The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: While the plan includes some actions which are consistent with the "Administrative Permit" requirements of Chapter§275-2 A of the Wetlands Law of the Town of Southold, including the proposed removal and relocation of the outdoor shower, reconstruction of the roofed porch, and installation of planting beds which qualify under §275-3 (b) Removal of any material or structure, provided that a project limiting fence and a silt fence with hay bales is installed to contain disturbance if deemed necessary and provided that such operations will not have an undue adverse impact on the wetlands and tidal waters of the Town, (d) Remodeling or renovation of a wetlands- permitted structure, provided that such activity will not have an undue adverse impact on the wetlands and tidal waters of the Town, and (k) Minor restoration or alterations of landscaping, the proposed expansion of the impervious patio on the water side of the structure does not satisfy the requirements of an Administrative Permit and should be reviewed under the regular permitting requirements. Due to the increase in pervious surface on the waterside of the house, this application maVjustify the establishment of a non-turf buffer.
