The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the policies of the LWRP as follows: Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The proposed as-built deck does not meet the setback requirements from a wetland as defined in Chapter §275-2 Definition; word usage and § 275-3 Findings; purpose; jurisdiction; setbacks. D. Setbacks. (1) The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) Wetland boundary or bank. [1]Residence— 100 feet. While the proposed work is on the landward side of the residence, it does not meet the 100ft setback requirement from the wetland boundary or bank. If the proposed work is permitted, the permanent non-disturbance buffer should be expanded. It should be noted that the condition/status of the existing 5ft non-disturbance buffer appears to be either turf grass and/or ornamental plantings based on the photos submitted. One way to correct this would be to establish a new no disturbance buffer closer to the water in what is currently mowed lawn. Creation of a non-disturbance (including no mowing) in this area would have a greater benefit to the adjacent creek. A) Project Design 1) The proposed additions and associated activities are proposed entirely on the landward side of the existing dwelling, thus creating no encroachments on the existing, previously permitted wetland setbacks. 2) The additions and entirety of the dwelling will remain consistent with the"pier line"established by the adjacent dwellings to the east and west, compliant with Town Code Section 275- 11(A)(3). 3) The renovated dwelling, which is located in a FEMA-designated Zone-X flood zone, is compliant with all Town zoning requirements, including lot line setbacks and limitations on height, sky plane, and gross floor area(GFA); and the additions will result in a net increase to Town lot coverage of 639 sf, increasing coverage to a total of only 8.1% where 20% is permitted. 4) The parking area to be raised and expanded will be retained on its east side by a proposed masonry retaining that will have a maximum exposure of 2 feet above grade, screened with plantings. B) Mitigation Measures 1) The existing conventional septic system,which is partially located less than 100 feet from the tidal wetland boundary and entirely within the 100-foot top of bank setback, will be replaced with a low-nitrogen, innovative/alternative sanitary system (I/A OWTS) relocated landward, more than 100 feet from wetlands,with leaching pools located at least 100 feet from the top of bank.This new I/A system would also treat effluent from the existing pool house located more than 100 feet from the top of bank. 2) A stormwater drainage system consisting of leaders,gutters,and drywells is proposed to collect and recharge roof runoff, and to capture backwash from the existing swimming pool located more than 100 feet from the top of bank. 3) The existing non-turf buffer situated along the top of the bank, which was required by Town Wetland Permit No.7184,would be established and covenanted as a vegetated non-turf buffer, thus ensuring permanent maintenance of a natural sink and filter for excess nutrients potentially contained in surface water runoff before reaching the tidal wetlands and surface waters of Jockey Creek. 4) A project limiting fence would be installed to contain site disturbance and potential surface runoff during construction. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information.The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding,are subject to public review,and may be subject to further verification. The additions include a small enclosed entry addition and deck in place of an existing covered entry deck; and a 1 &2- story attached garage/1-bedroom addition,with an associated expansion and raising of the existing gravel parking area on the landward side of the house. To ensure the proposed dwelling expansion and associated work does not adversely impact the adjacent wetlands and surface waters, and to ensure compliance with the standard policies of the Board of Trustees and standards for issuance of wetland permits set forth by Town Code Section 275-12, as well as consistency with LWRP Policies 5 and 6,the project design elements and incorporated mitigation measures described below are intended to protect and improve water quality and to protect and restore the quality and function of the adjacent tidal wetland ecosystem. A) Project Design 1) The proposed additions and associated activities are proposed entirely on the landward side of the existing dwelling, thus creating no encroachments on the existing, previously permitted wetland setbacks. 2) The additions and entirety of the dwelling will remain consistent with the"pier line"established by the adjacent dwellings to the east and west, compliant with Town Code Section 275- 11(A)(3). 3) The renovated dwelling, which is located in a FEMA-designated Zone-X flood zone, is compliant with all Town zoning requirements, including lot line setbacks and limitations on height, sky plane,and gross floor area(GFA); and the additions will result in a net increase to Town lot coverage of 639 sf, increasing coverage to a total of only 8.1% where 20% is permitted. 4) The parking area to be raised and expanded will be retained on its east side by a proposed masonry retaining that will have a maximum exposure of 2 feet above grade, screened with plantings.
