En-Consultants on behalf of SEAN R. MCCOYD requests a Wetland Permit to demolish
and remove existing 1,360sq.ft. one-story dwelling with attached garage and deck and
construct in its place a new 1,182sq.ft. 1 & 2 story, single family dwelling with a 143sq.ft.
covered entry deck and 135sq.ft. covered waterside deck with associated steps, and a
432sq.ft. one-story detached garage; install wood utility platform and 4'x7' outdoor
shower with discharge piped to drainage system; replace existing asphalt driveway with
pervious gravel driveway; remove existing septic system and install an I/A OWTS
sanitary system; install stormwater drainage system; and to establish and perpetually
maintain a 10' wide vegetated non-turf buffer along the landward edge of the existing
concrete seawall. Located: 3360 Minnehaha Boulevard, Southold. SCTM# 1000-87-3-

SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type H category of the State's List of Actions, without`
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-1.4 to 23,and the Suffolk County Department of Planning issued its reply
dated September 3,2025 stating that this application is considered a matter for local determination as there appears
to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268,Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated October 29, 2025. Based upon the information
provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available,
it is recommended that the proposed action is CONSISTENT with LWRP policy standards and therefore is
CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: The subject parcel is an 11,007 square foot(10,565 square feet buildable)
non-conforming lot located in the RL40 zoning district. The property line has road frontage of 109.75 ft along
Minnehaha Boulevard,then it runs northeast for 88.33 feet where it meets Corey Creek, it then runs 132.75 feet in
an irregular line along Corey Creek before returning 99.04 feet back to Minnehaha Boulevard. The property is
improved with an existing one(I)-story dwelling with a wood deck in the rear. There is a concrete bulkhead at the
waterline with a fixed and floating dock into the creek.
BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280-
124; and the Building Inspector's June 27, 2025 Notice of Disapproval based on an application for a permit to
demolish an existing dwelling and construct-a single family dwelling and an accessory garage; at: 1) dweIling is
located less than the code required minimum front yard setback bf 35 feet; 2) accessory garage is located in other
than the code permitted rear yard; located at: 3360 Minnehaha Blvd.(Adj.to Corey Creek), Southold,NY. SCTM
No. 1000-87-3-66.4.
RELIEF REQUESTED:The applicant requests variances for the following:
1. Increase the front yard setback from 17.7 feet(existing)to 19.4 feet where a 35-foot front yard setback is
required.
2. Create an accessory garage in the side yard,where a rear yard,or front yard(waterfront)location is permitted.

ADDITIONAL INFORMATION: During testimony at the public hearing from the applicant's agent, the entire
house is to be demolished and a new FEMA compliant two (2)-story residence is to be constructed. The new
residence will bring the property into compliance with both FEMA and the Suffolk County Dept.of Health Services.
The residence will use many of the existing setbacks but will also bring the house more into conformity with the
town zoning code. There was discussion about attaching the garage,thereby removing one of the variances,but that
action would have put the proposal over the allowable Gross Floor Area(GFA). The accessory garage does not
count towards GFA coverage.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on November 6,2025 at which time written
and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property
and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The proposed FEMA-compliant and SCDHS-compliant
residence will be code compliant with respect to lot coverage and GFA. The proposed front yard setback will be
more in compliance with the code than the existing setback. The subject property is one of roughly twenty waterfront
parcels created more than 80 years ago and has been improved with a dwelling since the 1930s. There have been
numerous cases where variance relief was given to a number of these parcels. Since this project is proposing less
non-conformity than the existing front yard setback,there will be no change in the character of the neighborhood.
The accessory garage is also one of many in the neighborhood. As this garage meets all the setbacks and lot coverage
requirements of the bulk schedule, this building will also not create an undue change to the character of the
neighborhood.
2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible
for the applicant to pursue, other'than an area variance. The benefit of constructing a new, modernized, energy _
efficient,FEMA-compliant and Suffolk County Department of Health Services compliant dwelling without creating
additional encroachments on the adjacent wetlands cannot be achieved without variance relief due to the
nonconforming lot size. The proposed residence has been designed to lessen the existing setbacks on the front and
rear of the house in relation to Corey Creek,but with less than 90-foot depth of the property, one setback variance
was required. It was also not possible to create an attached garage without one additional variance request,either for
the excessive GFA or a setback variance.
3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial.
1. The front yard setback represents 45%relief from the code.
2. The accessory garage in the side yard represents 100%relief from the code.
However,the front yard setback relief is not substantial because nonconforming front yard setbacks are common in.
the surrounding neighborhood. Also,the proposed setback represents an increase from the existing 17.7-foot setback
currently in place. The accessory garage relief is not substantial due to the preponderance of accessory structures in
the surrounding neighborhood that currently exist with variance relief. The proposed garage will only be one (1)
story in height and will comply with all setback and lot coverage requirements.
4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law&267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased.the parcel after the
Zoning Code was in effect, and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.

