Re: Proposed Amended Site Plan for Fox Lane Residences
SCTM#1000-12-1-1.2 Zoning District: AHD
This proposed Site Plan is for the construction of four(4) tenant-occupied affordable housing
units in three (3) structures: two, one bedroom units at±560 sq. ft. and one ±880 sq. ft. structure
including a ±534 sq. ft. single bedroom unit and ±346 sq. ft. studio on 0.75 acres in the AHD
Zoning District, Fishers Island.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, the proposed action is recommended as CONSISTENT with the
LWRP provided the following is considered:
Policy 2.2. Protect and preserve archaeological resources
The parcel is included within the archeo-sensitive mapped area (MAPINFO GIS-Archeo-
sensitive layer). The site is previously disturbed and a cultural resources survey is not
recommended.
Flood Zones
The proposed structures are located in FEMA flood zones AE el 11 and 12. Structures have
been designed to meet floodplain regulations with first floor elevations proposed at 14' furthering
Policy 4 Minimize loss of life, structures, and natural resources from flooding and erosion.
Groundwater Quality
The following is recommended to further policies 5. Protect and improve water quality and
supply in the Town of Southold and 6. Protect and restore the quality and function of the Town
of Southold ecosystem:
Fishers Island water supply is dependent upon a sole source aquifer and 22 miles of water
mains, an equalization reservoir, a surface water treatment plant, a groundwater treatment
facility, a well field and three surface water reservoirs: Barlow Pond, Middle Farm Pond and
Treasure Pond. The numerous ponds on Fishers Island serve as the primary catchment and
recharge areas for the islands aquifer. The hydrology of Fishers Island differs substantially
from other portions of the Town of Southold. Due to its hilly topography, most of the
precipitation that falls on Fishers Island flows to one of the numerous freshwater ponds or
directly to the coastal shoreline. According to the Hydrogeologic Report Conducted on Fishers
Island, New York (Groundwater, Inc., April 1990), groundwater recharge on Fishers Island is
estimated to be approximately 709 million gallons per year.
The water supply, treatment, distribution and storage facilities for Fishers Island are owned and
operated by the Fishers Island Waterworks, a subsidiary of the Fishers Island Development
Corporation (FIDCO). The FIDCO water supply system, originally constructed in the early
1900's, services approximately 624 customers.
The parcel is proposed to be hooked up to the existing Fishers Island Sewer system. The
existing disposal system was designed for a summer average flow of 20,000 gpd and a winter
average flow of 7,500 gpd with a peak hour estimated flow of 80,000 gpd ("Operations and
Maintenance Manual for the Fishers Island Wastewater Facilities" prepared by A.R. Lombardi,
Inc. in September 1986 and on a major upgrade in 2008).
The proposed action would add an additional XXXXX gallons per day (gpd). Disposal is
proposed via the Fishers Island Sewer District. Effluent will be treated to regulatory levels.
To further lessen impact on ground water quality or quantity the following best management
practices should be required to be filed within a Covenant and Restriction:
a. Require the use of native, drought-tolerant plants in landscaping.
b. Require only the use of organic fertilizers where the water-soluble nitrogen is no more than
20% of the total nitrogen in the mixture.
c. Require a maximum of 1 lb. of nitrogen per 1000 square feet in any one application, with a
cumulative application of no more than 2 lbs. per 1,000 square feet per year.
d. Prohibit the application of fertilizer products containing nitrogen, phosphorus, or potassium
between November 1 st and April 1 st.
e. The use of phosphorous containing lawn fertilizer is prohibited unless establishing a new
lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have
three bold numbers. The number in the middle is the percentage of phosphorus in the product,
e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a
.number higher than 0.67 may only be used if a new lawn is being established or a soil test
indicates it is necessary
Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.
