GARY AND MARY NAPOLITANO #8022 - Request for a Variance from Article XXXVI, Section
280-207 and the Building Inspector's May 5, 2025 Notice of Disapproval based on an application for a
permit to construct additions and alterations to an existing single family dwelling; at; 1) gross floor area
exceeding permitted maximum square footage for lot containing up to 20,000 square feet in area; located
at: 1250 Blue Marlin Drive, (Adj. to the Peconic Bay) Greenport ,NY. SCTM No. 1000-57-1-34
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the action is
INCONSISTENT with the below listed Policy Standard and therefore is INCONSISTENT with
LWRP.
Policy ]. Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location,
and minimizes adverse effects of development.
1. Structure within this area should be avoided or minimized due to repetitive loss from
storm damage, including hurricanes.
The 3963 sq. ft. gross floor area, where 3197.6 sq. ft. is permitted in this structural hazard
area, is not supported.
The 21.4% lot coverage, where 20 % maximum is permitted, is not supported by Policy
4. Minimize loss of life, structures, and natural resources from flooding and erosion.
4.1 Minimize losses of human life and structures from flooding and erosion
hazards.
A. Minimize potential loss and damage by locating development and
structures away from flooding and erosion hazards.
S. Manage development in floodplains outside of coastal hazard
areas so as to reduce adverse environmental effects, minimize the
need for future structural flood protection measures, or expansion
of existing protection measures and to meet federal flood
insurance program standards.
2. Groundwater elevation is expected to rise over time in this structural hazard area,
threatening the built structures.
Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfi-ont Consistency Review Law. This
assessment is intended to supplement other iiifoiination used by a Town of Southold agency in

WHEREAS, a public hearing was held and concluded on February 6,
1986,_ in the Matter of the Application for ANNA PACIFICO under Appeal
N6'. 3383 filed July 18, 1985; and
WHEREAS, the board has considered all testimony and documentation
entered into the record concerning this application; and it is noted
that public opposition has been received as, noted in the verbatim
transcript of the hearing and record concerning this matter; and
WHEREAS., the board members have personally viewed and are familiar
with the premises in question, existing structures, and the surrounding
area; and
WHEREAS, the board made the following findings of fact:
1 . The property in question is identified on the Suffolk County
Tax Maps as District 1000, Section 53, Block 05, Lot 034, consisting
of a total lot area of 19,,062 sq. ft. with 110 ft. frontage along the
south side of Blue Marlin Drive at Arshamomaque, Greenport, NY, and
is known as Lot #13 on "Map of Southold Shores" filed August 29, 1985,
File No. 3853.
2. By this application, appellant requests Variances for the
construction of an addition to the rear of the house consisting of
a wooden deck, fence enclosure,"pool , and gazebo: (a) with
minimum total sideyards at 14.8 feet [which is established at the

west side, and the east side, a zero setback [and 1 .8' building
eaves encroachment onto the neighboring property]; (b) with a
total lot coverage of 24% for a total of 4610 sq. ft. in area;
(c) with a setback of not closer than 43 feet from the wood bulk-
head and 49 feet to the high water mark [52± feet from the pool
wall to highwater mark].
3. Article III:, Section. 100-31, Bulk Schedule of the Zoning
Code requires a minimum sideya.rd .setback_,. at the easterly side at
15 feet (and minimum at the west side at 10 feet) , a minimum total
sideyard area at 25 feet, and a maximum of 20% lot coverage for all
structures.
4. Article XI, Section 100-119.2 of the Zoning Code requires
". ..all buildings located on lots....adjacent to tidal water bodies. . .shall
be set back not less than seventy-five (75`) feet from the ordinary
highwater mark o.f such tidal water body or not less than seventy-five
(75' ) feet from the landward edge of the tidal wetland, whichever is
greater.. .. ."
5. It is the opinion of .this board that the practical
difficulties demonstrated ar_e not sufficient to warrant a grant-
ing. of all the variances requested; however., a reduction of the
square footage to 500 sq- ft. over the 20% maximum-permitted of _
the zoning code (or 431.2} sq. ft. total ), and a reduction of_.t.he
east sideyard setback to 16.` 8,° at the- northeast corner of the
existing deck (allowing a_ 3` duck) and 7` at the southeast
corner of the existing. deck (as exists), and a straight. line
drawn on an angle connecting these two points (to allow a walk-
way from the east side of the dwelling to the pool .and deck
area in question), would not be u.n.reasonable under the circum-
stances.
In considering this appeal., the board finds and determines:
(a) that the relief as requested is substantial in relation to
the zoning requirements.; being a variance of 20% over the
requirement for total lot coverage; being more than 35% of a
variance from the si.deyard requi.rementsZ and being a variance
of more than 40% of the wetland-setback requirements; (b)
that a reduction as decided herein is not unreasonable under
the circumstances; (c) that there is no other method feasible
for appellant to pursue other than a variance; (d) that the public
health., welfare, safety, order and convenience of the town will
best be served by allowi.ng.the variances as amended by this board;
(e) that by all.owing the variances as amended by this board, a
substantial change would not be created in the character of: this
neighborhood; (f) that the spirit of the zoning ordinance and
the interests of _justice will best be served by granting the
variances as amended and noted below.
Accordingly, on motion by Mr. Goehri.n.ger, seconded by
Mr. Sawicki , it was

a minimum setback of 16'8" from the property line to allow for
a walkway/deck of three feet in width, and that a straight angle
be cut (connecting the northeast corner to the southeast corner
of the deck) to a minimum of 7' from the property line at the
southeast corner (to allow for a walkway to the pool and rear
deck areas from a side entrance of the dwelling);
2. That the total lot area over the maximum-permitted
20% (3812 sq. ft.) shall not exceed 500 .sq, ft. , for a total
lot coverage of 4312 s.q. ft.
3. That a final survey be furnished to the Building
Inspector and Board of Appeals certifying compliance, with
the above.
