Planning Board for comments. In their memorandum dated October 27, 2025, the Planning Board
found that the proposed special exception use is generally consistent with several goals and
objections of the Southold Town Comprehensive Plan. In their memo they discussed concerns
relating to the intensity of use and traffic safety, etc., and made recommendations and based upon
SEQRA assessment, considered conditions to ensure compatibility with the LB Zoning District and
the Comprehensive Plan.

the Suffolk County Administrative Code Sections A 14-14 to 23. The Suffolk County Department
of Planning issued its reply dated March 6, 2025 stating that this application is considered a matter

The Commission made additional comments to include: 1)the Suffolk County Department of Public
Works should review same for roadway mitigation; 2)that the petitioners should review the Suffolk
County Planning Commission publications on Managing Storm water-National Vegetation and Green
Methodologies and incorporate same where practical; and 3)the petitioner should review the Suffolk
County Commission Guidebook with respect to energy efficiency.

pursuant to Article M Section 280-41 B (2),
ADD LTiEQRMATION: At the initial public hearing held on August 7,2025,the:applicant

provided testimony regarding the proposed use of the subject spaces, During the cout
hearing, members of the Board inquired as to the specific intended uses of the spaces,the nature and
type of prospective rentals, the procedures for loading and unloading, and the potential for outdoor
storage. In resporise to these inquiries, the applicant affirmed that outdoor storage would not be
permitted on the property and further agreed to record restrictive covenams expressly prohibiting any
outdoor storage on the premises.

the project. Two neighbors spoke for the project at the November 6 th hearing with concerns about
water runoff onto their property and the flow of traffic, U-turns in particular.

The Zoning Board of Appeals held a public hearing on this application on August 7, and November
6 at which tirne written and oral evidence were presented. Based upon all testimony,
documentation,on, personal inspection of the property and surrounding neighborhood, and other
evidence, the Zoning Board finds the following facts to be true and relevant and makes the
following findings:
The Board has reviewed the General Standards governing Special Exception uses set forth in Section
280-142 and finds:
A. That the use will not prevent the orderly and reasonable use of adjacent properties or of
properties in adjacent use districts. The proposed buildings are intended for small-scale
businesses compatible with Southold's small-town character. The project represents an
efficient use of this limited commercial land,providing space for local contractor businesses
while generating less traffic and activity than other permitted uses in the zone, such as a
hotel, restaurant, or retail winery.
B. That the use will not prevent the orderly and reasonable use of permitted or legally
established uses in the district wherein the requested use is located or of permitted or
legally established uses in adjacent use districts
C. That the safety, the health, the welfare, the comfort,the convenience or the order of the town
will not be adversely affected by the proposed use and its location.
D. That the use will be in harmony with and promote the general purposes and intent of this
chapter. The proposed contractor business yard advances the Town's economic

development goals by providing-space for srn,,111-scale service businesses that generate
stable local employment. By accommodating multiple businesses on a single site, the
project fosters the growth of existing business sectors, :supports community-serving.

E. That the use will be compatible with its surroundings and with the character of the

neighborhood and of the community n general, particularly with regard to visibility, scale
and overall appearance.

F. That all proposed structures, equipment and material shall be readily accessible for f'

G. That the proposal shall comply with the requirements of Chapter 236, Stormwater
Management
In making such determination, consideration was also given to:
A. The character of the existing and probable development of uses in the district and the
peculiar suitability of such district for the location of any of such permitted uses. The LB
district is intended for limited, low-traffic bLiSilIeSS, activity that preserves the rural and
residential character of the surrounding area. The proposed tow 11,000 square foot
buildings with ten contractor bays,represent a relatively high-intensity use, but With closely
managed operational intensity, all traffic impacts should be mitigated.
B. 'The conservation of property values and the encouragement of the most appropriate uses of
land.
C. The effect that Elie location of the proposed use and the location that entrances and exits
may have upon the creation or undue increase of vehicular traffic congestion on public
streets, highways or sidewalks to assure the public safety.
D. The availability of adequate and proper public or private water supply and facilities for the
treatment, removal or discharge of sewage, refuse or other effluent(whether liquid, solid,
gaseous or otherwise) that may be caused or created by or as a result of the use.
E. Whether the use or the materials incidental thereto or produced thereby may,give off
obnoxious gases, odors, smoke or soot.
F. Whether the use will cause disturbing emissions of electrical discharges, dust, light,
vibration or noise. iterference with the
G. Whether the operation in pursuance of the use Will cause undue it
orderly enjoyment by the public of parking or of recreational facilities, If existing or if

assemblage of persons, upon such plot.
J. Whether the use or the structures to be used therefor will cause an overcrowding of land or
undue concentration of population.
K. Whether the plot area is sufficient, appropriate and adequate for the use and the reasonably
anticipated operation and expansion thereof.

