("the PBA"). WHEREAS,the Town and the PBA are parties to a collective bargaining agreement covering the period January 1, 2025 through December 31, 2025 ("the CBA"); and WHEREAS, the parties have engaged in negotiations in good faith in an effort to arrive at a successor agreement to the CBA that expires on December 31, 2025; and WHEREAS, the parties have arrived at a tentative agreement. NOW, THEREFORE, in consideration of the mutual covenants contained herein,the parties stipulate and agree as follows: 1. The provisions of this Stipulation are subject to ratification by the PBA membership and ratification and approval by the Town Board. 2. The respective negotiating committees below agree to recommend this Stipulation for ratification/approval. 3. A copy of this original document has been furnished to representatives of the Town and the PBA. 4. Section 4(V)(5) (G.M.L. § 207-0. Effective January 1, 2026, change 12 to six months. 5. Section 8.2 (Retirement Benefits). Effective January 1, 2026, October I"to September 15cn 6. Section 7.2(f) (Sick Leave Bank) (NEW). Effective January 1, 2026: Effective January 1, 2026: i. All employees will be eligible to participate in the Sick Leave Bank Program. 1/12/26 ii. The Sick Leave Bank will be funded by a donation on January 1 of one sick leave day per calendar year per employee from their annual sick leave, except probationary employees will not be eligible for Sick Leave Bank benefits, and so will not be required to donate sick time, until they have completed their probationary appointment. iii. The Sick Leave Bank must always have at least 57 unappropriated days. iv. If the Sick Leave Bank has 114 unappropriated days on any December 31, then P 2 will be suspended for that year, subject to PP 3, 5. V. If the Sick Leave Bank balance falls below 57 days, then it must be immediately replenished by a mandatory donation of an equal amount of sick leave days per employee necessary to restore the sick leave bank to at least the minimum set forth in P 3. vi. Employees may voluntarily donate additional sick leave days. Sick leave days donated to the Sick Leave Bank days may be reaccumulated for future individual use, but not for payment or vacation extension upon retirement purposes pursuant to CBA Section 7.2a. Instead, the Section 7.2a cap will be reduced for that employee by the number of hours donated by them regardless of the number of sick leave days that the employee has otherwise accumulated. vii. , Contributions to the Sick Leave Bank are non-refundable; i.e., days will not be returned to an employee if they are not used. viii. Any employee who voluntarily donates days will have their sick leave accruals reduced by the appropriate number of sick leave days and the employees will be so notified. ix. Employees will be eligible for a grant of sick leave credits from the sick leave bank if they: (1) have completed their probationary appointment; (2) otherwise have at least one year of service as a PBA Unit Member; (3) are necessarily absent from work due to a 2 1/12/26 catastrophic injury or illness; and (4) have exhausted all of their accumulated leave time, except for one personal day and two annual leave days. X. Employees may apply for Sick Leave Bank benefits by submitting an application, on the attached form, to the PBA Unit President and the Town Attorney ("the Committee"), or their designees. xi. The application will be accompanied by documentation from a medical practitioner(s) setting forth the nature of the injury or illness, the prescribed medical treatment, the prognosis for return to work and the timing of same. xii. Within 14 calendar days from submission of the completed application, the Committee will email to the applicant with a written determination granting or denying the application. An application will be deemed granted only if it is unanimously approved.- xiii. In making its decision, the Committee will consider, among other criteria, the nature of the illness or injury, the medical documentation submitted, the prognosis for return to work, the timing of same, the applicant's work record and the applicant's length of service. xiv. The Committee will notify the applicant of the number of sick leave days to be awarded, not to exceed 30 in any one determination. xv. If the Committee decides that the Sick Leave Bank needs to be replenished separate and apart from PP 3-5,then the Committee will request voluntary donors from within the PBA Bargaining Unit. xvi. Nothing concerning the Committee's discussions and results, or lack of same, will be subject to the contractual grievance and arbitration procedures, PERB's improper practice procedures or any other type of third party review by any person or entity at any time or for any reason. 