HomeMy WebLinkAboutTB-04/18/1961-S WAIVER OF NOTICE ,OF TOWN BOARD MEETING WE, the undersigned, being members of the Town Board of the Town of Southold, Suffolk C ounty, New York, do hereby severally waive notice of the time, place and purpose of the meeting of the Town Board to' be held at Greenport, in the Town of Southold, New York,' on Tuesday, April ,18, 1961, and do hereby consent that the same be held on said date for the transaction of any , business which may properly come before said meeting. Southold Town Board was held at. the Super- visor ' s Office, 16. South Street, Greenport, N.Y. on Tuesday, April 18, 1961, the members of the Board having waived notice . of the time, paace and. purpose of .the. meeting. The meeting was called to order by the Supervisor at 1 P.M_with the following present:.. Supervisor' Albert- son; Councilmen Demarest and Grathwohl; Justice Clark. Moved by Councilman. Grathwohl; seconded.by Justice Clark: WHEREAS, a petition was received from Frederick C. Burnhardt, 20.. Staten Plaza, Great Neck, N.Y. requesting a change of zone of certain property situated in Cutchogue, N.Y. and more fully described in said petition from. "A" Residential and Agricultural District to ."M" Multiple Residence District, NOW, THEREFORE, BE IT RESOLVED: That the Town Clerk of- the town''of Southold be and he is hereby, directed to transmit this petition to . the Planning Board in accordance .w.ith Section 901, Subdivision C of. Article IX of the Building Zone Ordinance of the .Town. of Southold. Vote of- Town Board: Ayes-Supervisor Albertson; Councilman Demarest and. Grathwohl; Justice Clark. . Moved by Councilman Demarest; seconded by. Councilman Grathwohl; RESOLVED: That the application of Ben and Millicent R. Jacobsen for change of zone has been withdrawn and that the fee of $25 .00 be return-- .ed to Ben and, Millicent Jacobsen. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest . and Grathwghl,; Justice Clark. . ... . Moved by Councilman Grathwohl ; seconded by Councilman Demarest:. WHEREAS, Franklin Saunders has applied to the Town Board for a- single Trailer permit. dated April 10, 1961, . NOW,. THEREFORE, BE. IT.RESOLVED:..That the application of Franklin Saunders to locate a single trailer on the .property of .E. E • Johnson, Coy¢' s Lane, Cutchogue,,. N.Y. be and hereby is-granted for year round occupancy fora two-year period. Vote of Town Board: Ayes-Supervisor Alberteon; 'Councilmen Demarest and Grathwohl; Justice Clark. Moved by. Councilman Demarest; seconded by Councilman Grathwohl WHEREAS, Southold -Town Planning Board has prepared an official report and recommendation upon the-.petition of Frederick C. Burnhardt for a change of zone from "A" Residential and AGricultural District to "M" Multiple Residence District on Certain property at Duck Pond, Cutchogue, A N.Y. , now, therefore, be, it RESOLVED: That apublic hearing will be held by the Southold .Town 'Board at the office of the Supervisor, 16 South Street, Greenport, N.Y. on Wednesday, May 3, 1961, at 7: 30 P.M_. on the following proposed amend- ment to the .Building Zone Ordinance of the Town of Southold, including the Building Zone Maps, to wit: BEGINNING at a point on the easterly line of Duck Pond Road, said point of beginning being 280 feet more or less southerly from the highwater mark of Long Island Sound, from said point of beginnigg running thence North 20 degrees 54 minutes 10 seconds West 280.0 feet, more or less, - to said ordinary highwater mark of Long island Sound; thence along said highwater' mark of. Long Island Sound North 56 degrees 15 minutes 50 seconds East 300.0 feet, more or less, to land now or formerly of McBride; thence along said land of McBride South 33 degrees 44 minutes 10 seconds .East 273 .01 feet, more or less, to a point; thence along said. land of' McBride ,South 56 degrees 15 minutes 50 seconds West 362.19 feet, more or less, to said .easterly line of Duck Pond, Road and the point, or place of beginning. BE IT FURTHER RESO1tad;, That .the Town Clerk be andhe hereby is author- ized and directed to cause a notice of said hearing to be published in the Suffolk Times, Greenport,' N.Y pursuant to the requirements 'of law. . Kalin and Lloyd C:. .'