The subject parcel is a non-conforming 22,650 SF lot in the R-40 zoning district located on Blue Marlin Drive in Greenport in the Southold Shores Subdivision. The lot is only 100' wide and therefore non-conforming in width and like many of the neighboring lots in the community, it has pre-existing nonconforming side yard setbacks. The property is owned by the Mangan and Kennedy families who are related and pursuing this renovation to create adequate living space for their extended family. The project contemplates the demolition of the existing one-story home as well as the deck and sunroom that lie in the VE flood zone. The Applicants propose to construct a new two-story home centered on the parcel with a slight shift in the footprint to the east. The proposed footprint would maintain the pre-existing non-conforming single side yard setback of 14.2 feet and a combined side yard setback of 28.8 feet where a minimum 15-foot side yard setback and a combined 35-foot side yard setback are required under Town Code Section 280-124 on lots measuring up to 39,999 square feet in total size. The proposed construction is otherwise conforming to the front and rear yard setback requirements in Section 280-124. Although the proposed construction is conforming to the required lot coverage, the proposed second floor addition will add 1,755 SF bringing GFA to 3,975 SF which is 400 SF above the allowable GFA of 3,576 SF. The surrounding neighborhood consists of one- and two-story homes varying in size on differently sized lots. Most of the bay side lots on Blue Marlin Drive are two story homes that are comparable in size if not larger than what the Applicant is proposing here and the proposed home falls entirely within the allowable sky plane. For the following reasons, the Applicant submits that variances from the requirements of Sections 280-124 and 280-207 are warranted. i 1. An undesirable change will not be produced in the CHARACTERPOy9lyed neighborhood or a detriment to nearby properties if granted, beca s �EW,x 7 2026 As this Board has acknowledged in prior Determinations for griance relief on Blue Marlin Drive, the prevailing development pattern cons esgo?d- of Appeals-- mix of one-story and two-story homes with the majority of the waterfront properties improved with two-story residences. The narrow lot width for many of the parcels results in side yard setbacks that are nonconforming to current setback regulations. In fact, the next door neighbor was granted side yard setback relief for second story additions with a side yard setback of 10' and a combined side yard setback of 25.9 feet on a lot with similar width (See, ZBA # 7668 od 2022) . Since the relief sought here is more conforming, the granting of relief will not result in an undesirable change to the neighborhood or be detrimental to nearby properties. With respect to the GFA relief requested, the recent amendment to Section 280-207 of the Town Code eliminated the averaging limitation on GFA variances so that the Board may now vary GFA under the standard area variance criteria in the Town Law. The Applicant submits that the granting of the requested GFA variance relief to permit an aesthetically pleasing second floor addition to this home, substantially within its pre-existing, non- conforming footprint will not result in any undesirable change in the neighborhood, and the renovated home will be entirely in character with many of the surrounding homes along Blue Marlin Drive. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The Applicant is seeking the benefit of expanded and upgraded living space to provide sufficient living space for their large family and to meet the needs of 21st-century living. While they are proposing to renovate the residence substantially within the existing non-conforming footprint, the advent of GFA regulations and the pre-existing non-conforming side yard setback trigger the need for variance relief. 3. The amount of relief requested is not substantial because: The Applicant submits that the magnitude of relief sought for side yard relief (5% for the side yard and 19% for the combined side yard) is not mathematically or practically substantial since the construction is essentially within the existing footprint and the relief sought is less than the relief granted to the next-door neighbor (33% and 26% respectively). As for GFA, the Applicant submits that the 11% relief requested is not substantial since the proposed construction is in character with many homes in the surrounding Page 2 of 3 neighborhood and the Board previously determined that the grant" of 12OXO relief for GFA to a nearby homeowner was not mathematically scab , " FEB1 Zoning Board of Appe al�. 4. In addition, as a Type II action, there is no perceivable environmental impact stemming from the proposed renovation. S.
