The Building Inspector denied the applicant's building permit to demolish an existing single- family residence and build a new single-family residence on the following grounds: The subject lot has merged with an adjacent lot to the west(SCTM# 1000-68-3-8.4) pursuant to Article 11 Section 280-10, which states: Merger A nonconforming lot shall merge with an adjacent conforming or nonconforming lot which has been held in common ownership with the first lot at any time after July 1, 1983. An adjacent lot is one which abuts with the parcel for a common course of ffty (50) feet or more in distance. Nonconforming lots shall merge until the total lot size conforms to the current bulk schedule requirements. The applicants assert, based on their property's history,that their lot(Lot 8.3)is not merged with the lot to the west (Lot 8.4), which is not owned by the applicants, and remains a single and separate lot, eligible for the requested building permit. The applicants'property was part of a three-lot subdivision that was approved by the Planning Board in 1971. Lot 1 is depicted on the Suffolk County Tax Map as SCTM# 1000-68-3-8.4. Lot 2 is the subject property. Lot 3 is depicted on the Suffolk County Tax Map as SCTM# 1000-68-3- 8.2. Lot 3 in the subdivision was deeded out to a new owner in 1978. Lot 1 was deeded out to a new owner in 1987, Lot 2, which is the subject property,was issued a Certificate of Occupancy in 1988,which was never challenged. The owners of Lot 2 are, therefore, entitled to rely on the building inspector's determination in 1988,to issue a Certificate of Occupancy for this property and the current Building Inspector cannot second guess that decision nearly four decades later, pursuant to the Court of Appeals in Ralm Mang ement CoW.v. Oo tein (8 NY3d 337 (NY 2007)), Additionally,the Town of Southold did not adopt its merger law until 1995, after the lots had already been placed in separate ownership and the 1988 Certificate of Occupancy had been issued. The Town cannot retroactively merge improved lots that are no longer in common ownership. Therefore,the Zoning Board should reverse the Building Inspector's Notice of Disapproval finding the subject property merged with Lot 8.4 to the west.