.Kalin heretofore filed a petition with the Town Board. dated the llth day of April, 1961, xC �xxktxaYa xQdtxkxa requesting the Town Board to change the' zone of the -premises described in said petition from "A" Residential and Agricultural District to "B" Business District, and WHEREAS, the: Town Board byresolution duly adopted on the 18th day of April, 1961, referred the petition to the Southold. Town Planning Board with a written. request instructing the Planning Board to prepare an official report on said matter in compliance with .Section 901 of the Building Zone Ordinance of the Town of Southold, and WHEREAS, the said Planning Board has filed its official report with' the Town Board dated the 18th. day of April, 1961, wherein the Planning Board recommends that the premises of Albert Herzog, Jr . lying west .of the Kalin property be included in the "B" Business District,. -and WHEREAS, thbC~Town Board is of the opinion that it would be intthe public interest to change the zpne of the premises of Herbert L Kalin and Lloyd C'. Kalin as well as the said premises of Albert Herz", Jr.. to "B" Business District, n NOW, - THEREFORE, BE IT RESOLVED: That the Town Board on its own motion amend the Building Zone Ordinance of the Town of Southold including the building zone maps as follows: By changing from "A" Residential and Agricultural District to "B" Business District the following described property: ALL THAT certain tract or parcel of land situated at Greenport,, in the Town of Southold, Suffolk County, New York, and more particularly bound- ed and described as follows: BEGINNING at a point formed by the intersectionoof the easterly line of Moore ' s Lane with the northerly line of Front _Street (State Route 25) and running thence North 2 degrees 42 minutes '40 ,seconds east, , 300..33 feet to the southwesterly corner of land of the Village of Greenport; thence North 89 degrees 41 minutes 30 seconds east, 302.39 feet to the southeasterly corner of land of the Village of Greenport; thence along the westerly line of land now or formerly of Sledjeski; South._ 2 .degrees 05 minutes 00 seconds west, 103 .60 feet to a point'" thence along the westerly line of Herzog; south 0 degrees 49 minutes 40 seconds west, 195 .72 feet- tot.the northerly side of Front Street; thence along said northerly line of Front Street South 89 degrees. 3'3 minutes 30 seconds West 310 feet to the point or place of beginning. - BE IT FURTHER RESOLVED: that the Town Clerk be and he hereby is directed to transmit a copy of this resolution to the Planning Board together with .a written request instructing the Planning Board to prepare an. official report thereon to the provisions of Article IX, Section 901, of the Building Zone Ordinance of the Town of Southold. Moved by Justice Clark; seconded by Councilman Demarest: WHEREAS, Southold Town Planning Board has prepared an official report and recommendation on a proposal of .the Town Board upon its own motion to change from "A" Residential and Agricultural District to "B" Business District on certain property on Main Road, Greenport, New York, described as follows:- ALL That certain tract or- parcel of land situated at Greenport, in the Town of Southold, Suffolk County, New York, and more particularly bounded and described as follows: BEGINNING at a point formed by the intersection of the easterly line of Moore' s Lane with the northerly line of Front Street (State Aoute . 25) amd running thence North 2 degrees 42 minutes 40 seconds east, 300.33 feet to the southwesterly corner of land of the Villa ge ,o:,,[,..Greenport, thence North 89 degrees 41 minutes 30 seconds east, 302.39, feet to the southeasterly corner of land of the Village of Greenport_; thence along the westerly line of land now or formerly of Sledjeski, South 2 degrees 05 minutes 00 seconds west, 103 .60 feet to a point; thence along the westerly line of Herzog,-, south 0 degrees 49 minutes 40 seconds west, 195 .72 feet to the northerly side of Front. Street, Greenport, New York, on Wednesday, May 3, 196.1, at 7: 30 PM on the above described proposed amendment to the Building :Zone Ordin- ance of the Town of Southold including the Building Zone. maps, and BE IT FURTHER' RESOLVED: That the Town Clerk be,:-and he hereby is authorized and directed to 'cause a notice of said hearing to be pub- lished in the.
