SUFFOLK COUNTY ADMINISTRATIVE CODE: County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief,permit,or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 32,146.88 square foot parcel located in the Residential R-80 Zoning District. The northerly property line measures 161.98 feet and is adjacent to Albertson Lane,the easterly property line measures 215.83 feet, the southerly property line measures 130.80 feet and the westerly property line measures 225.46 feet. The property is improved with a two and one-half story dwelling(varying roof heights) with a roofed front porch,a wood deck with steps at the rear of the dwelling,a large,fenced garden to the east of the dwelling, a'36 ft.by 14 ft.in-ground swimming pool south of the dwelling and wood deck and a 16.2 ft.by 20.2 framed accessory building located east of the in-ground swimming pool as shown on the survey map prepared by Ralph Heil. LS, and last revised October 2, 2023. BASIS OF APPLICATION: Request for Variance from Article III, Sections 280-15 and the Building Inspector's October 2, 2025 Notice of Disapproval based on an application for a permit,to legalize an "as built" accessory pool house at: 1) less than the code required minimum side yard setback of 10 feet; located at: 1955 Albertson Lane, Greenport,NY. SCTM No. 1000-52-5-56. RELIEF REQUESTED: The applicant requests a variance to legalize an"as built"pool house,accessory to an existing single-family dwelling. The 327 square foot pool house,on this 32,146.88 square foot parcel located in the Residential R-80 Zoning District, is not permitted pursuant to Article III, Section 280-15, which states accessory buildings and structures on lots between 20,000 and 39,999 square feet shall maintain minimum rear and side yard setbacks of 10 feet. The pool house has a side yard setback of 8.9 feet. ADDITIONAL INFORMATION: There is a November 24, 1992 Certificate of Occupancy issued by the Town of Southold for an "Accessory Storage Shed" and although the old survey that had accompanied this Certificate of Occupancy does not show the setback dimensions, it does show that the shed was very close to the east side of the V Page 2,January 22,2026 #8070,Touhey SCTM No. 1000-52-5-56 property line. A preexisting Certificate of Occupancy, issued September 17, 2003, did not mention the accessory structure but a rudimentary survey shows a rectangular garage along the east property line. A Certificate of Occupancy issued July 15, 2023 does not list this accessory structure but the Site Plan that accompanied the application for that Certificate of Occupancy includes dimensions to the east property line from the accessory structure of 8.3 feet and 8.5 feet. The representative for the applicant stated that the information shows that the accessory structure has been in that location for more than thirty years and has not resulted in any detriment to the neighboring property. The property is well landscaped and maintained affording the adjacent neighbors privacy. A Site Plan drawing of the accessory structure, prepared by Louis Schwartz, LPE, and dated July 15, 2025, was submitted. Due to discrepancies with prior Certificates of Occupancy and surveys,the contractor assumed that the prior accessory structure(garage)was properly located. During the January 8,2026 public hearing,the Board closed the hearing subject to receipt of additional information to include a letter that was read during the hearing and clarification of possible permits granted. On January 13,2026,the applicant's representative provided the following: 1) the above subject letter; 2) a copy of the 1992 Certificate of Occupancy#Z-21180 for an accessory shed;3)a map of the property on the letterhead of Otto W.Van Tuyl,Licensed Engineer and Surveyor, dated September 30, 1948, indicating a garage in the same location as the as-built pool house and indicating a 5 foot distance to the easterly property line;4)an excerpt of a survey of the property signed by Roderick Van Tuyl, Licensed Land Surveyor, survey performed during the 1970s (the year is clipped off), dated as"Received" October 6, 1992, showing a garage in the same location as the as-built pool house. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 8,2026 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. It appears that this accessory structure has existed for many years. It was originally noted as a garage. The property is well screened to neighbors on both the east and west sides giving the neighbors privacy to the applicant's property. Pool houses are not uncommon to the community and there are many accessory structures throughout the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The accessory structure is existing,the only thing changing is the use of the structure. The applicant wishes to use the structure as a pool house since it is located to the east of the in- ground swimming pool. To move the structure would cause a financial burden to the applicant. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 11% relief from the code. However,the existing accessory structure poses no adverse effects to the environment or the community. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law U67-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. f J . Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pool house while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New i York Town Law 267-13,motion was offered by Member Acampora,seconded by Member Steinbugler,and duly carried, to GRANT the variance as applied for, and shown on the survey map prepared by Ralph Heil, LS, last revised October 2, 2023 and Architectural Drawings prepared by Louis Schwartz,LPE, and dated July 15,2025. SUBJECT TO THE FOLLOWING CONDITIONS: I. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s) within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 2. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s)and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 3. The "as built" improvement(s)may not be used until a Certificate of Occupancy has been obtained. 4. The subject pool house shall conform to all of the design requirements listed under Cabana/Pool House in Chapter 280-4 Definitions of the Southold Town Zoning Code as follows: LaJA cabana/pool house or any portion of an accessory structure dedicated to such use shall not exceed 350 square feet of gross floor area. J!))_A cabana/pool house shall not contain more than one room other than a bathroom. aA cabana/pool house shall not be heated,nor shall any pool house/cabana contain a kitchen or be designed, equipped or used for cooking or sleeping purposes. A refrigerator no greater than five cubic feet in capacity is permitted. f!LInterior plumbing fixtures shall be limited to a sink plus one bathroom containing a toilet and sink. (e) Cabana/pool houses shall not contain indoor showers. Outdoor showers are permitted. faAll plumbing fixtures shall drain to a Suffolk County Health Department approved sanitary system in conforming location. Jg)_A building permit for a cabana/pool house shall not be issued unless:there is an existing inground pool with a valid certificate of occupancy; a building permit,that is still valid,has previously been issued for an inground pool,or the building permit f6r the cabana/pool house is being issued simultaneously with the issuance of a building permit for an inground pool.No certificate of occupancy for a cabana/pool house shall be issued unless there is an existing inground pool with a certificate of occupancy or.a certificate of occupancy for an inground pool is being issued at the same time as a certificate of occupancy for a cabana/pool house. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity,provided de minimis relief is requested within one year of the date of this decision Any time after one year, the Board may require a new application. Background and Survey History When I purchased the property,the original survey prepared by Aerial Land Surveying(job No.21-851,dated May 13 2021)was filed with the Town and attached to the deed.This version was the official record used by both myself and the Building Department to determine setback compliance for the shed. Fully Permitted Shed Relocation The shed relocation was fully permitted by the Town of Southold and performed by a licensed local specialist experienced in moving historic structures.The operation was conducted safely and in good faith based on the 2021 survey attached to the deed and the T ! Aerial Land Surveying has since acknowledged that the original survey contained measurement errors,which are the sole source of the setback discrepancy.The firm has confirmed that it stands by the most recent survey,and it will not re-survey the property. The resulting error is not the fault of either the contractor or the property owner,but rather an unusual and previously unknown series of survey issues that came to light only after the permitted relocation had been completed. 3. Hardship and Preservation Context Moving the 100-year-old shed approximately 24 inches away from the property line was a significant and costly undertaking performed in full compliance with Town permits and inspections.Relocating it again based on a later survey revision would now be cost- prohibitive and could cause damage to the restored structure.
