V: ANALYSIS The parcel is greater than 7 acres and is subject to the clustering requirement where 60% of the buildable land must be preserved as open space. 1 Southold Planning Department Staff Report Open Space The open space is intentionally sited to protect roadway views by preserving frontage. It also establishes a natural, wooded buffer exceeding 100 feet adjacent to Richmond Creek. At 8.4 acres, the designated area constitutes 62.6% of the buildable land, above the required minimum. Pursuant to § 240-44, the applicant indicates that active recreation areas comprise 43.8% of the total open space, which is within the maximum allowable limit of 50% defined by code. Full compliance with the 5-acre cap, setback requirements, and other specifications will be verified via further analysis prior to conditional sketch approval. Once this open space use is reviewed and analyzed, the FEAF may need further corrections to accurately address projected water usage, particularly regarding the maintenance and irrigation of active recreation facilities. Parcel Access Access to each lot is proposed as a private driveway from Indian Neck Lane. Yield Plan The Yield Plan demonstrates a six-lot standard subdivision based on the 80,000- square-foot zoning of the district. Per Town Code § 240-10B(2)(b), all yield and density calculations must be determined based on buildable lands, specifically excluding freshwater wetlands. The current application relies on a wetland survey dated October 2021. Given the time elapsed, a formal re-flagging and verification of the wetland boundary is required. Because the wetland line serves as the baseline for all land deductions and setback requirements, any shift in this boundary will require a revision of the Yield Plan and density calculations. The current yield calculation accounts for the following deductions: • Wetlands: 39,528 sq. ft. (0.91 acres) deducted per§ 240-1013(2)(b)[2]. • Covenants: 26,139 sq. ft.
