Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. Removal of trees within an established non-disturbance buffer is not permitted and definitely not consistent with the "Administrative Permit" requirements of Chapter §275-2 A of the Wetlands Law of the Town of Southold. Additional actions proposed in the application cannot be assessed given that no specifics are provided. There is no list of trees already planted or new vegetation that is proposed to be planted. Use of the terms "erosion control-specific plantings, including native vegetation" is not an adequate description. In addition to this, there is no planting plan provided. Mitigation for tree removal should take into account the species involved (with exceptions for disease-prone species) and the size the specimens. Only native trees of similar size and providing similar habitat value should be considered. These trees were removed for a combination of the following reasons: (1) safety; (2) proximity to the house; (3) condition of the trees; and/or(4) solar panel production. Five of these trees were small to medium dead Beech trees (due to Beech Leaf Disease, for which there is no cure). One of these trees was a small dead White Oak tree. The remaining tree was a healthy White oak tree. Owners purchased the property in February 2023. Upon closing, owner's mortgage bank expressed concerns related to the proximity of several trees to the house. Also at that time, owners were able to find only one insurance company to cover the home at a reasonable rate. Large branches from some of the trees have fallen on the driveway and house over the past 2.5 years. Two years ago, owners hired a tree company to salvage certain trees by limbingthem up and installing a cable between branches. This did not resolve the safety issues and other concerns and therefore, owners came to the unfortunate conclusion that tree removal was necessary. Given this conclusion, together with having moved to Southold full-time in July 2025, to take advantage of the federal subsidies expiring at the end of 2025, owners looked into installing solar panels. Using a program showing the shade on the house from the trees on the property, the solar company identified the trees that needed to be removed for the solar panels to be productive. The solar company indicated that they would file the permit application with the town on owner's behalf. Owners assumed this application would cover tree removal necessary for the solar panels to be productive. Owners were notified by the solar company of obtaining the permit and to avoid further potential personal safety concerns and damage to the home due to the impacts from Hurricane Melissa expected to hit the eastern end of Long Island the evening of October 31, 2025, including upwards of 70 mph wind gusts, owners had the trees removed the week of October 27, 2025. Owners have more than mitigated the removal of the seven trees within Trustee jurisdiction by planting twenty-two trees, more than three times those removed, at various locations on the property over the past six months.
