Bradley and Irene Bradley PROPERTY LOCATION: 1450 East Mill Road, Mattituck,NY SCTM No. 1000-107-1-2.4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without furti8r steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under t1he Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject parcel is a rectangular non-conforming 30,000 square foot property in the R-80 Zoning District on East Mill Road in Mattituck and is lot numberA on the map of Mattituck Creek Estates filed with Suffolk County March 25, 1992. The property line has 150.00 feet fronting East Mill Road, then runs south 200.00 feet along the easterly property line of an adjacent residential parcel, then runs 150.00 feet west,then runs 200.00 feet north back to East Mill Road. The property is developed with a one-story frame dwelling with attached garage, gravel drive way, a rear wood deck, a front wood stoop, a 12.1 foot by 7.8-foot frame shed in the rear yard, and a 7.0 foot by 7.0-foot plastic moveable shed in the side yard, as shown on the survey prepared by Donald G. Dekenipp,L.S,Professional Land Surveyor; last updated March 8, 2025. BASIS OF APPLICATION: Request for Variances from Article 111, Section 280-13A(6)(d)and 280-13A(6)(i)and the Building Inspector's August 27, 2025 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling to include a second story accessory apartrrrent; at: 1) apartment will exceed more the code permitted maximum 25% of the habitable space of the entire residence; 2) foundation expansion will exceed more than the code permitted 25%of the living space of the existing dwelling unit; located at: 1450 East Mill Road, Mattituck,NY. SCTM No. 1000-107-1-2.4. RELIEF REQUESTED: The applicant r quests variances to construct a two-story addition on the right(west) side of the existing dwelling to expand the first floor living space, create a one-car garage, and establish a second-floor accessory apartment.The proposed accessory apartment will be 565 square feet where the code-permitted maximum of 25%of the habitable space of the residence is 243 square feet and the foundation expansion to will be 732 square feet where the code-pennitted foundation maximum,expansion to establish an-accessory apartment is 25% of the existing foundation or 344 square feet, as shover, on the architectural plans titled "Bradley Addition" pages SD-El, SD-E2, and SO-.l through SD-5, prepared by Anthony Portillo, R.A., of AMP Architecture, dated July 21,2025. Page 2, December 18, 2025 #8063 John G. Bradley and Irene Bradley SCTM No. 1000-107-1-2.4 ADDITIONAL INFORMATION: The applicant provided a statement indicating that she has received a Plus One Accessory Dwelling Unit (ADU) grant from the New York State Office of Homes and Community Renewal. The grant enables her to afford the addition of the apartment, which will be occupied by her adult son in the near term. The grant set a deadline of March 20, 2026 for the grantee to receive a building permit. She noted that building the project in two phases, first doing a one-story addition followed by adding a second-story accessory apartment, would avoid the need for any variances,but would not meet the grant's March 20, 2026 deadline. As noted on page SD-1 of the architectural plans,the property has the benefit of Suffolk County Health Department approval R10-95-0071. Testimony in the public hearing indicated that this approval allows the addition of one bedroom without any changes to the existing Suffolk County-approved septic system. Two neighbors submitted letters indicating they had no objections to the proposed addition. The existing dwelling is covered by three Certificates of Occupancy: No.35406 dated January 23,2012 pursuant to Building Permit No.36087 dated December 10,2010 for roof mounted solar panels; No. Z-34157 dated January 8; 2010 pursuant to Building Permit No. 35071-Z dated October 14, 2009 for a deck addition to an existing single family dwelling; No.Z-24270 dated April 8, 1996 pursuant to Building Permit No.23147-Z dated November 30, 1995 fora one family dwelling with attached garage. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 4,2025 at which time written and oral evidence were presented. Based upon all testimony,documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel is one of just four residential parcels on this section of East Mill Road. There is a one-story dwelling on the parcel to the east and two-story dwellings on the parcels to the west. The addition of a partial second story to the subject dwelling will be in keeping with the neighborhood and will have no visible impact to the character of this area. Additionally,the four residential parcels back up to agricultural land and lie across East Mill Road from agricultural land, and East Mill Road ends at the Mattituck Inlet a short distance to the west, so that through-traffic is limited. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. As the applicant noted, if not for the deadline imposed by the Plus One ADU grant,the project could be executed in two phases, with the first phase expanding the first-floor foundation without the need for a variance and the second phase adding the second-floor apartment, also without need for a variance. The deadline for the grant,combined with the Code-imposed limits on the allowable living area expansion and foundation expansion to support an accessory apartment,render this approach infeasible. 3. Town Law§267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 132.5% relief from the code for the habitable space increase and 112.8% relief for the foundation area increase. However, practically speaking the variances are largely administrative in nature since the same foundation expansion and creation of an accessory apartment could be achieved without variances if executed over a longer time frame,but for the deadline imposed by the Plus One ADU grant. Further,the creation of a legal accessory apartment is a desirable outcome for the Town given the current lack of affordable/attainable year-round rental housing. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The need for variance relief in this case is mainly driven by the deadline for acquiring a Building Permit imposed by the Plus One ADU grant the applicant successfully applied for. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a first-floor addition and to utilize NYS-provided grant funds to establish a second- floor accessory apartment while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Steinbugler, seconded by Member Acampora, and duly carried,to GRANT the variances as applied for,and shown on the architectural plans titled"Bradley Addition"pages SD-E1, SD-E2, and SD-1 through SD-5,prepared by Anthony Portillo,R.A.,of AMP Architecture,dated July 21,2025. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must comply with the terms and conditions of the NYS Plus One ADU grant. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the decree of nonconformity, Provided de minimis relief is requested within one year of the date of this decision. Any time after one year, the Board may require a new application. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. I am a recipient of the Plus One ADU grant from the New York State office of Homes and Community Renewal, administered by the Long Island Housing Partnership'for Southold Town residents. The grant has a deadline of March 20, 2026 at which time I must have a building permit for the apartment in order to remain eligible. The State initially earmarked two million dollars for Southold Town. That figure has been reduced to one million. Eleven homeowners received the grant and three have dropped out. Of the remaining eight, only three have received or are on target to receive the funds. Without the grant, I would not be able to afford this construction and the many thousands of dollars I have already spent for architect and surveyor services will have been lost. I grew up in Mattituck and am thankful that my children grew up here. I would very much like my future grandchildren to grow up in Mattituck. But as you know, the cost of purchasing or even renting on the North Fork is out of reach for many young people who grew up here. The proposed apartment will serve as a home for my adult son who is currently working on his PhD. Once my son is able to purchase his own home, the apartment will provide a comfortable, affordable home for another North Fork young person or perhaps a senior looking to downsize. The apartment will also generate income that will allow me, as a retired widow,to stay in my home. The subject variance is required because the square footage of the apartment would exceed the 25% allowable by code. Once the project is complete,the apartment square footage will be within the allowable 25%. An option discussed with my architect was a two-phase application. Phase one would have been construction of the addition without the apartment and phase two would have been application for and construction of the apartment. In this scenario, no variance would be required. I would have preferred the two-phase plan, but because of the March.20 deadline, that would not be possible. As you can see, my choices are limited at best. I am trying to do a good thing for the Town- constructing affordable housing at my (and the State's) expense. The completed project will be in keeping with the architectural character of the Town. And the use will be in keeping with Southold's goal of providing affordable housing.