3 1/12/26 xvii. The Committee's decisions will not be precedent-setting for any future applications. xviii. An applicant may apply to receive a further award of Sick Leave Bank credits, based on the same injury/illness, utilizing the same procedure set forth above, with updated medical information. xix. An applicant whose application has been approved will begin to be paid immediately upon the Committee's approval of the application, retroactive to whatever day is determined by the Committee. xx. The Town will, consistent with the Committee's award, withdraw from the Sick Leave Bank one day of sick leave for each day the employee is absent from work due to the illness or injury that qualified the Employee for the use of sick leave bank credits. xxi. An applicant whose application has been approved will not earn or accrue any paid time off or holiday pay during their use of donated sick leave days. xxii. An applicant's Sick Leave Bank days will have no value to them other than as set forth in this Agreement. xxiii. When utilizing Sick Leave Bank credits, the applicant will be governed by the same rules, procedures, policies, protocols and CBA provisions as apply to the use of ordinary sick leave. xxiv. The Committee may periodically require that the employee supply medical documentation supporting the need for their continued absence from work and Sick Leave Bank credits. xxv. If the Committee determines that the applicant no longer qualifies for Sick Leave Bank credits, it will notify the applicant of the effective date that the Town will discontinue permitting the applicant to receive the Sick Leave credits. 4 1/12/26 xxvi. No employee will be permitted to receive payment from the Sick Leave Bank on or following their separation of employment from the Town. xxvii. Any remaining balance in the Sick Leave Bank will remain for potential use by other employees who are deemed eligible by the Committee for same. xxviii. Nothing contained herein in any way restricts the Town's right to separate an employee from employment pursuant to Civil Service Law Section 71 or 73, as appropriate, pursuant to CBA Section 29. 7. Section 9.3(a) (Three Tour Differential). Effective on the first day of the first payroll period in 2026 (January 8, 2026), the differential will be increased by $435. Effective January 1, 2027, the differential will be increased by $435. Effective January 1, 2028, the differential will be increased by $435. Effective January 1, 2029, the differential will be increased by $435. 8. Section 7.11(a) (Duty Chart). "April 23, 2023"will be revised to read"Six calendar months from the date on which the 2025-2029 Agreement is fully ratified and approved, or July 1, 2026, whichever is later." 9. Section 7.15 (Mandatory Overtime) (New). Effective January 1, 2026: Unconsolidated Laws Section 971. Effective upon the complete ratification and approval of the 2026-2029 Agreement, employee overtime may be mandated notwithstanding the provisions of Unconsolidated Laws Section 971 or any of its successors as follows. i. This policy applies to non-emergency (as declared by the Town Supervisor or designee and as defined in Unconsolidated Laws Section 971) mandated shift coverage situations. 5 I'1 1/12/26 ii. A separate list for mandatory shift coverage will be maintained by the Department. When contact is made with an employee, that employee will be ordered to report for shift coverage, and on what date and time. This will be noted in the appropriate box. iii. Employees who are scheduled for pre-approved vacation, bereavement, compensatory time or personal days will be exempt from mandatory shift coverage. iv. If overtime becomes available within eight hours of any shift, and there are no volunteers to fill the vacancy, the most junior employee from the preceding shift will be mandated to work the overtime shift. An employee will not be mandated two days in a row, unless there is no other alternative. An employee will also not be mandated if the mandate will create a situation in which the employee would be required to work more than 16 hours in a 24-hour period. 10. Section 9.1 (Salaries): i. Effective on the first day of the first payroll period in 2026 (January 8, 2026), for police officers hired before December 31, 2013,the base salary will be increased by 3.75%, as set forth in Appendix A. ii. Effective on the first day of the first payroll period in 2026 (January 8, 2026), for police officers hired on or after December 31, 2013 and before May 22, 2018, the first year and seventh year salary steps of the January 1, 2025 salary schedule will be increased by 3.75%, and the second through sixth year salary steps of the January 1, 2025 salary schedule will be recalculated, so that the first through seventh year salary steps are equidistant, as set forth in Appendix A. iii. Effective on the first day of the first payroll period in 2026 (January 8, 2026), for police officers hired on or after May 22, 2018,the first year and ninth year salary steps of the January 1, 2025 salary schedule will be increased by 3.75%, and the second through eighth 6 1/12/26 year salary steps of the 2025 salary schedule will be recalculated, so that the first through ninth year salary steps are equidistant, as set forth in Appendix A. iv. Effective January 1, 2027, for police officers hired before December 31, 2013, the base salary will be increased by 3.75%, as set forth in Appendix A. V. Effective January 1, 2027, for police officers hired on or after December 31, 2013 and before May 22, 2018, the first year and seventh year salary steps of the January 1, 2026 salary schedule will be increased by 3.75%, and the second through sixth year salary steps of the January 1, 2026 salary schedule will be recalculated, so that the first through seventh year salary steps are equidistant, as set forth in Appendix A. vi. Effective January 1, 2027, for police officers hired on or after May 22, 2018, the first year and ninth year salary steps of the January 1, 2026 salary schedule will be increased