L. Whether the use to be operated is unreasonably near to a church, school,theater,
recreational area or other place of public assembly.
M. Whether the site of the proposed use is particularly suitable for such use.
N. Whether adequate buffer yards and screening can and will be provided to protect adjacent
properties and land uses from possible detrimental impacts of the proposed use.
O. Whether adequate provision can and will be made for the collection and disposal of
stormwater runoff, sewage, refuse and other liquid, solid or gaseous waste which the
proposed use will generate.
P. Whether the natural characteristics of the site are such that the proposed use may be
introduced there without undue disturbance or disruption of important natural features,
systems or processes and without risk of pollution to groundwater and surface waters on
and off the site.
Q. The issuance of a Special Exception permit, as applied for in this application„ is also subject
to the following specific criteria and requirements which have been met pursuant to Section
280-40 of the Town Code:

Lehnert, seconded by Member Steinbugler, and duly carried to
GRANT a Special Exception, as applied for, and shown on the Site Plans prepared by Marc
Polotta, LPE, dated October 10, 2025 and the architectural drawings prepared by Ronald Kuoppala,
last revised September 10, 2025.
SUBJECT JECT TO TJl-E FOULOW ING C()NDI`FIONS:
I. Covenants and restrictions shall be filed with Clerk of Suffolk County„ and be attached to
the property in perpetuity stating that there will be no outdoor storage of any type on the
property
2. In accordance with the Zoning Board of Appeals, approval shall thereafter be deerned a
lawful use as if the same were permitted by this chapter without need for a special
exception permit; provided, however, that:
a. All conditions imposed by the special exception approval shall continue to apply
unless they, by their express terms, are of limited duration;
b. All conditions imposed on special exception approval uses generally or specifically
by this chapter shall continue to apply, regardless of whether any such conditions
were expressly incorporated into the special exception approval;
C. The Zoning Board of Appeals shall retain continuing jurisdiction over the same;
d. The duration of a special exception use may be limited to a specified time period as
set forth in the approval of the Zoning Board of Appeals, if the approval is silent as to
the duration of the special exception use, then said use shall be in perpetuity;
e. A special exception use which has been discontinued for a period of one year or more
shall be deemed abandoned.
3. The applicant must obtain site plan approval from the Planning Board. Failure to do
so will render this Special Exception Permit null and void.
4. The applicant must comply with all additional conditions of approval required by
the Planning Board during site plan approval.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when
issued.

Dear Mr. Kuoppala:
The following resolutions were adopted at a meeting of the Southold Town Planning
Board on Monday, December 8, 2025:
WHEREAS, this Site Plan application proposes the construction of two new 11,002.6-
square-foot buildings, each divided into five contractor business spaces for a total of ten
spaces, on a 2.57-acre parcel in the Limited Business Zoning District in Mattituck; and
WHEREAS, on February 19, 2025, Ronald Kuoppala, authorized agent, submitted a
Site Plan Application for review; and
WHEREAS, the Southold Town Zoning Board of Appeals must review the proposed
project for a special exception use pursuant to § 280-41(B)(2); and
WHEREAS, on March 24, 2025, the Southold Town Planning Board found the
application incomplete; and
WHEREAS, on April 3, 2025, Ronald Kuoppala, authorized agent, submitted application
materials; and
WHEREAS, on April 18, 2025, Ronald Kuoppala, authorized agent, and Marc Pilotta,
PE from Key Civil Engineering, submitted additional materials; and

