Environmental Consulting Services last revised May 3, 2006 and determined the proposed construction of a 5'X 8.5' roof deck to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 100' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the policies of the LWRP as follows: Policy 5 Protect and improve water quality and supply in the Town of Southold. 5.1 Prohibit direct or indirect discharge that would cause or contribute'to contravention of water quality standards. C. Ensure effective treatment of sanitary sewage and industrial discharges by: 3. Modifying existing sewage treatment facilities to provide improved nitrogen removal capacity. Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 6.3. Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The plan includes property improvements that are consistent with the requirements of Chapter §268 Waterfront Consistency Review of the Town of Southold Town Code. These actions include renovation and expansion of an existing porch and additions to an existing residence greater than 100' from wetlands. The installation of an I/A septic system is beneficial as it should help to protect surface and groundwater quality. The proposed action has been reviewed to Chapter §268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. 2 Colletta Project Description Proposed Construction more than1O0 SF from edge of wetlands: 204 SF 1 story addition to the existing house, proposed expansion (82 SF) to existing screened porch (208 SF) and steps (18 SF) and 20 SF of porch to be removed, 274 SF addition to south side of existing house with proposed 4'7.5"x 12" wood landing and steps (93 SF), wood deck (6.8'x 12.5') and hot tub (6.4'x 7.4'), remove existing sanitary system and construct new IA sanitary system 11 9'from edge of wetlands, 42 SF addition to the front of the house. Moore'; Betsy Perkins; Madison Messina Cc: Hobson,Thomas Subject: Colletta; SCTM# 1000-116-4-15 Pat, In reviewing your Administrative Permit application for the Colletta application, please be advised that at this time it is incomplete. While at this time the application can remain as an Administrative permit, however there are items needed in order to move forward. The proposed expanded screened porch, proposed stoop, existing wood deck, and wood deck section where hot tub is to be placed do not have dimensions on the survey which is required. A separate site plan from a NYS licensed professional will work if you have a site plan with all dimensions. Regarding the written description, it is apparent that the applicant will be installing a new I/A system which when measuring out the proposed the construction activity and ground disturbance may fall within the 100'jurisdictional area so this should be added to the project. In your description you note a 2009 letter of Non-Jurisdiction, however I am unable to find this letter. There is however a 2006 letter which was for a 5'x8.5' roof deck off of a portion off the dwelling beyond the jurisdiction (110ft.). Regardless of that letter if a structure is within Trustee jurisdiction today and work is being performed on part of all of that structure a Trustee permit must be applied for prior to performing any work on it. As you are proposing a 12'x12' expansion of a screened porch the total size of the proposed screened porch and new size of the deck need to be part of the application along with dimensions on the site plan. If the applicant is going to re-deck the existing deck or other deck work in order to facilitate the porch expansion, that should be noted in the written description. I cannot tell if the deck section the hot tub is being placed on,is connected to the larger deck. If this is a separate deck from the deck off the dwelling(not attached)then you need to apply for that existing deck and proposing the hot tub on top.
