Since the adoption in 2022 of the code limiting residential dwelling size, our Board has heard numerous applications seeking variance relief from proposed projects that exceed the code permitted maximum house size. While the Board fully supports the important goal of maintaining community character by keeping house size in scale with lot size, we have found the administration of the existing code problematic in ways we think were unanticipated. I attended a Town Board work session on September 25, 2025 to bring those issues to your attention and to propose the minor change to Section 280-207 (C)) of the existing code that is before you tonight. This change was reviewed by the Code Committee on November 20, 2025. We believe this small change will improve the ability of the ZBA to render decisions that balance the reasonable rights of property owners with the welfare and character of the community. Let me explain why. Section 280-207 2(C) reads as follows: "The new construction, reconstruction or improvement of any dwelling shall be limited by the standards established by this code, or by variance relief not to exceed the average GFA of dwellings in the immediate area as determined by the Zoning Board of Appeals." GFA is an abbreviation for Gross Floor Area. That definition is quite long and complicated. But part of the definition includes counting interior ceiling heights in excess of 15 feet twice. For example, if you have a cathedral ceiling in your living room,the size of that room is doubled when calculating GFA. The ZBA has had to deny applications for even small additions to a home with a high interior ceiling that would otherwise have been issued a building permit without the need for a variance. Did the code really intend to regulate how a home owner designs the inside of their house? Rather, wasn't the intent to limit the massing and visual impact of the outside of the house on the street and neighborhood? The second issue the ZBA discovered was the lack of a clear definition of"the immediate neighborhood." As a result, property owners and their agents were using the largest homes anywhere nearby and not including the smaller homes when calculating the average GFA. So, the ZBA developed guidelines for applicants that were similar to the code that permits front yard setback averaging. Namely, using the size of other dwellings on both sides of the street where the applicant's property is located. However, since lot sizes,the number of developed lots, and street length vary so much in different neighborhoods this is not a perfect answer. Moreover, it requires the expertise of a licensed architect or engineer to do the research and calculations. This presents two problems. First, finding the required architectural drawings for all of these dwellings is difficult if not impossible. So typically,the best they can do is to resort to using the square footage of other dwellings as noted on the Town's property record cards, and not the GFA as required by code. Second, hiring a design professional to do GFA averaging can be quite costly for property owners who are not guaranteed that the resultant average will work in their favor. However, if those calculations are not submitted,the ZBA cannot determine if the required variance for excessive GFA does or does not exceed the average. And the current code prohibits the ZBA from granting a variance that exceeds the average. The code modification proposed tonight seeks to simplify all of this by eliminating about half a sentence in Section 280-2 (C) to read as follows: "The new construction, reconstruction or improvement of any dwelling shall be limited by the standards established by this code, or by variance relief as determined by the Zoning Board of Appeals." Every variance application before the ZBA always involves a personal inspection of both the applicant's property and neighborhood before a public hearing. The very first Town Law we must apply in rendering a decision is whether the requested variance will or will not "produce an undesirable change in the character of the neighborhood or a detriment to nearby properties." Zoning Boards of Appeal have been evaluating impacts to neighborhood character since the inception of zoning in Southold Town in 1957. We all know that the Town is in the midst of a major zoning code update. Currently the members of the Design Subcommittee of the Zoning Update Advisory Committee, I among them, are working on developing improvements to the existing code limiting residential dwelling size. Of course, any forthcoming proposal will be thoroughly vetted by the Town Board and the public. But as a small interim step, the minor code modification proposed tonight will at least make things simpler to administer. Homeowners seeking building permits for construction that will result in excessive GFA will still have to appear before the ZBA. That will not change. But the ZBA will be able to evaluate the substantiality of the required variance and its impact on neighborhood character based on the six NYS Town Laws we always use for any variance application. The reason this is proposed to be removed was that requirement was onerous and impractical as gross floor area of houses in the immediate area were not readily available to applicants. The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 280" reads as follows: LOCAL LAW NO. -2026 BE IT ENACTED by the Town Board of the Town of Southold as follows: I. PURPSE The purpose of this local law is to address issues concerning the maximum size of one and two family dwellings in certain zoning districts consistent with the Southold Town Comprehensive Plan adopted September 8, 2020, the Vision Statement of which calls for future planning within the Town to be consistent with existing community character and a periodic review and amendment of the Town Code to that end. The Town Board because of objectives outlined in the plan, especially Chapter 3 Land Use and Zoning, finds it necessary to modify the code that established standards for the construction and reconstruction of residential dwellings in certain zoning districts to modify the requirements concerning the use of GFA. II. Chapter 280 of the Code of the Town of Southold is hereby amended to include the underlined words and remove the struck-through words as follows: 1 § 280-207. Maximum gross floor area for residential dwellings in A-C, R-40, R-80, R- 120,R-200, and R-400 Districts (2) In determining the maximum permitted gross floor area, the following provisions shall apply: (c) The new construction, reconstruction or improvement of any dwelling shall be limited by the standards established by this code, or by variance not to exeeed theaver-age as determined by the Zoning Board of Appeals. III. SEVERABILITY If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid. IV. EFFECTIVE DATE This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.