WHEREAS, on April 24, 2025, Ronald Kuoppala, authorized agent, and Marc Pilotta,
PE from Key Civil Engineering, submitted additional materials; and
WHEREAS, on April 24, 2025, the Southold Town Planning Board found the application
complete for review; and
WHEREAS, on May 5, 2025, at their public meeting, the Southold Town Planning
Board, pursuant to State Environmental Quality Review Act (SEQRA) 6 NYCRR, Part
617, classified the proposed action as an Unlisted Action as it does not meet any of the
thresholds of a Type I Action, nor does it meet any of the criteria on the Type II list of
actions; and
WHEREAS, on May 5, 2025, at their public meeting, the Southold Town Planning Board
set the Public Hearing for July 14, 2025; and
WHEREAS, on May 8, 2025, Ronald Kuoppala, authorized agent, submitted renderings;
and
WHEREAS, on May 12, 2025, Ronald Kuoppala, authorized agent, submitted revised
renderings; and
WHEREAS, on May 15, 2025, the Planning Board, pursuant to Southold Town Code
§280-131 C, distributed the application to the required agencies for their comments; and
WHEREAS, on May 16, 2025, the Suffolk County Department of Public Works reviewed
the proposed application and said a Highway Work Permit is required; and
WHEREAS, on May 22, 2025, the Southold Town Code Enforcement officer verified
that there were no open violations on the subject parcel; and
WHEREAS, on May 27, 2025, the Suffolk County Department of Health Services found
the application incomplete pending submission of the SEQRA Determination; and
WHEREAS, on June 2, 2025, Ronald Kuoppala, authorized agent, and Marc Pilotta, PE
from Key Civil Engineering, submitted revised plans; and
WHEREAS, on July 3, 2025, the Town of Southold Local Waterfront Revitalization
Program (LWRP) Coordinator reviewed the proposed project and recommended the
project to be found consistent with Southold Town LWRP; and
WHEREAS, on July 8, 2025, the Southold Town Engineer reviewed the proposed
application and determined the applicant must prepare a Stormwater Pollution
Prevention Plan (SWPPP) and obtain a State Pollution Discharge Elimination System
Permit (SPDES) from the New York State Department of Environmental Conservation
(NYSDEC); and

WHEREAS, on July 14, 2025, the Southold Town Planning Board, as Lead Agency
pursuant to SEQRA, made a determination of non-significance for the proposed action
and granted a Negative Declaration after a coordinated review; and
WHEREAS, on July 14, 2025, the Planning Board held and closed the public hearing for
the proposed action; and
WHEREAS, on July 15, 2025, Ronald Kuoppala, authorized agent, and Marc Pilotta, PE
from Key Civil Engineering, submitted revised plans; and
WHEREAS, on July 31, 2025, the Mattituck Fire District determined that there was
adequate fire protection for the site; and
WHEREAS, on August 7, 2025, the Southold Town Architectural Review Committee
held a regular meeting to review the project; and
WHEREAS, on August 7, 2025, Ronald Kuoppala, authorized agent, submitted a truck
maneuvering plan; and
WHEREAS, the Zoning Board of Appeals held a public hearing on August 7, 2025 and
adjourned the hearing subject to Planning Board comments; and
WHEREAS, on August 21, 2025, the Southold Town Fire Marshal reviewed and
determined that there was adequate fire protection, emergency egress, and emergency
access to the site; and
WHEREAS, on August 22, 2025, the Architectural Review Committee (ARC) provided
comments to be incorporated into the proposed site design; and
WHEREAS, on August 26,_2025, Ronald Kuoppala, acting as the authorized agent,
submitted the NYSDEC Letter of Authorization for the SPDES Notice of Intent (NO[)
along with the full electronic NOI filing; and
WHEREAS, on August 29, 2025, Marc Pilotta, PE, of Key Civil Engineering, provided a
letter containing an analysis of existing conditions, traffic impacts, parking adequacy,
and intersection safety and operations for the proposed development; and
WHEREAS, on September 3, 2025, Ronald Kuoppala, authorized agent, and Marc
Pilotta, PE from Key Civil Engineering, submitted revised plans; and
WHEREAS, on September 3, 2025, the Suffolk County Water Authority reviewed the
proposed project and determined there is sufficient water capacity for the proposed use;
and
WHEREAS, the Zoning Board of Appeals held a public hearing on September 4, 2025
and adjourned the hearing subject to Planning Board comments; and

WHEREAS, at their work session on September 8, 2025, the Planning Board reviewed
the proposed application, along with comments from referral agencies, and required

