Maresca Associates Consulting Engineers, last dated February 9, 2026,which has been revised to depict an additional 10-ft wide, 670 sf vegetated non-turf buffer area in place of existing lawn to the south of the "playhouse," landward of the approximately 3,620 sf area of existing plantings also to be permanently maintained as a vegetated non-turf buffer. Thus, the total area of the proposed vegetated non-turf buffer, including both the existing and additionally proposed plantings,will total approximately 4,290 square feet. Please let me know if you have any questions regarding the revised site plan, which I will also present at the public hearing. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The proposed as-built residence does not meet the setback requirements from a wetland as defined in Chapter §275-2 Definition; word usage and §275-3 Findings; purpose,jurisdiction; setbacks. D. Setbacks. (1) The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) Wetland boundary or bank. [11 Residence— 100 feet. While the proposed work is on an existing structure, it does not meet the 100ft setback requirement from the wetland boundary or bank. Designating existing vegetated areas and an unvegetated beach does not provide any mitigation for the proposed work. Consider reducing the size of the existing lawn and including it in the non-disturbance buffer area. WETLANDS PERMIT APPLICATION ADDENDUM FOR THE WILLIAM J.GRAF IRREVOCABLE TRUST U/A/D 10/18/2018& THE SUSAN H.GRAF IRREVOCABLE TRUST U/A/D 10/18/2018 4855 STILLWATER AVENUE CUTCHOGUE,NY SCTM#100-137-3-8.3 STATEMENT OF EFFECT The proposed project consists of the interior renovation and additions and alterations to an existing single-family dwelling that was damaged by fire last year. The dwelling was constructed prior to 1985 and renovated and altered in 2005 pursuant to Town Wetland Permits 5665 and 6129A. The applicants, who have owned and occupied the dwelling for 25 years, are hoping to use the unfortunately necessary fire damage renovation as an opportunity to also modernize and expand the living space of the very modest 1,325 sf, 1-story dwelling footprint through a 2nd floor addition over a portion of the existing lst floor to remain; a small 2-sty addition to the front of the house; and conversion of the existing screened porch on the side of the house to 1-story living space. To avoid adversely impacting the adjacent wetlands and surface waters, and to ensure compliance with Town wetlands permit issuance standards set forth by Town Code Section 275-12, as well as consistency with LWRP Policies 5 and 6,the project design elements and incorporated mitigation measures described below are intended to protect and improve water quality and to protect and restore the quality and function of the adjacent tidal wetland ecosystem. A) Project Design 1) The proposed additions and alterations are proposed above,in place of,and/or landward of the existing structural footprint in order to 1) avoid any additional encroachment on existing wetland setbacks, and slightly increase the dwelling's wetland setback as a result of removing the existing 4-ft roof overhang; and 2) limit the net increase in Town-defined lot coverage to 164 sf,which increases percent lot coverage from 10.26 to 10.68 percent. 2) The renovated dwelling will remain positioned landward of the "pier line" established by the closest neighboring dwellings to the north and south, compliant with Town Code Section 275-11(A)(3). 3) The renovated dwelling and all proposed improvements,which are located entirely within a FEMA-designated Zone-X flood zone, are also compliant with all Town zoning requirements, including lot line setbacks and limitations on height, sky plane, and gross floor area(GFA). 4) No trees are to be removed within 100 feet of the wetlands boundary. 5) The proposed swimming pool was specifically designed to be located well more than 100 feet from wetlands and is thus not a subject of the application. B) Mitigation Measures 1) The existing conventional septic system located less than 100 feet from wetlands will be replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located at least 125 feet from wetlands. Unlike conventional septic systems, I/A OWTS sanitary systems are designed to significantly reduce nitrogen loading into the groundwater table. 2) A stormwater drainage system consisting of leaders, gutters, and drywells is proposed to collect and recharge roof runoff, and to capture backwash from swimming pool proposed outside Chapter 275 jurisdiction. 3) The up to 47-ft wide, approximately 3,620 sf area of planted and naturally existing vegetation situated between the existing edge of lawn and tidal wetlands boundary is proposed to be established and permanently maintained as a vegetated non-turf buffer,thus ensuring permanent maintenance of a natural sink and filter for excess nutrients potentially contained in surface water runoff before reaching the tidal wetlands and surface waters of Eugene's Creek. 4) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information.The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding,are subject to public review,and may be subject to further verification. GRAF IRREVOCABLE TRUST U/A/D 10/18/2018& THE SUSAN H.GRAF IRREVOCABLE TRUST U/A/D 10/18/2018 4855 STILLWATER AVENUE CUTCHOGUE,NY SCTM#100-137-3-8.3 POLICIES 5 & 6 The proposed project consists of the interior renovation and additions and alterations to an existing single-family dwelling that was damaged by fire last year. The dwelling was constructed prior to 1985 and renovated and altered in 2005 pursuant to Town Wetland Permits 5665 and 6129A. The applicants, who have owned and occupied the dwelling for 25 years, are hoping to use the unfortunately necessary fire damage renovation as an opportunity to also modernize and expand the living space of the very modest 1,325 sf, 1-story dwelling footprint through a 2nd floor addition over a portion of the existing I" floor to remain; a small 2-sty addition to the front of the house; and conversion of the existing screened porch on the side of the house to 1-story living space. To avoid adversely impacting the adjacent wetlands and surface waters, and to ensure compliance with Town wetlands permit issuance standards set forth by Town Code Section 275-12, as well as consistency with LWRP Policies 5 and 6,the project design elements and incorporated mitigation measures described below are intended to protect and improve water quality and to protect and restore the quality and function of the adjacent tidal wetland ecosystem. A)Project Design 1) The proposed additions and alterations are proposed above,in place of,and/or landward of the existing structural footprint in order to 1) avoid any additional encroachment on existing wetland setbacks, and slightly increase the dwelling's wetland setback as a result of removing the existing 4-ft roof overhang; and 2) limit the net increase in Town-defined lot coverage to 164 sf,which increases percent lot coverage from 10.26 to 10.68 percent. 2) The renovated dwelling will remain positioned landward of the "pier line" established by the closest neighboring dwellings to the north and south, compliant with Town Code Section 275-11(A)(3). 3) The renovated dwelling and all proposed improvements,which are located entirely within a FEMA-designated Zone-X flood zone, are also compliant with all Town zoning requirements, including lot line setbacks and limitations on height, sky plane, and gross floor area(GFA). 4) No trees are to be removed within 100 feet of the wetlands boundary. 5) The proposed swimming pool was specifically designed to be located well more than 100 feet from wetlands and is thus not a subject of the application. B) Mitigation Measures 1) The existing conventional septic system located less than 100 feet from wetlands will be replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located at least 125 feet from wetlands. Unlike conventional septic systems, I/A OWTS sanitary systems are designed to significantly reduce nitrogen loading into the groundwater table. 2) A stormwater drainage system consisting of leaders, gutters, and drywells is proposed to collect and recharge roof runoff, and to capture backwash from swimming pool proposed outside Chapter 275 jurisdiction. 3) The up to 47-ft wide, approximately 3,620 sf area of planted and naturally existing vegetation situated between the existing edge of lawn and tidal wetlands boundary is proposed to be established and permanently maintained as a vegetated non-turf buffer,thus ensuring permanent maintenance of a natural sink and filter for excess nutrients potentially contained in surface water runoff before reaching the tidal wetlands and surface waters of Eugene's Creek. 4) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction.
