This meeting is public. The Planning Board may add or remove applications from the agenda upon its discretion, without further notice. Applications may not be heard in the order they appear on this agenda. .SETTING-OF THE:NEXTRLANNING BOARD-MEETING Chairman Rich: The first order of business is to Board to set Monday, November 3, 2025 at 5:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next regular Planning Board Meeting Amelia Jealous-Dank: So, moved. SUBDIVISION APPLICATIONS FINAL PLAT DETERMINATION Chairman Rich: Evans Standard Subdivision —This proposal is for the standard subdivision of a 5.68-acre parcel into 2 lots, where Lot 1 is 1.5 acres, and Lot 2 is 4.18 acres in the R-40 Zoning District. The property is located at 1050 Greton Court, Mattituck. SCTM#1000-107.-3-2 Amelia Jealous-Dank: WHEREAS, this proposal is for the standard subdivision of a 5.68-acre parcel into 2 lots, where Lot 1 is 1.5 acres, and Lot 2 is 4.18 acres in the R-40 Zoning District; and WHEREAS, on April 7, 2025, the Planning Board granted a Negative Declaration under the State Environmental Quality Review Act, and granted Conditional Preliminary Plat Approval; and WHEREAS, on June 2, 2025, the Planning Board granted Conditional Final Plat Approval on the application; and WHEREAS, on September 8, 2025, the applicant submitted proof of recording of the required covenants and restrictions, thereby satisfying one of the conditions of the Conditional Final Plat Approval; and WHEREAS, on September 29, 2025, the applicant submitted the following: • Park and Playground Fee in the amount of$7,000, • Administration Fee in the amount of$4,000, • Five mylar and twelve paper subdivision maps with Suffolk County Department of Health Services approval stamp, thereby satisfying the remainder of the conditions of Conditional Final Plat Approval; and Southold Town Planninq Board Public Meeting —October 6, 2025 — Page 3 ------------- WHEREAS, on October 6, 2025, at their work session, the Planning Board found that all the conditions of the Conditional Final Plat approval have been met; therefore be it RESOLVED, that the Southold Town Planning Board hereby grants Final Plat Approval upon the map entitled, "Evans Standard Subdivision, Final Plat" prepared by Young & Young, dated April 21,2025, and last revised on September 4, 2025, and authorizes the Chairman to endorse the maps. Chairman Rich: The Orchards Standard Subdivision —This proposal is for a Clustered Standard Subdivision to subdivide a 13.3-acre parcel into five lots where Lot 1 = 9.33 acres including a 1.35 acre building envelope and 7.98 acres of preserved Open Space, and Lots 2 through 5 are each +/- 1 acre in the R-80 Zoning District. The property is located at 2595 Orchard Street, on the northeast side of Orchard Street, approximately 17' northwest of Platt Road, in Orient. SCTM1000-27.-1-3 Donald Wilcenski: WHEREAS, this proposal is for a Clustered Standard Subdivision to subdivide a 13.3- acre parcel into five lots where Lot 1 = 9.33 acres including a 1.35 acre building envelope and 7.98 acres of preserved Open Space, and Lots 2 through 5 are each +/- 1 acre in the R-80 Zoning District. The property is located at 2595 Orchard Street, on the northeast side of Orchard Street, approximately 17' northwest of Platt Road, in Orient. SCTM1000-27.-1-3; and WHEREAS, the Planning Board; as Lead Agency, performed a coordinated review of this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA); made a positive declaration, and completed the SEQRA process with a Findings Statement adopted on January 9, 2023; and WHEREAS, on February 5, 2024, the Planning Board determined the Final Plat Application to be complete; and Southold Town Planning Board Public Meeting — October 6, 2025 — Page 4 WHEREAS, on January 13 2025, the Planning Board granted Conditional Final Plat Approval of this application; and WHEREAS, on January 31, 2025, the applicant submitted the revised Final Road & Drainage Plans for review; and WHEREAS, on May 6, 2025, the applicant submitted the revised Final Plat with corrections made; and WHEREAS, on August 25, 2025, the applicant submitted the Performance Bond in the form of a letter of security from Dime Bank in the amount of$99,385; and WHEREAS, on August 25, 2025, the applicant submitted the Park and Playground Fee . in the amount of$28,000, and the