6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a new residence with an accessory garage while preserving and protecting the
character of the neighborhood and the health,safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member Acampora,and duly carried,
to:
GRANT the variances as applied for, and shown on the survey by Howard W. Young, LLS, last revised April 9,

available to me, it is my recommendation that the proposal is CONSISTENT with the

While the applicant argued that the proposed actions were exempt from LWRP review
pursuant to Southold Town Code § 268-3 under the definitions of"minor actions"
including:
B. `Replacement, rehabilitation or reconstruction of a structure or facility, in kind,
on the same site (in place), including upgrading buildings to meet building or fire
codes, except for structures in areas designated by the Coastal Erosion Hazard
Area (CEHA) law where structures may not be replaced, rehabilitated or
reconstructed without a permit and shoreline erosion control structures
(including, but not limited to, groins,jetties, bulkheads, filled piers) located within
Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay,
Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor,
Gardiners Bay, Long Island Sound, Fishers Island Sound and Block Island

F. "Granting of individual setback, lot line and lot area variance, except in relation
to a regulated natural feature or bulkhead or other shoreline defense structure or
any activity with the CEHA."
it was determined that the proposed work, which includes changing the position, size
and number of structures on this parcel does not qualify as a "Replacement,
rehabilitation or reconstruction of a structure or facility, in kind, on the same site (in
place)" and was therefore not exempt.
After review of the application, the proposed work was determined to be consistent with
the following policies:
Policy 5.2. A. Minimize non-point pollution of coastal waters and manage activities
causing non-point pollution.
The proposed action calls for replacement of an existing asphalt driving with a pervious
gravel driveway, establishment of a 1 0-foot-wide vegetated non-tun`buffer adjacent to
the existing seawall, and installation of a stormwater management system which will
help to protect nearby surface water quality.
Policy 5.1 C. Ensure effective treatment of sanitary sewage by requiring sufficient
treatment of sanitary sewage to avoid negative impact to the sole source aquifer.
The proposed action involves replacing a traditional septic system with new I/A OWTS
sanitary system that will reduce Nitrogen pollution to the groundwater, helping to better
protect both coastal waters.
Policy 4.1 A. 3. Move existing development and structures as far away from flooding
and erosion hazard areas as practical. Maintaining existing development and structures
in hazard areas may be warranted for sites where relocation of an existing structure is
not practical.
While redevelopment in the coastal flood hazard area is technically inconsistent with the
LWRP, this action is proposed for land that already is developed with no practical way
to move the development out of the flood zone. The house is proposed to be built to
withstand flooding and minimize loss of life and structures.
Pursuant to Chapter 268, the Zoning Board of Appeals shall consider this
recommendation in preparing its written determination regarding the consistency of the
proposed action.

Program (LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the policies of the LWRP as follows:
1. Foster a pattern of development in the Town of Southold that enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial
use of a coastal location, and minimizes adverse effects of development.
Policy 6. Protect and restore the quality and function of the Town of Southold's
ecosystem.
The height and scale of the proposed structure is not in keeping with the character of
the community and adjacent single-story homes.
6.3. Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other lands
under their jurisdiction.
D. Provide adequate buffers between wetlands and adjacent or nearby uses and
activities in order to ensure protection of the wetland's character, quality, values,
and functions.
The proposed work does not meet the setback requirements from a wetland, beach or
bank as defined in Chapter § 275-2 Definition; word usage and § 275-3 Findings;
purpose;jurisdiction; setbacks.
D. Setbacks.
(1) The following minimum setbacks apply to any and all operations proposed on
residential property within the jurisdiction of the Board of Trustees:
(a) Wetland boundary or bank.

