RODRIGUEZ W WW.DOS.NY.GOV SECRETARY OF STATE ----------------------------------------------------- " • ,..i R ;4 In the Matter of the Petition of: i :;.at,` M,�.,;,.r3r;s DECISION BRIAN CLARK For a Variance to the New York State Uniform Fire Prevention &Building Code PETITION NO. 2024-0103 ------------------------------------------------- Upon the application of BRIAN CLARK,filed pursuant to 19 NYCRR 1205 on February 26, 2024, and upon all other papers in this matter,the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to alterations to an existing one-family dwelling, 2 stories in height, 2400 in gross square feet, and located at 2540 Bridge Lane, Town of Southold, County of Suffolk, State of New York. Relief is requested from: 19 NYCRR Part 1220, 2020 Residential Code of New York State, Section AJ601.3, Compliance, Exception 1, provided as follows: Space created in basements may,have a ceiling that projects to within 6 feet, 8 inches of the finished floor; and beams, girders and ducts in such space or other obstructions may project to within 6 feet,4 inches of the finished floor. [The petitioner requests relief for spaces in a basement with ceiling heights less than allowed.] FINDINGS OF FACT 1. The petition refers to the construction of habitable and non-habitable space in the basement of the subject building. 2. The finished basement height is slightly below 6'4"in a small potion of the basement?due to the border that runs the length of the house. 3. The basement headroom exceeds the average height of adult persons according to anthropometric data found in the current NFPA 101 life safety code. 4. The basement floor is of concrete construction and the first floor is constructed with conventional wood floor joists. It would be physically impracticable and an unreasonable economic burden to raise the STA" K, Department OPPOR STATE OF TUNITY of State Petition No 2024-0103 Page 2 floor above or lower the slab below. 5. The subject space is in a dwelling unit used by individuals who are accustomed to their surroundings, the reductions to the height of the ceiling would not have a substantial negative effect on their health or life safety and are considered de minimis. 6. The interior pictures showed a stairway leading from the basement to the 1st floor landing. 7. The building plan showed proposed Emergency Escape and Rescue Opening. 8. The local code enforcement official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 1205.6. CONCLUSION OF LAW The proposed variance will not substantially adversely affect the Code's provisions for health, safety, and security. Strict compliance with the provisions of the Uniform Fire Prevention-and Building Code would entail practical difficulties, economic hardship, or would otherwise be unwarranted because such would be unnecessary considering alternatives which, without a loss in the level of safety, achieve the intended purpose of the code. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220, Section AJ601.3, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the reduced headroom projections shall be marked or treated by painting a contrasting coloring in such a way as to call attention to the reduction. : 2. That smoke and carbon monoxide detecting alarm devices shall be located within the basement, including in each major ceiling compartment,and interconnected to additional alarms in the dwelling above. 3. That an interconnected rate of rise heat detector shall be installed in the boiler or furnace room. 4. That an Emergency Escape and Rescue Opening should be maintained as required in Part R310. 5. That there would be no cooking or sleeping in the basement space. 6. That in all respects,the applicable requirements of the Uniform Code shall be satisfied. Unless objected to by the petitioner in a writing received by the department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
