SCTM No. 1000-57-1-34 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with LWRP. Policy ]. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. 1. Structure within this area should be avoided or minimized due to repetitive loss from storm damage, including hurricanes. The 3963 sq. ft. gross floor area, where 3197.6 sq. ft. is permitted in this structural hazard area, is not supported. The 21.4% lot coverage, where 20 % maximum is permitted, is not supported by Policy 4. Minimize loss of life, structures, and natural resources from flooding and erosion. 4.1 Minimize losses of human life and structures from flooding and erosion hazards. A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. S. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. 2. Groundwater elevation is expected to rise over time in this structural hazard area, threatening the built structures. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. It is the opinion of .this board that the practical difficulties demonstrated ar_e not sufficient to warrant a grant- ing. of all the variances requested; however., a reduction of the square footage to 500 sq- ft. over the 20% maximum-permitted of _ the zoning code (or 431.2} sq. ft. total ), and a reduction of_.t.he east sideyard setback to 16.` 8,° at the- northeast corner of the existing deck (allowing a_ 3` duck) and 7` at the southeast corner of the existing. deck (as exists), and a straight. line drawn on an angle connecting these two points (to allow a walk- way from the east side of the dwelling to the pool .and deck area in question), would not be u.n.reasonable under the circum- stances.
