Therefore, we have again revised the dock layout by rotating the structure clockwise so that the landward portion of the catwalk should be shifted to the east enough to avoid disturbing the existing shrubs. As a result,relative to the April 6t"plan, it was also necessary to extend the length of the elevated catwalk landward by 5 feet to reach the tidal wetland boundary, which extends farther landward at the repositioned catwalk location. This latest revision results in a proposed dock consisting of a 4' x 14' inclined ramp, 4' x 156' catwalk, and a 4' x 16' terminal platform that would extend approximately 56 feet seaward of the shoreline, consistent with the previously submitted plans. It remains our hope that the Board will find this latest design to be approvable. In response,we added that pier line to the plan and found that the dock in fact extended beyond it. Therefore,prior to the public hearing on February 11th,we submitted a revised plan that shortened the dock by 25 feet,resulting in a 184-foot long dock that was pier-line compliant and reached a water depth only 2 to 3 inches less than the 2 feet reached by the originally proposed structure. Nevertheless,at the public hearing the Board still expressed concern over the overall length of the pier line and questioned whether the dock could be shortened further without adversely compromising navigable water depth. In response,we have since reevaluated the design and have again revised the plan to shorten the dock by an additional 19 feet,resulting in a 165-foot long dock structure;`now 44 feet shorter than the originally proposed. At this revised length,the proposed dock reaches a water depth between 1.51 feet and 1.65 feet at mean low water and extends only 56 feet seaward of the marsh, exactly matching the length restriction imposed by the Trustees for the immediately adjacent dock to the north,which the Board approved in 2000 pursuant to Permit 5220. The dock proposed here is now 27 feet shorter than the total length of that dock, and it would end approximately 24 feet landward of the pier line. We therefore believe that any further reduction in the length of the dock would not produce any additional navigational or other public benefit,as the dock now meets or exceeds all of the construction and operation standards set forth for docks in Section 275-11(C)(2)of the Town Code,and meets all of the standards for permit issuance pursuant to Section 275-12. For these reasons,we are hopeful the Board will find that the enclosed plans prepared by En-Consultants, last dated April 6, 2026, sufficiently address the Board's concerns and can be approved accordingly. As the pier line is typically drawn between adjacent dock structures (based on the language of the code and the Board's practice),we did not depict a pier line on the originally submitted plans due to the absence of a dock to the south and instead effectively used an eye test to ensure the proposed dock would not extend farther toward the center of the creek than the immediately adjacent dock to the northwest. But if we adjust for the irregularity of the shoreline and the absence of a dock to the southeast by drawing the pier line along the outer limits of both dock facilities to the northwest,the pier line crosses the applicant's property approximately 25 feet closer to the shoreline than the seaward end of the currently proposed dock. Thus,I have attached for your review during Monday's work session an alternate dock layout that depicts the above described pier line and a revised proposed dock reduced in length by 25 feet to align therewith(eliminated section depicted in red). At this reduced length,the outside of the terminal"L" platform still reaches an effective water depth of 2 feet(-1.95')at mean low tide. And the dock's overall length would be reduced from 209 to 184 feet,roughly 8 feet less than the overall length of the adjacent Trustees-permitted dock to the northwest. As I also noticed the width of the adjacent catwalk is 3 feet,we could also potentially reduce the width of the proposed catwalk here to 3 feet,which would also allow us to reduce the dock's elevation above the grade of marsh from 4 to 3 feet,if the Board felt those changes would be beneficial. I would offer to shorten the catwalk length at the landward end as well,but I think it's important to the restoration of the high marsh area that access be achieved via elevated catwalk versus a walking path through the marsh,for example. We can of course discuss further at the hearing,but I wanted to get this alternate layout in front of the Board and ask if it would be helpful to have it staked out for March field inspections. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. Protect and restore ecological quality by adhering to the following measures. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. The proposed dock does not meet the requirements set forth in Chapter§275-11 Construction and operation standards for a residential dock including: C. (2) Docks. (a) Standards for residential and commercial docks; general rules. It shall be the policy of the Town of Southold that all docks shall be designed, constructed and located so as to reduce a dock's potential adverse impacts to navigation, public safety, waterway congestion, access to public trust lands and water, and natural resources and habitats. The following standards will serve as a basis for granting, denying, or limiting permits for the construction of docks, (b) Dock locations and lengths. [2] Within creeks and other narrow waterways, no dock length shall exceed 114 the total width of the water body. Determination of the length of the dock must include the dimensions of the vessel. (c) Regulations for the placement and configuration of docking facilities. [1]Residential docks. [b] If any part of a residential dock structure includes a float or floating dock, the float or floating dock portion shall be designed so that, with the exception of the pilings: (ii]New floats will be permitted only where there exists a minimum of 30 inches of water depth at mean low water. No part of the floating dock will contact the bottomland during a normal low tide. While the proposed dock satisfies the requirements set forth above, given the depth of the water in the creek, the proposed structure can and should be shortened. A dock at this location can achieve 30 inches of water at mean low water much closer to shore than proposed in this plan. In addition to this, since both docks north of this property (there are none to the south) are not included in the survey, a pier line cannot be shown. If the pier line were drawn on the plan using both docks as suggested, the proposed dock may project beyond it.
