A Local Law in Relation to an Amendment to §280-207, Maximum Gross Floor Area
(Resolution 2025-923)
The Planning Board supports the proposed code amendment,which eliminates an onerous and
impractical requirement when evaluating applications for variances from the gross floor area limitations
in the zoning code. Importantly, this amendment does not alter the broader obligation of the Zoning
Board of Appeals to consider community character when reviewing any variance request.
The Planning Board appreciates the opportunity to provide comments on this local law.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2025-923 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
DECEMBER. 2, 2025:
VMEREAS, there was presented to the Town Board of the Town of Southold, Suffolk County,
New York, on the 2nd day of December 2025, a Local Law entitled "A Local Law 1n relation to
Amendments to Chapters 2 8 0" and
RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the
aforesaid Local Law at Southold Town Hall, 53095 Main Road, Southold,New York, on the
13th day of January 2026, at 6:00 p.m. at which tulle all interested persons will be given an
opportunity to be heard, be it htrther
RESOLVED that the Town Board of the Town of Southold hereby declares itself lead agency for
the purposes of SEQRA review of the proposed local law; and be it further
RESOLVED that the Town Board of the Town of Southold has requested the Planning Board
and/or Planning Staff to prepare a report and recon-niendations on the proposed local Law,
including a SEQRA and LWRI' reports and reconu-nendations; and it is fiirther
RESOLVED that the Town Clerk of the Town of Southold is directed to forward the following
to the Suffolk County Planm*n.g Concession, along with any associated fees, for a report and
recommendations.
The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 280"
reads as follows:
LOCAL LAW NO. -2026
BE IT ENACTED by the Town.Board of the To Nm of Southold as follows:
I. Purpose.
The purpose of this local law is to address issues concerning the maxii-nimi size of one and two
family dwellings in certain zoning districts consistent with the Southold Town Comprehensive
Plan adopted September 8, 2020, the Vision Statement of which calls for future planning within
the Town to be consistent with existing cormuunity character and a periodic review and
amendment of the Town Code to that end.
The Town Board because of objectives outlined M' the plan, especiaily Chapter 3 Land Use and
Zoning, finds it necessary to modify the code that established standards for the construction and
reconstniction of residential dwellings in certain zoning districts to modify the requirements
concerning the use of GFA.
IL Chapter 280 of the Code of the Town of Southold is hereby amended to include the
underlined words and remove the struck-through words as follows:
§ 280-207. Maximum gross floor area for residential dwellings In A-C,R-40, R-80,R-
120, R-200, and R-400 Districts

(c) The new construction, reconstruction or improvement of any dwell'

111. SEVERA-BILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, thejudgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be tuiconstitialonal or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