Administration Fee in the amount of$5,963.10; and WHEREAS, on September 9, 2025, the Southold Town Board accepted the Performance Bond; and WHEREAS, on September 17, 2025, the applicant and submitted proof of recording of the covenants, and WHEREAS, on October 3, 2025 the applicant submitted 14 paper copies and 8 mylars of the Final Plat with the approval stamp of the SCDHS; and WHEREAS, on October 6, 2025, at their work session, the Planning Board found that all the conditions of the Conditional Final Plat approval have been met; therefore be it RESOLVED, that the Southold Town Planning Board hereby grants Final Plat Approval upon the map entitled "Subdivision of Property The Orchards, Clustered Final Plat Standard Subdivision" prepared by Lahti Engineering and Environmental Consulting P. C., dated June 15, 2013 and last revised September 30, 2025, and including the two- page Final Road & Drainage Plan entitled "Road and Drainage Plan for Clustered Final Plat Standard Subdivision of The Orchards", dated June 15, 2013, and last revised January 23, 2025, and authorizes the Chairman to endorse the maps. SITE PLAN APPLICATIONS SEQRA CLASSIFICATION/SET HEARING Chairman Rich: Zuhoski Nursery Agricultural Storage —This agricultural site plan is for the proposed construction of a 4,800 sq. ft. agricultural storage building (no basement) and 2,400 sq. ft. asphalt area, located on 8.0 acres in the A-C Zoning District. The property is located at 27500 CR 48, Cutchogue. SCTM#1000-85.-1-3 Martin Sidor: WHEREAS, this agricultural site plan is for the proposed construction of a 4,800 sq. ft. agricultural storage building (no basement) and 2,400 sq. ft. asphalt area, located on 8.0 acres in the A-C Zoning District.; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental ,Quality Review Act (SEQRA) 6 NYCRR, Part 617.5 (c), determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5(c)(4) "agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming"; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is a Type II Action under SEQRA as described above; Donald Wilcenski: Second. PUBLIC HEARINGS Chairman Rich: 5:01 p.m. - Southold Gas Station & Convenience Store EV Chargers—This amended site plan application is for the proposed installation of four (4) Autel dual handle Electric Vehicle Charging Stations on a site with an existing Gasoline Service Station and Convenience Store, located on 1.46 acres,in the General Business (B) Zoning District. The property is located at 45450 CR 48, Southold. SCTM#1000-55.-5-2.2 Anyone wishing to address the Planning Board, please step forward and state your name, sign your name for the record. Jessica Michaelis: For the record, the sign posting and certified mailings were done correctly. Nicholas Ontoria: My name is Nicholas Ontoria. Jessica Michaelis: You can address the Planning Board. Thank you. Nicholas Ontoria: It's my understanding that my colleague, Mark Ruscher, has previously spoken to the Planning Board about this project, covering a majority of it, but I do know that there were a remainder of questions regarding the lighting of the chargers. And we have since done a study and I have that information. So, based on the study, the chargers that are used are a newer edition of the Autel high power maxi charge, which have a smaller screen — and not only that— but a dimmer screen than its previous model and that the lighting itself is not going to be any brighter than the surrounding lights. The lighting of a screen is similar to that of a laptop screen, if you go towards the end of the pages, yes, specifically page E-11. It is a nighttime photo that was taken of the chargers. The chargers are actually the older model, so the brightness Southold Town Planning Board Public Meeting — October 6, 2025 — Page 7 that you are seeing emanating from the charger itself is going to be even less than that with the newer model. And even in the daytime, there's an anti-glare screen on then, there's a polarized screen that itself will allow for clearing in the daytime. Chairman Rich: Thank you, do you have any sort of brief overview of the project that you'd like to present for this public hearing? Nicholas Ontoria: So, the project itself is going to be a number of 240 kilowatt units that are going in to provide high-powered charging at a gas station to allow electric vehicles to take up