Since our last extension: • In October 2024,we applied to National Grid to relocate the gas line—a winter-season backlog delayed completion until March 2025. • Our contractor then installed the new septic system on May 16,2025. • The Health Department's final inspection is scheduled for June 5,2025. If the Health Department approves on June 5,it typically takes several business days to issue its report. Once received,the Building Department needs additional business days to review and process the paperwork before issuing a CO.With fewer than ten business days between inspection and our June 16th deadline,any unforeseen delay—such as a follow-up request from the Health Department or a processing backlog at the Building Department—could push CO issuance past the compliance window. Granting this extension will ensure we have time to: 1. Receive and address any final Health Department comments; 2. Submit the complete inspection report and related documents to the Building Department; and 3. Allow sufficient business days for the Building Department to process and issue the CO. Box 1179 Southold, NY 11971-0959 Attn: Leslie Weismann Subject: Request for extension for Building Permit,ZBA#7626 Dear Ms.Weisman: This letter is a request for an extension of Condition 6 of our determination letter,dated June 23'd 2022, which requires us to obtain a building permit for the"as built' improvements located at 910 Fleetwood Road,Cutchogue,NY(STCM 1000-137-4-22)within 90 days. Application has been made to the Building Department for a building permit,but before a building permit can be issued,we must first meet Condition 1,which will require us to install an approved upgraded septic system. We hired a surveyor on July 20,2022 to initiate the process to fulfill Suffolk's County Department of Health Services design and permitting requirements. However,it has taken much longer than expected for the surveyor to complete the design. Once a design is completed,applications will also need to be made to the Board of Trustee and the DEC for approval. We understand it may take several more months to acquire the proper permitting before the Building Department can issue a building permit. Additionally, the as built deck on cottage#1 is not permitted pursuant to Article XXIII, Section 280-123, Article XXIII, Section 280-124 which states: lots measuring less than 20,000 square feet in total size require a minimum side yard setback of 10 feet. The survey shows the existing deck to be located at 8.8 feet of the side yard property line. ADDITIONAL INFORMATION: During the Public Hearing held on June 2,2022 the applicant's husband, Mr. Maye,told the Board that Mrs. Maye inherited this property from her aunt who purchased the property in 1974. Between 1974 and 1976 work was performed on the two cottages to convert them from seasonal to year-round dwellings as confirmed by the Certificate of Occupancy issued by Southold Town Building Departinent in August of 1976. The Building Inspector stated that both dwellings had heating installed and conform to the Town Code. The applicant simply wishes to legalize the improvements that were made in order to receive a rental permit from the Town. As to the "as built deck" on cottage 91, the applicant estimates the work was done in the early 2000s. They are seeking a variance for the side yard setback of 1.2 feet. Southold Board of Trustees approved the deck application September 20, 2021. In 2018 the previous owner,Mrs. Maye's aunt, received Southold Board of Trustee approval for an"as built" 8 feet by 8 feet shed and (2) 6 feet. x 6 feet panels installed between the shed and bulkhead. There was a condition on this approval that the owner establish and subsequently maintain a 10 ft. wide non-turf buffer area along the landward edge of the bulkhead which has not been done. . FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law $267-W)(b)(I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant inherited the property and wishes to legalize the previous work. 3. Town Law§267-b(3)(b)(3). The variances granted herein for altering two pre-existing nonconforming dwelling units are mathematically substantial, representing 100% relief from the code. The side yard setback relief is substantial representing 12% relief from the code. However, these two cottages have not enlarged their existing footprints and have existed on the subject property and continuously inhabited for decades as part of the community character. 4. Town Law 1267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has not been self-created. The applicant inherited the property without knowledge of previous work. 6.Town Law�267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the two cottages while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
