in this lease is determined to be contrary to New York state Landlord and tenant law, the term shall be void. The rest of this lease shall remain in full force and effect and be binding upon both the Lessor and Lessee. 17. Binding Effect The covenants and conditions herein contained shall apply to and bind the heirs, legal representatives and assigns of the parties hereto, and all covenants are to be construed as conditions of this lease. 18. Damage to Premises If the demised premises, or any part thereof , shall be partially damaged by fire or other casualty not due to Lessee's negligence or willful act or that of his employee, family, agent or visitor, the premises shall be promptly repaired by Lessor and there shall be an abatement of rent corresponding with the time during which, and the extent to which , the leased premises may have been un-tenantable; but, if the lease premises should be damaged other than by Lessee's negligence or willful act or that of his employee, family, agent or visitor to the extent that Lessor shall decide not to rebuild or repair, the term of the lease shall end and the rent shall be prorated up to the time of the damage. 19. Lessee Gives Lien To Lessor Lessee hereby grants a lien on all personal property of Lessee in or upon the premises to Lessor to secure payment of the rent and performance of the covenants and conditions of this lease. Lessor shall have the right upon the default in the payment of rent or other default of Lessee, as agent of Lessee, to take possession of any furniture, fixtures or other personal property of the Lessee found in or about the apartment and hold same under Lessor's lien. Lessor shall also have the right, after proper legal proceedings, to sell same at public or private and apply the proceeds thereof to the payment of any rent added rent or other money due Lessor under the provisions of this lease. 20. Abandoned Property of Lessee If at the end of the Term of this lease, or if Lessee no longer resides in the premises before the end of the Term, any property of the Lessee left at the premises shall be considered abandoned property. Lessor at his option may dispose of any such property which he considers to be valueless and store the remaining property for the time period required by law and then dispose of the property in any way Lessor sees fit. The cost of such disposal will be at the cost of the Lessee. 21.Additional Terms & Conditions a. Garbaae Lessor will provide the garbage collection schedule to Lessee. Lessor will also provide a suitable garbage collecting container to the Lessee for collection and disposal of their garbage. b. Snow Removal The Lessor will be responsible for snow removal c. Lawn Maintenance The Lessor will be responsible for all landscaping. d. Tenant Insurance Lessor will not be liable for any loss to Lessee's property. Lessee have been advised of the benefits of obtaining renter's insurance to insure their personal property. Lessee understands that the Lessor does not have liability insurance to cover Lessee's property from any loss and Lessee waives the right of subrogation from Lessee's insurance company against Lessor's. e. Parkins The driveway of the house should be used at all possible times to park the vehicles belonging to the Lessee & their friends/visitors . In any event, irrespective of any situation, all vehicles should be parked in the driveway during the winter period. It should be understood by Lessee that no vehicles should be parked on the street when it has snowed and facility must be extended to the town snow plow to clean the road without any hindrances. f. Improvements to Premises Lessor shall have no right for additional construction and / or improvements to the premises or to any part of the main property as they see fit. g. Lessee's Duty to Obey Laws and Regulations The premises being occupied by Lessee is a Legal Rental property. Therefore, Lessee must, at Lessee's expense, promptly comply with all laws, orders, rules , requests and directions of all governmental authorities, Lessor's insurers, Board of Fire Underwriters, or similar groups. Notices received by Lessee from any authority or group must be promptly delivered to Lessor. Lessee may not do anything which may increase Lessor's insurance premiums. If Lessee were to do anything to create this increase, Lessee must bear the consequent increase in premium as Added Rent. 22.Entire Agreement: No Waivers a. Entire Agreement. This document constitutes the entire Agreement between the parties, and no promises or representations, other than those contained here and those implied by law, have been made by Lessor or Lessee. Any modifications to this Agreement must be in writing signed by Lessor and Lessee. b. No Waivers. Only a written agreement between the Lessor and Lessee may waive an obligation or violation of this Agreement. A waiver may not be implied by the Lessor `s acceptance or rent, or failure to take immediate action against the Lessee, while the Lessee is violating one or more provisions of this agreement. The applicant, on July 16, 2015, submitted a plan that eliminated all but one variance. The applicant reduced the size of the decks and porches in the front yard and relocated the rear deck to a conforming setback. The reduction of the porches and decks reduced the Iot coverage to create conforming lot coverage. The applicant is requesting a front yard setback of 36.7 feet from Ryder Farm Road for a 4ft.X 9.4 ft.wood stoop. ADDITIONAL INFORMATION: At the hearing a question arose regarding the height of the dwelling and the percentage of dormer on the accessory garage roof. The applicant provided certified plans noting code conforming height and the garage roof was conforming to code per the building department. At the Public Hearing many neighbors spoke against the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals field a public hearing on this application on July 2,2015 at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 5267-b(3)(b)(1). Grant of the variance as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The majority of the improved parcels in the area of this subdivision along the south side of Sound View Road are more modest in size than the dwelling under construction on the subject property. However, many of the homes across the street on Sound front parcels are Iarge in size and the one variance for a front yard setback on the applicant's corner lot is consist with other setback variance relief in the neighborhood. 2. Town Law U67-b(3)(b)(2).The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's amended survey removed all but one variance, for a front yard setback,which essentially serves as an elongated landing entry to the dwelling. 3. Town Law $267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 8% relief from the code. 4. Town Law 4261-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law U67-b. Grant of the relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
