The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. C. Prevent the net loss of vegetated wetlands according to the following measures. Use the measure resulting in the least environmentally damaging practicable alternative. 1. Avoid placement of fill in or excavation of vegetated wetlands. c. Choose design alternatives which would avoid excavation or fill. F. Restore tidal wetlands and freshwater wetlands, wherever practical, to foster their continued existence as natural systems by: 1. reconstructing lost physical conditions to maximize wetland values, 2. adjusting altered chemical characteristics to emulate natural conditions, 3. manipulating biological characteristics to emulate natural conditions through re-introduction of indigenous flora and fauna The placement of"approx. 10 cubic yards of clean fill from an upland source" is not justified or appropriate for placement in a tidal marsh. If fill is used in such situations, it should only be clean sand. In addition, no elevations or biological benchmarks have been provided on the plan to justify the need for fill. Has there been a loss in elevation that requires addition of fill? Based on the photos provided, cordgrass survives along the lower (waterside) edge of the subject area indicating that the higher elevations behind this area are sufficient to support cordgrass. What stressor has caused the loss of grass and how will this be mitigated? Was there a rafting and smothering event that led to the death of the cordgrass or is it some other factor. Planting plugs of cordgrass would be allowable and may facilitate revegetation of the site, but there is no guarantee of success given that the reason for loss has not been determined. While the proposed establishment of a rain garden and bioswale planted with "native vegetation" is potentially beneficial, the lack of a detailed plant species list, source and planting specs make it difficult to ascertain how successful these may be. Such details should be submitted prior to any approval by the Trustees.
