Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. And Town code policy §275-3 "Findings; purpose;Jurisdiction; setbacks" D. Setbacks. (1) The following minimum setbacks apply to any and all operations proposed on residential property within the jurisdiction of the Board of Trustees: (a) Wetland boundary or bank. (b) Top of bluff. [1]Residence: 100 feet. The proposed work includes the seaward extension onto a home that meets the 100ft setback from the wetland boundary. Although the property does include a fairly steep rear yard facing the water it does not meet the definition of a bluff as defined by Chapter§275-2 Definition and word usage. BLUFF Land presenting with a precipitous or steeply sloped face adjoining a beach or a body of water. For the purposes of this chapter, a precipitous or steeply sloped face shall be a face with a slope of 20% or greater and a height of greater than 20 feet between the toe of the bluff and the top of the bluff. Based on the plan submitted, the slope in the rear yard immediately behind the home from the 14' contour down to the 10' contour is separated by 1". Given that the scale of the plan is 1" =20' this translates to a slope of 20%, but the overall rise from the lowest point of the bank to the top does not meet the 20' vertical minimum requirement defined above, so this rear yard cannot be considered a bluff. While the home extension is consistent with the LWRP the Board of Trustees should consider the impact of the second-floor extensions on the view of the neighbors to the east given the fact that the addition extends the existing home further past the pier line.