by 3.75%, and the second through eighth year salary steps of the 2026 salary schedule will be recalculated, so that the first through ninth year salary steps are equidistant, as set forth in Appendix A. vii. Effective January 1, 2028, for police officers hired before December 31, 2013, the base salary will be increased by 3.75%, as set forth in Appendix A. viii. Effective January 1, 2028, for police officers hired on or after December 31, 2013 and before May 22, 2018, the first year and seventh year salary steps of the January 1, 2027 salary schedule will be increased by 3.75%, and the second through sixth year salary steps of the January 1, 2027 salary schedule will be recalculated, so that the first through seventh year salary steps are equidistant, as set forth in Appendix A. ix. Effective January 1, 2028, for police officers hired on or after May 22, 2018, the first year and ninth year salary steps of the January 1, 2027 salary schedule will be increased by 3.75%, and the second through eighth year salary steps of the 2027 salary schedule 7 1/12/26 will be recalculated, so that the first through ninth year salary steps are equidistant, as set forth in Appendix A. X. Effective January 1, 2029, for police officers hired before December 31, 2013, the base salary will be increased by 3.75%, as set forth in Appendix A. xi. Effective January 1, 2029, for police officers hired on or after December 31, 2013 and before May 22, 2018, the first year and seventh year salary steps of the January 1, 2028 salary schedule will be increased by 3.75%, and the second through sixth year salary steps of the January 1, 2028 salary schedule will be recalculated, so that the first through seventh year salary steps are equidistant, as set forth in Appendix A. xii. Effective January 1, 2029, for police officers hired on or after May 22, 2018, the first year and ninth year salary steps of the January 1, 2029 salary schedule will be increased by 3.75%, and the second through eighth year salary steps of the 2029 salary schedule will be recalculated, so that the first through ninth year salary steps are equidistant, as set forth in Appendix A. xiii. Effective on the first day of the first payroll period in 2026 (January 8, 2026), the January 1, 2025-sergeant salary rate will be increased by 3.75%, as set forth in Appendix A. xiv. Effective January 1, 2027, the January 1, 2026 sergeant salary rate will be increased by 3.75%, as set forth in Appendix A. xv. Effective January 1, 2028, the January 1, 2027 sergeant salary rate will be increased by 3.75%, as set forth in Appendix A. xvi. Effective January 1, 2029, the January 1, 2028 sergeant salary rate will be increased by 3.75%, as set forth in Appendix A. 8 i 1/12/26 xvii. Effective on the first day of the first payroll period in 2026(January 8, 2026),the January 1,2025 lieutenant salary rate will be increased by 3.75%,as set forth in Appendix A. xviii. Effective January 1,2027,the January 1,2026 lieutenant salary rate will be increased by 3.75%,as set forth in Appendix A. xix. Effective January 1,2028,the January 1,2027 lieutenant salary rate will be increased by 3.75%,as set forth in Appendix A. xx. Effective January 1,2029,the January I,2028 lieutenant salary rate will be increased by 3.75%,as set forth in Appendix A. 11. Section 9.6(IRC&401(a)).Delete(moot). 12. Section 16.2(Step 3)(last sentence)(Arbitration).For all demands for arbitration filed after the date on which the 2026-2029 Agreement is fully ratified and approved,revise to read:'-'The arbitrator will be assigned by the Town Attorney or designee to conduct the hearing from the following panel: Elena Cacavas Jay Siegel Dr. Rosemary Townley Arbitrators will be assigned on a rotating basis in alphabetical order and in the order in which the demand for arbitration is received by the Town Attorney's Office.The Town Attorney's Office or designee will send written notification of the assignment to the arbitrator and the PBA.The Town Attorney's Office's assignment of arbitrators will constitute a ministerial act and will not constitute participation by the Town in the arbitration for purposes of preventing the Town from filing an application to stay arbitration pursuant to New York Civil Practice Law and Rules Section 7503.Any arbitrator(s)may be removed from the panel by the Town or the Union upon 9 1/12/26 written notice to the other to be received by that party by not later than December 1 each calendar year. Should this occur,the parties will immediately meet to attempt to agree upon a replacement(s).Failure to agree upon a replacement(s)will not be subject to the grievance or arbitration procedure,PERB or court jurisdiction,or other third party review,except that,if the panel contains fewer than two names for one or more months,then a party will have the unilateral option,on written notice to the other,to replace the panel for grievances not then pending with arbitration through PERB's voluntary arbitration rules(Section 207)pursuant to the procedure that was in effect in the 2025 Agreement. The Arbitrator will issue a decision not later than 30 days from the date of the closing of the hearings or, if verbal hearings have been waived,then from the date of transmitting the file, statements and proofs to the Arbitrator.The decision will be in writing and will set forth the Arbitrator's interpretation of the issue(s)submitted to them." 13.
