Subject: Request for extension for Certificate of Occupancy,ZBA#7626(Condition#7)
Dear Ms.Weisman:
We request a further extension of the June 16th deadline for ZBA#7626 Condition 7,which requires a
Certificate of Occupancy("CO")once the septic system passes final Health Department inspection.
Since our last extension:
• In October 2024,we applied to National Grid to relocate the gas line—a winter-season backlog
delayed completion until March 2025.
• Our contractor then installed the new septic system on May 16,2025.
• The Health Department's final inspection is scheduled for June 5,2025.
If the Health Department approves on June 5,it typically takes several business days to issue its report.
Once received, the Building Department needs additional business days to review and process the
paperwork before issuing a CO.With fewer than ten business days between inspection and our June
16th deadline,any unforeseen delay—such as a follow-up request from the Health Department or a
processing backlog at the Building Department—could push CO issuance past the compliance window.
Granting this extension will ensure we have time to:
1. Receive and address any final Health Department comments;
2. Submit the complete inspection report and related documents to the Building Department; and
3. Allow sufficient business days for the Building Department to process and issue the CO.
We appreciate your understanding of these timing constraints

Subject: Request for extension for Building Permit,ZBA#7626
Dear Ms.Weisman:
This letter is a request for an extension of Condition 6 of our determination letter, dated June 23'd 2022,
which requires us to obtain a building permit for the"as built' improvements located at 910 Fleetwood
Road,Cutchogue,NY(STCM 1000-137-4-22)within 90 days.
Application has been made to the Building Department for a building permit, but before a building
permit can be issued,we must first meet Condition 1,which will require us to install an approved
upgraded septic system. We hired a surveyor on July 20,2022 to initiate the process to fulfill Suffolk's
County Department of Health Services design and permitting requirements. However,it has taken much
longer than expected for the surveyor to complete the design. Once a design is completed, applications
will also need to be made to the Board of Trustee and the DEC for approval. We understand it may take
several more months to acquire the proper permitting before the Building Department can issue a
building permit.
Please accept our request for extension and if there are any questions, please let us know.

Dear Mr.Maye;
We received your letter of December 5,2024 requesting another extension to comply with the Zoning
Board of Appeal's Condition#7 relating to"As Built"improvements to existing seasonal cottages as
described in the June 23,2022 decision which reads as follows:
The applicant must obtain a Certificate of Occupancy/Pre-CO from the Building Department for the "as built"
improvement(s) and submit same to the Office of the Zoning Board of Appeals within one (1) year of this
decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why
the applicant was unable to obtain a Certificate of Occupancy in the time allotted.
In your letter you explain that a Certificate of Occupancy cannot issue until the relocation of the water
line and gas line have been facilitated, and you receive final approvals from the Suffolk County
Department of Health for a proposed upgraded sanitary system.
The Zoning Board of Appeals has granted your request for an extension of Condition#7,to expire on
June 16,2025.
Please feel free to contact our office,if you have any further questions or concerns.

Attn: Leslie Weismann
Subject: Request for extension for Certificate of Occupancy,ZBA#7626(Condition#7)
Dear Ms.Weisman:
We request a further extension of the June 16th deadline for ZBA#7626 Condition 7,which requires a
Certificate of Occupancy("CO")once the septic system passes final Health Department inspection.
Since our last extension:
In October 2024,we applied to National Grid to relocate the gas line—a winter-season backlog
delayed completion until March 2025.
Our contractor then installed the new septic system on May 16,2025.
The Health Department's final inspection is scheduled for June 5,2025.
If the Health Department approves on June 5,it typically takes several business days to issue its report.
Once received, the Building Department needs additional business days to review and process the
paperwork before issuing a CO.With fewer than ten business days between inspection and our June
16th deadline, any unforeseen delay—such as a follow-up request from the Health Department or a
processing backlog at the Building Department—could push CO issuance past the compliance window.
Granting this extension will ensure we have time to:
1. Receive and address any final Health Department comments;
2. Submit the complete inspection report and related documents to the Building Department; and
3. Allow sufficient business days for the Building Department to process and issue the CO.
We appreciate your understanding of these timing constraints
Regards,
James Maye

