TOWN ►F SM'TjjOI CS20 strapping is specified and observed at the sill plate. Simpson H7 straps are specified at the rafter-to-wall condition and H8 or H2.5 straps are specified for rafter- to-plate connections.Though Simpson doesn't make a connector with the identifier H2.5 there are several similar denominations such as the H2.5A and H2.5T.The contractor used Simpson H8 and H2A where observed.Installation appears compliant with code,though AOR should confirm load requirements are met. ADDITIONAL INFORMATION: The Southold Board of Trustees approved a Wetland Permit No. 10068 on February 16, 2022 for the additions as applied for. The permit was conditioned that the applicant must establish and perpetually maintain a 10 ft. wide non-disturbance buffer and a 10 ft. non-turf buffer tunning along the waterline as depicted on the survey map prepared by Michael W. Minto, LS, PC. The applicant will be moving the proposed garage back toward the dwelling by 7 feet so it will be further back from Rabbit Lane than the existing shed and planter in the front yard that will be removed. The applicant is also willing to remove the small shed in the rear yard. A New York State Department of Environmental Conservation Permit was issued to the applicant approving the additions to the residence. Permit ID 1-473 8-04752/0000 1. No neighbor spoke or wrote in favor or in opposition to this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This is an old established waterfront community with many small cottages that have been remodeled and.enlarged over the-years. The applicant is staying.vitl:in the established footprint of the dwelling. The applicant wishes to remove the present second-story and construct a new second-story with a new 6.4 ft.x 11.2 ft. balcony. They also plan to remove the north wall on the first floor in order to install new sliding doors. The existing cottage in the front yard will be demolished and a one car garage will be built 22 feet from the front yard lot line. The new Site Plan drawings submitted by Terry B. Porter, Architect and dated May 12, 2022 show the remodeled dwelling will now have three bedrooms on the second floor with two bathrooms and the first floor will have one full bathroom.The size of the proposed dwelling is in keeping with the size of other renovated two-story dwellings on Rabbit Lane. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the size of the lot and the pre-existing non-conforming side yard setback of the existing dwelling,further expansion would not be possible without variance relief. . 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 37%relief for the front yard setback of the proposed accessory garage; 73% relief for the side yard setback for the existing dwelling,and 10%relief for the excessive lot coverage. However,the applicant is moving the proposed garage back 7 feet and has also proposed to remove the small shed in the rear yard which will decrease the lot coverage. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of addition sto the dwelling and a new one car garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Additionally,the proposed construction will result in 22% lot coverage where the code permits a maximum of 20%. The proposed construction, on this non-conforming 6,780 square foot parcel in the Residential R-40 Zoning District, is not permitted pursuant to Article XXIII, Section 280-124 which states: lots measuring less than 20,000 square feet in total size require minimum front yard setback of 35 feet, a minimum side yard setback of 10 feet and further states lot coverage be a maximum of 20%. ADDITIONAL INFORMATION: The Southold Board of Trustees approved a Wetland Permit No. 10068 on February 16,2022 for the additions as applied for. The permit was conditioned that the applicant must establish and perpetually maintain a 10 ft. wide non-disturbance buffer and a 10 ft. non-turf buffer tunning along the waterline as depicted on the survey map prepared by Michael W. Minto, LS, PC. The applicant will be moving the proposed garage back toward the dwelling by 7 feet so it will be further back from Rabbit Lane than the existing shed and planter in the front yard that will be removed. The applicant is also willing to remove the small shed in the rear yard. A New York State Department of Environmental Conservation Permit was issued to the applicant approving the additions to the residence. Permit ID 1-4738-04752/00001. No neighbor spoke or wrote in favor or in opposition to this application. By email dated October 10, 2024, the applicant requested that the decision be amended to remove the requirement of an I/A OWTS Septic System. The applicant indicated in his correspondence that during discussion with a representative of the Suffolk County Department of Health Services, the applicant was advised that a new system need not be installed if the number of bedrooms are not being increased during reconstruction of a single family dwelling. At the October 17, 2024 Special Meeting, the Board members voted unanimously to strike Condition 91 from the original decision. All other conditions shall remain. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law U67-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant is staying within the established footprint of the dwelling. They also plan to remove the north wall on the first floor in order to install new sliding doors. The existing cottage in the front yard will be demolished and a one car garage will be built 22 feet from the front yard lot line. The new Site Plan drawings submitted by Terry B. Porter, Architect and dated May 12, 2022 show the remodeled dwelling will now have three bedrooms on the second floor with two bathrooms and the first floor will have one full bathroom.The size of the proposed dwelling is in keeping with the size of other renovated two-story dwellings on Rabbit Lane. Accessory garages in front yards with non-conforming setbacks are also common on both sides of Rabbit Lane.The existing dwelling is closest to the easterly property line and the property to the east is undeveloped.Therefore,an enlarged second story will have little to no impact on an adjacent neighbor. 2. Town Law V67-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the size of the lot and the pre-existing non-conforming side yard setback of the existing dwelling,further expansion would not be possible without variance relief. . 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 37%relief for the front yard setback of the proposed accessory garage; 73% relief for the side yard setback for the existing dwelling,and 10%relief for the excessive lot coverage. However,the applicant is moving the proposed garage back 7 feet and has also proposed to remove the small shed in the rear yard which will decrease the lot coverage. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 5267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of addition to the dwelling and a new one car garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. In order to issue you the proper notice of disapproval so you can proceed with your variances, I will need some additional info added to the plans and survey: Please provide us with lot coverage calculations, based on the buildable area of the property, excluding the non- disturbance buffer. The house, decks, sheds, and deck overhang all need to be taken into account. Please have your surveyor indicate existing first floor elevation on the survey. Also have him reference the flood zone. Because of the age of the home, and there are no septic permits on file,you will need Suffolk County Health Department approval for the sanitary system. Lastly,the project meets the town's definition of a "demolition". It doesn't mean you are tearing it down to the ground, it means substantial improvement, in which the cost of construction is going to exceed 50%of the home's current market value (excluding property and location). Because of this,the house will have to comply with current codes and flood zone requirements.