the same space as your normal gas vehicles. You can see there's four proposed chargers there. Chairman Rich: Thank you. Anyone from the public wish to address the Planning Board on this? Cheryl Enera: I have a question... Chairman Rich: You may state your question but it may not be answered this evening. Cheryl Enera: Okay, I'm Cheryl Enera, I live at 3225 Youngs Avenue. I'm the second house down Young's Avenue from the gas station. Where these charging stations are going to go, is a long the property line of the Rempe's and with the original Site Plan for the gas station, we were told that there was going to be a six-foot fence across the entire property line. There is not. Where these chargers are going to go, there's still,a four-foot fence. Okay? We have car lights now from the parking that go into our backyards and into our houses. We have mentioned this to the Planners and nobody has answered us but when we left the meeting for the original gas station proposal, we were told a six-foot fence would be the entire property line. In order to do these chargers now, we would request that part of the plan is to get that six-foot fence up there. The other thing, is the gas station hours are until ten o'clock at night. How long — what's going to happen with the EV chargers? Are they available 24/7? Do we know? Chairman Rich: That's a question we will certainly ask them. Cheryl Enera: Okay, and I think the fence issue — I see the lighting looks okay, but the fence is an issue so that we don't have to —you know- once you turn the corner, you're into a residential neighborhood, whether we like it or not and even a taller fence at that spot would probably be good. That should be part of the plan now. Okay? Because it hasn't been taken care of. I want to make sure I ask everything, because we looked at the -when you sent us the notice —we looked at everything. Yeah, the — are the chargers going to be available 24/7 and then where are these people going to be, they're just gong to stay with their cars? Are we gonna —we already have issues with these people as our neighbors where we're picking up garbage and things like that so, we're just curious about what—will they be 24/7. Southold Town Planninq Board Public Meeting — October 6, 2025 — Page 8 Chairman Rich: That's certainly a legitimate question and we will probably as a question of how long a timing takes to complete a charge. Which would sort of answer your second question I believe - Cheryl Enera: Yeah, because right down the road here we have six EV chargers that the Town put in and they're not all utilized at any given time, I mean, we use this street all the time cuz we live on it. You know, so the other part of my thinking is that: there's four charging stations that—two cars at each charging station, you could charge eight cars at a time, I don't know, seems like a bit of overkill based on what we're seeing here at the Town Annex on Young's Avenue, so that's just a comment. But the fence is definitely and the hours, we need to know. We'd like for you to tighten that up, if you can. Chairman Rich: Thank you, I feel that we owe you an explanation or research on that six-foot fence issue. As far as the economic viability of a business, that's not really something in our prevue. Cheryl Enera: That was told to us in the original plan! Chairman Rich: No, I'm talking about the number of chargers... Cheryl Enera: Oh, the number of chargers, yes. I know, it's just a comment. Chairman Rich: It was well received, Cheryl. Thank you. Cheryl Enera: Yeah, just those two things: the fence'and are —you know- the chargers are 24/7? We had an issue —just so you know—we had an issue after the gas station opened, the hours were supposed to be until ten o'clock at night and we ended up, because we're not always out and about after that but we ended up finding out that a couple months later that they were open to midnight and so we called Code Enforcement and they went down and spoke to them and now they're just open until ten o'clock at night so they're not, they haven't been the best neighbors as far as the plan and stuff was concerned, the original plan, but that's really all I have to say. The six-foot fence is really important and finding out what the hours are for the chargers... Donald Wilcenski: And garbage... I agree with that. Cheryl Enera: And garbage.