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF JUNE 16, 2022
Southold Town Clerk
ZBA FILE: #7626
NAME OF APPLICANT: James and Jennifer Maye
PROPERTY LOCATION: 910 Fleetwood Road, Cutchogue, NY SCTM#100-137-4-22
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration
in this application and determines that this review falls under the Type 11 category of the State's List of
Actions, without further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the
Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department
of Planning issued its reply dated January 19, 2022 stating that this application is considered a matter for
local determination as there appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront
Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated May 27, 2022. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department,
as well as the records available, it is recommended that the proposed action is INCONSISTENT with
LWRP policy standards and is therefore INCONSISTENT with the LWRP.
Policy 1. Foster a pattern of development of the Town of Southold that. Enhances community
character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a. coastal
location, and minimizes adverse effects of development.
The (as-built) structures are not supported by this policy as it does not enhance community
character and sets precedent contrary to the Board's procedures and authority. With the submission of the
Zoning Board of Appeals application and approval by the Board to grant the expansion of the pre-existing
non-conforming uses, the "as built" actions can therefore become CONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 11,954 square foot lot
located in the R-40 Zoning District. The northerly property line measures 27.31 feet, then slopes east at
29.79 feet, then drops southerly 72.16 feet, then east 34.00 feet then northerly at 50.24 feet, and is adjacent
to East Creek(Eugene Creek). The easterly property line measures 146.80 feet, the southerly property line
measures 98.11 feet and is adjacent to Fleetwood Road and the westerly property line measures 173.22 feet.
The property is improved with two single-family dwellings (aka as Cottage #1 and Cottage #2). Cottage
#1 is located on the easterly portion of the property and is approximately 875 square feet with an attached
wooden deck at the rear of the frame dwelling. Cottage 42 is a frame dwelling located on the westerly side
Page 2,June 16,2022

