The proposed action has been reviewed to Chapter§268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. Protect and restore ecological quality by adhering to the following measures. 6.1 Protect and restore ecological quality throughout the Town of Southold. 2. Retain and add indigenous plants to maintain and restore values of natural ecological communities. a. Protect existing indigenous plants from loss or disturbance to the extent practical. The removal of the native cedar tree should not be allowed, but if permitted it should be mitigated through native plantains of at least 6 - 3gallon high tide bushes (Baccharis halimifolia) within a permanent non-disturbance buffer created below the proposed retaining wall. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The proposed work does not meet the setback requirements from a bank defined as: Land incline adjoining a body of water, wetland and/or beach under Chapter §275-2 Definition; word usage. Under this definition, the entire backyard is a bank so none of the proposed work meets the setback requirements as defined by §275-3 Findings; purpose;jurisdiction; setbacks. D. Setbacks. (1) The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees.- (a) Wetland boundary or bank. [5] Swimming pool and related structures: 60 feet. Pools requiring retaining walls greater than two feet above grade— 100 feet. [6]Landscaping or gardening. 50 feet. 2 If any of the proposed work is to be considered for approval a permanent non- disturbance buffer should be established beginning immediately seaward of the second (lower) retaining wall and this area should be planted with the high tide bush shrubs noted above.