STATEMENT OF EFFECT
Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12,the
proposed replacement of an existing dwelling with a new dwelling and accessory garage would not adversely affect
Town wetlands but should in fact have a net beneficial impact on the adjacent tidal wetlands and waters of Corey
Creek as a result of careful and modest architectural design and environmental mitigation measures designed to
reduce potential flood damage; protect and improve water quality; and protect the quality and function of the
adjacent tidal wetland ecosystem,also consistent with LWRP Policies 4, 5 and 6,as described below.
A) Project Design
1) Although the small size and limited depth of the property substantially constrain the ability to do so,
the project would result in a roughly 7 foot or 24% increase in wetlands setback to the dwelling
structure, as the dwelling with attached waterside deck located 28.7 feet from the adjacent tidal
wetland/waterway would be replaced with a dwelling and attached deck located at least 35.5 feet away.
2) The existing FEMA-noncompliant dwelling would be replaced by a more highly elevated, FEMA-
compliant dwelling that will meet the combined Federal and New York State codes requiring the new
dwelling to maintain a base flood elevation at least 3.5 feet higher than the minimum base flood
elevation required by the FEMA-designated flood zone, thus substantially reducing the dwelling's
exposure to risks of flood and erosion damage.
3) The proposed dwelling will remain situated well landward of the"pier line"established by the adjacent
dwellings,compliant with Town Code Section 275-1 l(A)(3).
4) The mass and height of the proposed dwelling are compliant with the Town's GFA and sky plane
limitations, and total lot coverage increases by only 228 sf to a compliant 18.3 percent.
B) Mitigation Measures
1) The existing conventional septic system located approximately 60 feet from wetlands will be removed
and replaced with a low-nitrogen, innovative/alternative sanitary system (1/A OWTS), which unlike
conventional septic systems is designed to significantly reduce nitrogen loading into the groundwater
table, located approximately 80 feet from wetlands, thus achieving a 20 foot or 33% increase to the
septic system's wetlands setback.
2) An existing asphalt driveway will be replaced with a pervious gravel driveway, thereby additionally
decreasing lot coverage by impervious surface that is not counted as lot coverage.
3) A 10'wide vegetated non-turf buffer is proposed to be established and permanently maintained adjacent
to the seawall, thus restoring a portion of the historically cleared area of the property adjacent to the
waterway, reducing the area of maintained and potentially treated turf lawn adjacent to wetlands, and
increasing the separation distance between potentially treated turf lawn and adjacent waterway.
4) A stormwater drainage system is proposed to capture and recharge roof runoff.
5) A project limiting fence will be installed to contain site disturbance and potential surface runoff during
construction.

assessment is intended to supplement other information used by a Town of Southold agency in

Consistent with the standards for issuance of a Town wetlands permit set forth by Town Code Section 275-12,the
proposed replacement of an existing dwelling with a new dwelling and accessory garage would not adversely affect
Town wetlands but should in fact have a net beneficial impact on the adjacent tidal wetlands and waters of Corey
Creek as a result of careful and modest architectural design and environmental mitigation measures designed to
reduce potential flood damage; protect and improve water quality; and protect the quality and function of the
adjacent tidal wetland ecosystem,also consistent with LWRP Policies 4, 5 and 6,as described below.
A) Project Design
1) Although the small size and limited depth of the property substantially constrain the ability to do so,
the project would result in a roughly 7 foot or 24% increase in wetlands setback to the dwelling
structure, as the dwelling with attached waterside deck located 28.7 feet from the adjacent tidal
wetland/waterway would be replaced with a dwelling and attached deck located at least 35.5 feet away.
2) The existing FEMA-noncompliant dwelling would be replaced by a more highly elevated, FEMA-
compliant dwelling that will meet the combined Federal and New York State codes requiring the new
dwelling to maintain a base flood elevation at least 3.5 feet higher than the minimum base flood
elevation required by the FEMA-designated flood zone, thus substantially reducing the dwelling's
exposure to risks of flood and erosion damage.
3) The proposed dwelling will remain situated well landward of the"pier line"established by the adjacent
dwellings,compliant with Town Code Section 275-11(A)(3).
4) The mass and height of the proposed dwelling are compliant with the Town's GFA and sky plane
limitations, and total lot coverage increases by only 228 sf to a compliant 18.3 percent.
B) Mitigation Measures
1) The existing conventional septic system located approximately 60 feet from wetlands will be removed
and replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS), which unlike
conventional septic systems is designed to significantly reduce nitrogen loading into the groundwater
table, located approximately 80 feet from wetlands, thus achieving a 20 foot or 33% increase to the
septic system's wetlands setback.
2) An existing asphalt driveway will be replaced with a pervious gravel driveway, thereby additionally
decreasing lot coverage by impervious surface that is not counted as lot coverage.
3) A 10'wide vegetated non-turf buffer is proposed to be established and permanently maintained adjacent
to the seawall, thus restoring a portion of the historically cleared area of the property adjacent to the
waterway, reducing the area of maintained and potentially treated turf lawn adjacent to wetlands, and
increasing the separation distance between potentially treated turf lawn and adjacent waterway.
4) A stormwater drainage system is proposed to capture and recharge roof runoff.
5) A project limiting fence will be installed to contain site disturbance and potential surface runoff during
construction.
