MEETING OF JANUARY 22, 2026 ZBA FILE: #8072 NAME OF APPLICANT: Rebekah Schulz PROPERTY LOCATION: 185 Riley Avenue, Mattituck,NY SCTM# 1000-143-4-29 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION:) The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 15,350 sq. ft.non-conforming parcel located in an R-40 Zoning District. The property sits on a corner of Bay& Riley Avenues in Mattituck. The property has a road frontage of 61.4 feet along Bay Avenue,then turns northeast for 250.00 feet before turning northwest for 61.4 feet to Riley Avenue. It then turns southwest for 250.00 feet along Riley Avenue and goes back to Bay Avenue. The property is improved with two existing one-story dwellings and existing accessory garage located in the rear yard as shown on Survey prepared by Michael J. Scalice, LS, last revised September 25, 2025. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's September 22, 2025 Notice of Disapproval based on an application for a permit to construct an addition to a single family dwelling: 1) less than the code required minimum front yard setback of 35 feet; located at: 185 Riley Avenue,NY. SCTM No. 1000443-4-29. RELIEF REQUESTED: The applicant requests a variance to construct an addition to a single-family dwelling having a proposed front yard setback of 11 feet where a minimum setback of 35 feet is required. ADDITIONAL INFORMATION: During the public hearing the applicant's agent gave testimony that the proposed addition was to be placed behind the existing front yard setback of 4.1 feet to keep in line with an existing line of the house. It was stated that the addition was placed in its proposed location due to the fact it was the best place for the addition with the existing layout of the house. Y Page 2,January 22,2026 #8072,Schulz SCTM No. 1000-143-4-29 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 8,2026, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Riley Avenue neighborhood consists of parcels of varying sizes and is developed with a mix of one- and two-story residential structures.The proposed addition will be located behind the existing front-yard setback, thereby improving conformity with the zoning code when compared to the existing 4.1-foot front-yard setback.Additionally,the addition is appropriately scaled and designed to be consistent with the existing one-story residence. As such,the proposed improvement will maintain the established character of the neighborhood and will not adversely impact surrounding properties. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Due to the property being a corner lot, there are two front yards, and both existing residences have been built with non-conforming front yard setbacks. Any addition to the residence will be subject to variance relief. The proposed relief sought will be less than the existing front yard setback thereby bringing it more into conformity with the code. 3. Town Law U67-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 69%relief from the code. However,the proposed addition is at a less nonconforming setback than the existing setback of the house. This will mitigate any adverse effects on the surrounding neighborhood. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with,Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition to an existing residence while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD:In considering all of the above factors and applying the balancing test under New York Town Law 267-B,motion was offered by Member Lehnert,seconded by Member Acampora,and duly carried, to GRANT the variance as applied for and shown on Site Plan and Architectural Plans (Sheets SD-1 thru SD-4) prepared by Anthony Portillo,Architect,dated October 1,2025. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variances)grantedherein as shown on the architectural drawings,siteplan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformides under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. TIME LMTS ON THIS APPROVAL: Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. PROPERTY FACTS/DESCRIPTION• The applicants' 10,875 square foot parcel is improved with a single- family, one-story dwelling, as shown on the June 5, 1991 survey prepared by Peconic Surveyors, P.C. BASIS OF APPLICATION: Request for Variances under Section 100-244 (280A 24), based on the Building Inspector's August 22, 2006 Amended Notice of Disapproval concerning a proposed garage addition, a second-floor addition with a setback at less than the code-required minimum of 10 feet on one side and 15 feet on the other side, resulting in a required combined side yard total at 25 feet, and proposed porch addition at less than 35 feet from the front lot line and swimming pool, which calculated a lot coverage in excess of the code limitation for a 20%maximum. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 28, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct additions and alterations to an existing one story dwelling by adding a second-story to the existing dwelling, adding a new deck at the rear of the home, adding a covered porch at the front of the dwelling,adding an open deck and garage additions. The variances requested are: (a) lot coverage increased when a swimming pool is proposed in the rear yard for 21.29% lot coverage total with all new construction; (b) a new porch addition will reduce the front yard to 33.18 feet at its closest point; (c) the side yard setbacks for the principal building with new garage and second-story will be 10.73 feet on the north side and 10.43 feet on the south side; (d)the total side yards will be 21.16 feet instead of the code required 25 feet. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1, Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicants are in need of more living and storage space, and the property is only 10, 875 square feet. The property is less than 11,000 square feet in size and has a width of 75 feet, and the dwelling is only 1128 square feet in size for living and storage area. 3. The variances granted herein are substantial. 4. The difficulty has not been self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and a swimming pool, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