SCTM No. 1000-137-4-22
of the property and is approximately 835 square feet. The rear yard is very close to wetlands as shown on
the survey map prepared by John T.Metgzer.LS and dated October 29,2005 along with floor plan drawings
of the two dwellings prepared by Louis Schwartz, PE, and dated February 11, 2021.
BASIS OF APPLICATION: Request for Variances from Article XXIII, Sections 280-123; Article XXIII,
Section 280-124; and the Building Inspector's November 30, 2021 Notice of Disapproval based on an
application for a permit to legalize "as built" alterations (convert screen porch to living space, new heat,
waterside deck) to an existing seasonal cottage known as Cottage 41 and legalize "as built" alterations
(convert screen porch to living space, new heat)to an existing seasonal cottage known as Cottage#2, at; 1)
Cottage# 1 and#2 nonconforming uses shall not be enlarge, reconstructed,or structurally altered or moved
unless the use of such building are changed to a conforming use; 2) Cottage#1, located less than the code
required minimum side yard setback of 10 feet; located at : 910 Fleetwood Road, (Adj. to East Creek)
Cutchogue,NY. SCTM#1000-137-4-22.
RELIEF REQUESTED: The applicant requests variances to pen-nit as built alterations to Cottage#1, east
structure: (convert screen porch to living space; new heat; waterside deck) to an existing seasonal cottage
and Cottage#2,west structure: legalize"as built"alteration(convert screen porch to living space;new heat)
to an existing seasonal cottage at: 910 Fleetwood Road, Cutchogue, NY. SCTM#1000-137-4-22. The as
built construction, on this non-conforming 11954 square foot lot in the R-40 Zoning District, is not allowed
pursuant to Article XXIII, Section 280-123, Article XXIII, Section 280-124 which states; "A
nonconforming building containing a non-conforming use shall not be enlarged, reconstructed, or
structurally altered or moved, except as set forth below: unless the use of such building is changed toa
conforming use." Additionally, the as built deck on cottage#1 is not permitted pursuant to Article XXIII,
Section 280-123, Article XXIII, Section 280-124 which states: lots measuring less than 20,000 square feet
in total size require a minimum side yard setback of 10 feet. The survey shows the existing deck to be
located at 8.8 feet of the side yard property line.
ADDITIONAL INFORMATION: During the Public Hearing held on June 2,2022 the applicant's husband,
Mr. Maye, told the Board that Mrs. Maye inherited this property from her aunt who purchased the property
in 1974. Between 1974 and 1976 work was performed on the two cottages to convert them from seasonal
to year-round dwellings as confirmed by the Certificate of Occupancy issued by Southold Town Building
Departinent in August of 1976. The Building Inspector stated that both dwellings had heating installed and
conform to the Town Code. The applicant simply wishes to legalize the improvements that were made in
order to receive a rental permit from the Town. As to the "as built deck" on cottage 91, the applicant
estimates the work was done in the early 2000s. They are seeking a variance for the side yard setback of
1.2 feet. Southold Board of Trustees approved the deck application September 20, 2021. In 2018 the
previous owner,Mrs. Maye's aunt, received Southold Board of Trustee approval for an"as built" 8 feet by
8 feet shed and (2) 6 feet. x 6 feet panels installed between the shed and bulkhead. There was a condition
on this approval that the owner establish and subsequently maintain a 10 ft. wide non-turf buffer area along
the landward edge of the bulkhead which has not been done. .
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on June 2, 2022 at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection
of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following
facts to be true and relevant and makes the following findings:
1. Town Law $267-W)(b)(I). Grant of the variances will not produce an undesirable change in the
character of the neighborhood or a detriment to nearby properties. The cottages have existed in this
Page 3,June 16,2022
#7626, Maye
SCTM No. 1000-137-4-22
community for many years. The neighborhood was a summer community and almost all the cottages s
have been converted to year-round dwellings. Many of the lots in the community are also non-conforming.
2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,
feasible for the applicant to pursue, other than an area variance. The applicant inherited the property and
wishes to legalize the previous work.
3. Town Law§267-b(3)(b)(3). The variances granted herein for altering two pre-existing nonconforming
dwelling units are mathematically substantial, representing 100% relief from the code. The side yard
setback relief is substantial representing 12% relief from the code. However, these two cottages have not
enlarged their existing footprints and have existed on the subject property and continuously inhabited for
decades as part of the community character.
4. Town Law 1267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions in the
neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management
Code.
5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The applicant inherited the
property without knowledge of previous work.
6.Town Law267-b. Grant of the requested relief is the minimum action necessary and adequate to enable
the applicant to enjoy the benefit of the two cottages while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test
under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member
Dantes, and duly carried,to
GRANT the variances as applied for, and shown on the survey map prepared by John T. Metgzer, LS and
dated October 29, 2005 and floor plan drawings prepared by Louis Schwartz, PE and dated February 11,
2021.
SUBJECT TO THE FOLLOWING CONDITIONS:
1. The applicant/owner must submit evidence to the Zoning Board of Appeals and the Southold Town
Building Department that current Suffolk County Department of Health Services septic system
standards have been met, or in the alternative, make application to the Suffolk County Department
of Health Services to install an approved upgraded septic system.
2. The 2018 condition of the Southold Board of Trustees for a 10 foot wide non-turf buffer area along
the landward edge of the bulkhead shall be installed.
3. The wooden deck on Cottage#1 shall remain open to the sky.
4. No further enlargement of the two cottages/dwellings shall be permitted without Zoning Board of
Appeals approval.
5. Only Off-Street, On-Site parking shall be allowed for subject property.
6. The applicant must apply to the Building Department for a building permit for the "as built"
improvement(s)within 90 days of the date of this decision and submit same to the Office of the
Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals
setting forth the reason(s) why the applicant was unable to obtain a building permit in the time
allotted.
D
Page 4,June 16,2022

SCTM No. 1000-137-4-22
7. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as
built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 12
months of this decision or submit a written request for an extension to the Board of Appeals
setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in
the time allotted.
This approval shall not be deemed effective until the required conditions have been met.At the
discretion of the Board of Appeals, failure to comply with the above conditions may render
this decision null and void
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when
issued.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration
that does not increase the degree of nonconformity.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in
delays and/or a possible denial by the Building Department of a building permit, and may require a new
application and public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or
survey cited above, such as alterations, extensions, or demolitions, are not authorized under this
application when involving nonconformities under the zoning code. This action does not authorize or
condone any current or future use, setback or other feature of the subject property that may violate the
Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
IMPORTANT TIME LIMITS ON THIS APPROVAL
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted
by the Board of Appeals shall become null and void where a Certificate of Occupancy has
not been procured, and/or a subdivision map has not been filed with the Suffolk County
Clerk, within three (3) years from the date such variance was granted. The Board of
Appeals may, upon written request prior to the date of expiration, grant an extension not
to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S
RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME
FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the
denial by the Building Department of a Certificate of Occupancy, nullify the approved
variance relief, and require a new variance application with public hearing before the
Board of Appeals