WHEREAS, on September 29, 2025, Ronald Kuoppala, authorized agent, and Marc
Pilotta, PE from Key Civil Engineering, submitted revised plans for the Planning Board

WHEREAS, on October 3, 2025, the Suffolk County Department of Health Services
issued wastewater approval for construction, reference # C-25-0053; and
WHEREAS, during its work session held on September 8, 2025, the Planning Board
reviewed the revised plans submitted for the proposed application and identified minor
corrections to be made; and

WHEREAS, the Zoning Board of Appeals held and closed the public hearing on
November 6, 2025; and
WHEREAS, on November 20, 2025, the Southold Town Zoning Board of Appeals (ZBA)
granted Special Exception #8009SE; and
WHEREAS, on December 5, 2025, the Southold Town Chief Building Inspector
reviewed and certified the proposed use is permitted as a special exception by the
Board of Appeals in the Limited Business (LB) Zoning District; therefore be it
RESOLVED, that the Southold Town Planning Board hereby finds the application
consistent with the Local Waterfront Revitalization Program; and be it further

Conditions of Approval:
1. Deliveries and Operations: All deliveries, contractor activity, and service
operations shall occur entirely on-site. Use of the public right-of-way for loading,
parking, staging, standing, or any business-related activity is strictly prohibited.
2. Outdoor Storage: Outdoor storage of materials or equipment is prohibited.
Parking of legally registered trailers, and the storage of materials or equipment
on legally registered trucks and trailers, is permitted.
3. Indoor Operations: All business-related activities shall be conducted indoors.
4. Public Access & Retail Uses: Retail sales and access by the general public are
prohibited.
5. Number of Contractor Bays: The number of contractor bays is limited to a
maximum of ten (10), as proposed. Any increase in the number of bays or units
shall require return to the Planning Board for review and approval, including
evaluation of potential impacts on traffic, parking, and on-site circulation.
6. Screening and Landscaping: Following installation, the Planning Board may
require supplemental plantings, as deemed necessary, to ensure that the buffer
achieves and maintains effective screening.
Please note the following requirements in the Southold Town Code relating to Site
Plans:
1. Any new lighting fixtures beyond those approved as part of the Lighting Plan
must conform to the Code and may require Planning Board approval depending
on their number, size, intensity and location. Fixtures shall be shielded so the
light source is not visible from adjacent properties and roadways and shall focus
and direct the light in such a manner as to contain the light and glare within
property boundaries and conform to §172 of the Town Code.

2. Proposed storm water run-off containment systems must be inspected by the
Town Engineer at the time of installation. Please call the Southold Town
Engineer prior to beginning this work.
3. Approved Site Plans are valid for eighteen months from the date of approval,
within which time all proposed work must be completed, unless the Planning
Board grants an extension.
4. Any changes from the Approved Site Plan shall require Planning Board approval.
5. Prior to the issuance of a Certificate of Occupancy, the Planning Board must
inspect the site to ensure it is in conformity with the Approved Site Plan, and
issue a Final Site Inspection approval letter. Should the site be found not in
conformance with the Approved Site Plan, no Certificate of Occupancy may be
issued unless the Planning Board approves the changes to the plan.
A copy of the Approved Site Plan is enclosed for your records. One copy will also be
sent to the Building Department and the Town Engineer/Highway Department.

As you informed, the plans were received on 7/2 via the Department of Public Works email
address and forwarded to the Traffic Engineering and Permit Division shortly afterwards;
unfortunately, the plans were never inserted into the Permit file. Please pardon any
inconvenience and delay.
Be advised, upon Town of Southold JOS) Planning Board approval, the application needs
to be delivered/forwarded to the TOS Building Department for procuremen
local/municipal permits. At this point, the TOS Building Department isu q 239f
Memorandum to inform Suffolk County of the TOS Planning Boards endorsement and
petitions the County for any comments/concerns regarding the application; see attached
PDF example.
To expedite the process, please have the building department submit the required 239f
Memorandum via DP F UEEDI C0UHT NY-TINY `•
If Suffolk County does not have any further comments/concerns regarding the application, a
Suffolk County permit processing package (Permit document, stamped plans and
associated fees) is submitted to the applicant.
Once Suffolk County is in receipt of the signed Permit document (applicants' signature),
associated checks, and required insurances, the Director of Traffic Engineering and
Permits provide the final signature to executs the permit document.
