Although withdrawn prior to the public hearing due to feedback provided by the Trustees during the pre-hearing field inspection,you may recall that the originally submitted application included a swimming pool that was proposed landward of the most seaward side of the dwelling but only 31 feet from the top of the embankment. In response,the Board conveyed that the pool would need to meet a minimum setback of 50 feet from the top of bank, and essentially that if the applicant desired a waterside pool, it would likely be necessary to consider a substantial reconfiguration of the developed nature of the property. Thus, with the intention of proceeding only with the proposed dwelling renovations,the proposed pool was withdrawn from the application without prejudice,and the Board approved the dwelling renovations with a variable width, 10-foot-equivalent non-turf buffer along the top of bank because the proximity of the dwelling made establishment of a uniformly 10-foot wide buffer impracticable. Since the time of permit issuance, however, the permittee has continued to consider options for having a pool on the property, and is now contemplating the possibility of foregoing the approved renovations to the dwelling in its existing location and instead removing the dwelling and constructing a new dwelling relocated substantially farther from the top of bank(80 feet proposed vs. 10 feet existing), which would allow for placement.of a waterside swimming pool at least 50 feet from the top of bank, and establishment of a uniformly 10-foot wide buffer, all as depicted on the enclosed draft site plan prepared by Michael Macrina Architect,last dated December 4,2025. Understanding that the code has since been revised for further increased top of bank setbacks faster than the permittee could formulate an updated conceptual design pursuant to the Board's original guidance,we believe the net environmental gain from potentially trading the currently approved renovations for a 70-foot landward relocation of the dwelling with a swimming pool set back 50 feet from the bank is compelling and for all intents and purposes unique. We would thus like to visit the property with the Board on a pre-submission basis to review the alternate site plan and hopefully gain an understanding of whether the permittee should continue forward with the approved renovations or if the alternate design concept would be well received by the Board. To that end,please find enclosed copies of the current wetlands permit; the above referenced site plan;signed Board of Trustees"Affidavit"and"Authorization"forms;and a check for$150.
