SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not required to be referred to the Suffolk County Department of Planning under the Suffolk County Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 16,624 sq. ft. non-conforming parcel located in the A-C Zoning District. The property is an L-shape with 137.41 feet of road frontage along NYS Route 25, it then heads southeast for 68.35 feet before turning southwest for 58.6 feet,then turns southeast again for 110.4 feet to the rear property line. The rear property line heads southwest for 55.51 feet then returns 168.9 feet back to NYS Route 25. The property is improved with an existing two-story residence with a deck to the rear of the house. There is an accessory garage in the rear yard,and also a shed in the southeast corner of the rear yard. Two small playhouses will be removed. All as shown on survey prepared by John C.Ehlers,LS, dated January 13, 2023. BASIS OF APPLICATION: Request fora Variance from Article I11, Section 280-15; and the Building Inspector's July 1, 2025, Notice of Disapproval based on an application for a permit to demolish an existing accessory garage and to construct a new accessory garage; at: 1) located in an area other than the code required rear yard; located at: 46660 NYS Route 25, Southold,NY. SCTM No. 1000-75-3-4. RELIEF REOUESTED: The applicant requests a variance to demolish an existing accessory garage,and to construct a new accessory garage in the side yard where a rear yard location is required. ADDITIONAL INFORMATION: At the public hearing the owner gave testimony as to the proposed location of the accessory garage. It was stated that it was proposed in a front yard location for ease of access to the existing house, and the desire to have less impervious driveway. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 8, 2026 at which time written and oral evidence were presented. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This proposed large accessory garage is close to Main Road / NYS Route 25. .There are accessory buildings nearby,but these buildings are used for agriculture, and they are not newly constructed. No accessory garages in front yards are found on Main Road/NYS Route 25 from Cutchogue to the east to Albertson's Lane to the west. Where accessory structures have been previously allowed in front yards, those structures have been more modestly sized and located on parcels more severely constrained than the subject parcel. The subject parcel has more than enough space for the construction of an accessory garage in the rear yard, where the current accessory garage is located. This rear yard location is allowable under the zoning code and can be achieved without the need for variance relief. Allowing a large accessory structure in the front yard will, by, precedent,produce an undesirable change in the character of the neighborhood. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for ;the applicant to pursue, other than an area variance. This is a substantially sized parcel with an accessory garage already located in a conforming rear yard location. A new accessory garage can be located in the same rear yard location as the existing and be conforming to the zoning code. 3. Town Law 4267-b(3)(b)(3). The variance herein is mathematically substantial, representing 100% relief from the Town Code. 4. Town Law 4267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Based upon personal inspection of the subject property and the surrounding neighborhood by Members of the Board of Appeals, and the architectural drawings submitted, the proposed new accessory garage will have a significant visual impact on NYS Route 25 (Main Road)that is not in keeping with the character of residential properties along this heavily trafficked street. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect, -and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law 4267-b. Grant of the requested relief is not the minimum action necessary and adequate to enable the applicant the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
