Box 1179 Southold, NY 11971 Re: Reversal of the Zoning Officer's Denial 2050 Dignans Road, Cutchogue, NY 11935 SCTM: 1000-83-2-7.3 Narrative to the application To Whom It May Concern, The applicant respectfully submits this appeal seeking reversal of the Zoning Officer's denial regarding the Certificate of Occupancy for the newly constructed conditioned storage barn located at 2050 Dignans Road, Cutchogue, New York. A building permit for this structure was duly issued in 2022, and construction commenced in June 2023. During construction,the applicant applied for and received approval from the Suffolk County Department of Health Services,and in February 2025, submitted this approval along with a request to amend the building permit to include a half-bathroom on the second floor.The amended permit(No. 48634)was issued on February 11,2025. In March 2025,the Building Department advised that a bathroom on the second floor would require a variance from the ZBA, asserting that such a bathroom is not expressly permitted under the Code. It was further stated that a bathroom on the first floor would not require a variance.The applicant respectfully disagrees with this interpretation.The Code does not expressly authorize bathrooms on the first floor either;therefore,the absence of an explicit allowance should not be construed as a prohibition. On May 22,2025,the applicant received a formal denial letter.The letter briefly mentions the half-bathroom, but places greater emphasis on an alleged impermissible use of the structure.Specifically, it references"personal art workshop and studio and antique storage"as prohibited under Town Code Article XXIII §280-13(C).This characterization of the proposed use is inaccurate.At no time did the applicant request approval for an art workshop or studio, and none of the property owners is an artist. The intended use is, and always has been,storage incidental to the residential premises.The first floor is to store a boat, as well as gardening tools and equipment. The second floor will house yacht drawings,along with the owner's collection of antiques.The half-bathroom is intended solely for convenience,as the owner anticipates spending extended periods of time in the storage space. Town Code§280-13(C)(4)explicitly permits garden house,toolhouse, storage building, playhouse,wading pool, swimming pool or tennis court incidental to the residential use of the premises and not operated for gain." In fact,the Code lists fifteen categories of,fermi ►ry uses, many of which have a far greater potential impact on the environment, neighbo , and community character than the storage use proposed here. For these reasons,the applicant respectfully requests that the Zoning Board of Appeals reverse the denial issued by the Building Department. Alternatively,should the Board concur with the Building Inspector's interpretation of the Code and decline to recognize the proposed storage as a permitted accessory use,the applicant respectfully requests that the Board grant any and all relief necessary to allow the use as proposed.The applicant has acted in full reliance on the duly issued and approved plans, and it would constitute an unreasonable hardship to require alteration of either the structure or its benign, incidental use.
