I also wanted to note that the Graf report also references work to an as-built house. In that application, it is accurate that there are additions and renovations proposed to an "existing" house located less than 100 feet from wetlands. However,the use of the term "as built" is potentially confusing/misleading because the Trustees typically use that term to describe a structure that has been constructed illegally/without a wetlands permit required at the time it was constructed. I will try to reach out to Chris directly about Lally to see if he may be misunderstanding the site plan, or if perhaps I am misunderstanding his comments, but in the meantime, please just bring the above to the trustees attention at their work session. WETLANDS PERMIT APPLICATION ADDENDUM FOR SEAN&RANDI LALLY 900 FOX HOLLOW ROAD MATTITUCK,NY SCTM#1000-113-6-22 STATEMENT OF EFFECT Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12, the proposed replacement of an existing dwelling with a new dwelling and accessory garage would not adversely affect Town wetlands but should in fact have a net beneficial impact on the environmental condition of the property and adjacent tidal waters of Mattituck Creek. Specifically, as a result of the below described design elements and incorporated mitigation measures, the project would result in increased separation distance between the dwelling structure and adjacent natural resources, including both the tidal wetland boundary associated with Mattituck Creek and the top of adjacent embankment;potentially reduced runoff and improved runoff quality; and potentially improved groundwater and surface water quality, thus also furthering the respective LWRP Policy 5 and 6 goals of protecting and improving water quality, and protecting and restoring the quality and function of Town of Southold ecosystems. A) Project Design/Shoreline Retreat 1) The project, which is located entirely within a FEMA-designated Flood Zone X and landward of a well elevated embankment fronting Mattituck Creek, would replace an existing dwelling located approximately 77 feet from the top of bank with a new dwelling located a minimum of 99 feet from the top of bank.The seaward edge of the proposed raised masonry patio would be situated landward of the seaward limit of the existing dwelling, and located a minimum distance of 81 feet from the top of bank and 124 feet from tidal wetlands. Thus, in addition to increasing wetland and top of bank setbacks, the project will further the LWRP Policy 4 goals of protecting and minimizing potential loss from flooding and erosion. 2) The existing dwelling to be removed is positioned seaward of the "pier line" established by the closest neighboring dwellings to the west and east,and the new dwelling is proposed well landward of the pier line, thereby converting preexisting noncompliance to compliance with Town Code Section 275-11(A)(3). 3) The proposed raised masonry patio on the waterside of the new dwelling is designed to be aligned as harmoniously as possible with the sloping waterside landscape using tiered planters and steps,as depicted on the "Proposed West Side Elevation' included with the architectural plans submitted herewith. 4) The proposed dwelling is also compliant with all Town zoning requirements, including lot line setbacks, lot coverage, gross floor area(GFA), and sky plane restrictions. B) Mitigation Measures 1) The existing conventional,nonconforming septic system located less than 100 feet from both the top of bank and tidal wetlands boundary would be replaced with a low-nitrogen, innovative/alternative sanitary system (1/A OWTS) located more than 100 feet from both wetlands and the top of bank. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR SEAN&RANDI LALLY 900 FOX HOLLOW ROAD MATTITUCK,NY SCTM#1000-113-6-22 POLICIES 5 & 6 Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12, the proposed replacement of an existing dwelling with a new dwelling and accessory garage would not adversely affect Town wetlands but should in fact have a net beneficial impact on the environmental condition of the property and adjacent tidal waters of Mattituck Creek. Specifically, as a result of the below described design elements and incorporated mitigation measures, the project would result in increased separation distance between the dwelling structure and adjacent natural resources, including both the tidal wetland boundary associated with Mattituck Creek and the top of adjacent embankment;potentially reduced runoff and improved runoff quality; and potentially improved groundwater and surface water quality, thus also furthering the respective LWRP Policy 5 and 6 goals of protecting and improving water quality, and protecting and restoring the quality and function of Town of Southold ecosystems. C) Project Design/Shoreline Retreat 5) The project, which is located entirely within a FEMA-designated Flood Zone X and landward of a well elevated embankment fronting Mattituck Creek, would replace an existing dwelling located approximately 77 feet from the top of bank with a new dwelling located a minimum of 99 feet from the top of bank.The seaward edge of the proposed raised masonry patio would be situated landward of the seaward limit of the existing dwelling, and located a minimum distance of 81 feet from the top of bank and 124 feet from tidal wetlands. Thus, in addition to increasing wetland and top of bank setbacks, the project will further the LWRP Policy 4 goals of protecting and minimizing potential loss from flooding and erosion. 6) The existing dwelling to be removed is positioned seaward of the "pier line" established by the closest neighboring dwellings to the west and east,and the new dwelling is proposed well landward of the pier line, thereby converting preexisting noncompliance to compliance with Town Code Section 275-11(A)(3). 7) The proposed raised masonry patio on the waterside of the new dwelling is designed to be aligned as harmoniously as possible with the sloping waterside landscape using tiered planters and steps, as depicted on the "Proposed West Side Elevation" included with the architectural plans submitted herewith. 8) The proposed dwelling is also compliant with all Town zoning requirements, including lot line setbacks, lot coverage, gross floor area(GFA), and sky plane restrictions. D) Mitigation Measures 5) The existing conventional,nonconforming septic system located less than 100 feet from both the top of bank and tidal wetlands boundary would be replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located more than 100 feet from both wetlands and the top of bank. Unlike conventional septic systems,I/A OWTS sanitary systems are designed to significantly reduce nitrogen loading into the groundwater table. 1 6) A stormwater drainage system consisting of leaders,gutters,and drywells is proposed to collect and recharge roof runoff and backwash from the existing swimming pool, as required by Wetlands Permit No. 10451 issued to the prior owner on August 16, 2023. 7) The non-turf buffer area between the existing pool fence line and top of bank,which was required as a special condition of the previously issued wetlands permit referenced above, would instead be established and perpetually maintained as a vegetated non-turf buffer,thus creating a more natural and effective sink and filter for excess nutrients potentially contained in surface water runoff before reaching the embankment and the tidal wetlands and surface waters of Mattituck Creek. 8) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction.
